Upshot for lawyers, firms, law profs: its not enough to take admin law anymore. Statutory interpretation is a must, and those classes must teach textualism.

If members of Congress want to help the country they should start pushing back against the Supreme Court. Article III says “ the supreme Court shall have appellate Jurisdiction, both as to Law and Fact, with such Exceptions, and under such Regulations as the Congress shall make.”

Well law professors have been part of the problem (I know, I'm one of them. They have taught too many students to think the court virtuous and congress contemptible. They need to breed new political leaders

MAGA is justifying the Trump ruling on the theory that it prevents Trump from prosecuting Biden. It does not. Trump will prosecute Biden for fake claims about corruption which have been repeatedly debunked based on private acts.

30 years ago I went to the library to draft VAWA. This law saved lives, not only for those abused, but for all the crime it prevented. So proud to be at the White House yesterday for the man who has stood by it, and pushed it, and made it real.

Since we passed the Violence Against Women Act, rates of domestic violence have dropped – between 1993 and 2022 annual rates fell by almost 70%. Rapes and sexual assaults declined by 56%. It matters.
President Joe Biden delivers remarks at the celebration of the 30th anniversary of the Violence Against Women Act.

Stop saying this is just politics; they believe in the theory of the unitary executive. They believe in originalism and textualism. Those theories have to be debunked just like Project 2025.

John Roberts sounds delusional. Not insane or hallucinating. But so out of touch, so high on his own supply, so deep in a bubble that Roberts—per this NYT report—thought his awfully reasoned, wildly un-American immunity ruling would be well received by the public and history.

You cannot filibuster reconciliation. You only need 51 votes for nominees.

Senate Republicans apparently threatened to use the filibuster to stop all other senate business -- including COVID19 relief for desperate American families -- if this trial were to continue and hear witnesses. Never before has the GOP stooped so low to defend Donald Trump.

Just posted a major SCOTUS review I've been working on for two years.papers.ssrn.com/sol3/papers.cf…. Covers 124 cases and 300 opinions. Focus: originalism and textualism...How did that work out?

Supreme Court reformers: the left has lost the battle for ideas. Textualism and originalism remain supreme and it's time to push back. See my latest with @EskridgeBill "Gerrymandering the Text," just posted on SSRN, out in @nyulawreview soon.

Law schools taught the current Justices that the Court is the center of the constitution. It is not. Justice Gorsuch does not understand that the Constitution's text--yes, its text-- is mostly about self-governance and elections. Judicial imperialism is in for a hard fall.

OPINION: We should take Neil Gorsuch’s “be careful” warning to the president seriously, because the fact that he felt free to issue it shows the real dangers of an unchecked Supreme Court. trib.al/ALznx4B
