    In theory, I don't see how the concept of a lip bite surrounded by neon can be copyrightable subject matter. But no predicting courts.

    PACER should be free. It is ridiculous & inexcusable that the federal courts continue to charge people for access to public information.

    An observation: if you are planning to ask (REQUIRE!) your students to pay $300 for a fucking textbook that consists mostly of public domain material, you might want to reconsider. We can AND SHOULD do better. If there is an open access version, use it. If not, write it.

    This person is wrong. Quoting song lyrics in a book is absolutely fair use. The problem here is not authors exercising their fair use rights, but spineless publishers who refuse to defend them. See, e.g., papers.ssrn.com/sol3/papers.cf…

    Dear authors: Stop. Quoting. Song lyrics. Just stop. You don't have explicit written permission from the copyright holders. You probably can't afford permission. Just don't do it.

    BigLaw firm Winston & Strawn was sued today for allegedly plagiarizing another firm's Rule 12 motion. Hsuanyeh Law Group registered one of its Rule 12 motions with the Copyright Office and says Winston copied it "nearly verbatim" in a consolidated case.

    Today, @songadaymann and I sued the @SECGov in Louisiana federal court, asking for a declaration that the SEC can’t regulate the sale of NFT art. I’ve argued that the SEC is abusing its authority for years & now I’m testing my theory. Here’s the complaint.

    An observation for my law professor friends: As you prepare for your classes in the fall, consider assigning a free, open-access casebook. There is at least one available for almost every subject & your students will thank you for it. The ~$250 you save each one matters a lot.
