Terms and Conditions of Use Agreement between TheSourceBottle Pty Ltd (ACN 147 880 064) (‘SourceBottle’) and users (‘You/Your’) of the SourceBottle website (‘Website’).

Your use of the Website is subject to these legally binding terms and conditions. If You do not accept these terms and conditions, You must not use the Website.

This Agreement must be read in conjunction with the Privacy Policy and any other policies notified on the Website.

Website Use

You agree that You will not use the Website for any unlawful, misleading or deceptive purpose, or any purpose prohibited by this Agreement or by applicable laws in Australia.
You must not:

You may only use the Website for its proper, lawful purposes. The Website is owned and operated by SourceBottle, and this Agreement may be revised by SourceBottle from time to time.

Violate or attempt to violate the security of the Website.

Hack into the Website, SourceBottle’s computer systems, or the computer systems of other users of the Website.

Use another user’s login or otherwise access the Website without proper authorisation.

Engage in any activity that may cause undue burden or interference with the operation of the Website, including but not limited to mail bombing, propagating viruses, worms or other malicious programs, deliberate attempts to overload a computer system or broadcast attacks.

Your use of the Website does not include any right to Deep Hyperlink to web pages within the Website without going through the Website homepage or other nominated entry points.

You agree to use the Website in a responsible manner and in accordance with all applicable laws, including in a manner that does not restrict, inhibit or interfere with any other person’s use and enjoyment of the Website.

Your Contributions to the Website

You may submit content to the Website for inclusion. SourceBottle may, in its sole discretion, determine whether Your content will be included, and reserves the right to edit, amend, refuse or remove any content submitted by You.

You warrant that You are permitted to submit any content You provide, and that You will not submit, post or email any material that:

Breaches any law or regulation.
Is obscene, explicit, pornographic, defamatory, inflammatory, misleading or otherwise objectionable.
Could give rise to civil or criminal liability.

You warrant that You own all intellectual property rights in the information and content You provide to SourceBottle.

Except for Your personal information (which is dealt with under the Privacy Policy), You immediately assign to SourceBottle, upon creation, all intellectual property rights in all information and content provided by You to SourceBottle (including Your Website postings).

Services Provided on the Website

SourceBottle reserves the right to add, modify or discontinue any of the services offered on the Website at any time without prior notice. SourceBottle will not be liable for any decision to add, modify or discontinue a service.

Sign Up and Registration

You may sign up to receive email alerts from SourceBottle by completing the online registration form ('Registration Form'). It is a condition of registration that You provide a valid email address and a secure password, and that You keep these details accurate and up to date. You must not share Your password with any third party.

Registration to the Website is free and entitles You to see content on the Website. However, as a Subscriber You are subject to the following rules:

Spamming a journalist, blogger or writer is grounds for being immediately banned from receiving queries/call outs or visiting the Website. Any response that does not answer a query/call out posted on the Website is considered “off‑pitch” and deemed spam.
You may forward “Drink Up” alerts or individual call outs, but You may not post them on blogs, social media or elsewhere on the web unless You have SourceBottle’s express permission.
You must not collect or harvest email addresses obtained through the Website or “Drink Up” alerts for any reason, including building mailing lists or databases.
If someone else spams a journalist/blogger as a result of You forwarding or passing on “Drink Up” alerts or individual call outs, You may be held responsible for their actions and immediately banned from receiving queries/call outs or visiting the Website.
You must not request payment for comment unless the relevant call out specifically indicates that payment is available for successful sources.

If You are in breach of any of these rules, You may be banned from the Website without further warning. SourceBottle also reserves the right to publicise the identity of anyone who misuses the service or is otherwise in breach of these terms and conditions to other users of the Website and SourceBottle services.

Using the Website and SourceBottle’s services constitutes Your acknowledgement of, and agreement to, these terms and conditions.

Paid Subscriptions

Certain services or features on the Website are available through paid subscription plans ('Subscription Services'). By purchasing or using Subscription Services, You agree to the following:

- Subscription Fees

Subscription fees are payable in advance at the rate displayed on the Website at the time of purchase or renewal.
Fees are generally stated in Australian dollars (AUD) and may be updated from time to time. If fees change, SourceBottle will use reasonable endeavours to provide notice on the Website or via email before the change takes effect.

- Payment Processing

Subscription fees are processed through SourceBottle’s authorised payment providers.
You must ensure that all payment information (including credit card or other payment details) is accurate, current and authorised.
If payment cannot be processed, SourceBottle may suspend or terminate Your access to Subscription Services until payment is successfully completed.

- Automatic Renewal

Unless You cancel before the end of the then‑current subscription period, Your subscription will automatically renew for consecutive periods equal to the original subscription term (for example, monthly or annually).
You authorise SourceBottle (and its payment providers) to automatically charge the applicable subscription fee to Your nominated payment method at the start of each renewal period, until You cancel.

- Cancellation by You

You may cancel Your subscription at any time via the account or billing settings made available to You, or by contacting SourceBottle support in writing.
Cancellation will take effect at the end of Your current billing period, and You will continue to have access to Subscription Services until that time.

- Refunds and Partial Refunds

To the extent permitted by the Australian Consumer Law, all subscription fees are non‑refundable, including where You cancel before the end of a billing period, fail to use the services, or change Your mind.
No partial or pro‑rated refunds will be provided for any unused portion of a subscription period.
Nothing in this Agreement excludes, restricts or modifies any rights or remedies that You may have under the Australian Consumer Law (including in relation to major failures, non‑supply or misrepresentation). Where You are entitled to a refund or other remedy under the Australian Consumer Law, SourceBottle will comply with those obligations.

- Changes to Subscription Services

SourceBottle may modify, upgrade, downgrade or discontinue any Subscription Services, plans or features from time to time.
Where a change has a material adverse effect on the Subscription Services You have already paid for, SourceBottle will use reasonable endeavours to provide advance notice and, where required by law, offer an appropriate remedy.

- Termination or Suspension by SourceBottle

SourceBottle may suspend or terminate Your subscription (and/or access to the Website) immediately if You breach this Agreement, misuse the Website, or engage in unlawful or harmful conduct.
Where suspension or termination is due to Your breach, You will not be entitled to a refund of any subscription fees already paid, except as required under the Australian Consumer Law.

Future changes

From time to time, this Agreement will be reviewed and may be revised. SourceBottle reserves the right to change this Agreement at any time and to revoke Your registration or access to the Website. Any changes to this Agreement will be posted on the Website.

Your continued use of the Website after any changes are posted will constitute Your acceptance of the varied Agreement.

Website availability

From time to time, the Website may be unavailable or experience down‑time, whether scheduled or unscheduled. SourceBottle will use reasonable efforts to minimise down‑time but does not guarantee that the Website will be available at all times.

SourceBottle will not be liable for any loss or damage You may suffer as a result of any interruption, suspension or unavailability of the Website.

Intellectual Property

Reproduction of part or all of the contents of the Website in any form is prohibited other than for Your individual, personal use. The contents of this Website must not be copied, reproduced, shared or otherwise communicated to third parties without SourceBottle’s prior written consent.

Without limitation, You agree that You will not print, distribute, display, sell, publish, broadcast, circulate, disseminate or commercially exploit, in any form or by any method whatsoever, any part of the contents of the Website, or incorporate Website material, or any part of it, in any work or publication (whether in hard copy, electronic or other form).

Unless otherwise indicated, all materials on the Website are protected as copyright, trade dress, trademarks and/or other intellectual property rights owned by SourceBottle or by other parties that have licensed their material to SourceBottle. The display of trademarks and notices on the Website is not intended to be a comprehensive compilation of all worldwide proprietary ownership rights held by SourceBottle.

All rights not expressly granted are reserved.

This Website may contain materials produced by third parties or links to other websites. Such materials and websites are provided by third parties and are not under SourceBottle's direct control. SourceBottle accepts no responsibility or liability in respect of any such third‑party materials or for the operation or content of other websites (whether or not linked to this Website).

You acknowledge that SourceBottle may require You to remove any link from another website to this Website which You install without obtaining SourceBottle's prior written consent.

Limitation of Liability

To the maximum extent permitted by law, and subject to any non‑excludable rights under the Australian Consumer Law, SourceBottle does not give any warranty in relation to:

The performance, availability or security of the Website.

To the maximum extent permitted by law, SourceBottle excludes all liability for loss or damage suffered by You (including but not limited to direct, indirect, incidental, special, consequential or exemplary damages, loss of profits or revenue, business interruption, loss of data or failure to realise anticipated savings, benefits or business opportunities) arising out of or in connection with:

Your use of, or reliance on, any information contained on the Website.

SourceBottle’s exclusion of liability applies whether a claim is made in contract, tort (including negligence), equity, under statute or otherwise, and even if SourceBottle has been notified of the possibility of such loss or damage.

Where liability under any condition, warranty or guarantee which cannot be excluded by law (including certain guarantees under the Australian Consumer Law) is implied into this Agreement, SourceBottle’s liability will, to the extent permitted by law, be limited to the resupply of the services or the payment of the cost of having the services supplied again.

You agree that any liability of SourceBottle to You at law will be reduced by the extent (if any) to which You contributed to the loss or damage.

Termination

SourceBottle reserves the right to cease providing the Website or any services (including Subscription Services) at any time.

SourceBottle shall not be liable to You for any cost, expense or damages arising from the termination of this Agreement or any service, except to the extent required by the Australian Consumer Law or other non‑excludable laws.

Governing law

These terms and conditions will be governed by and construed in accordance with the laws of Australia.

Definitions

In this Agreement, unless the context otherwise requires:

"Agreement" means these terms and conditions that apply to the use of the Website, as amended from time to time.

"Deep Hyperlink" means a direct hypertext link or hypertext linking, established by a third party for purposes other than non‑commercial personal use, from the Website where items or images from content providers reside to another web page, where such link bypasses the homepage of the Website or the homepages of sections of the Website where items or images reside.

"Registration Form" means the online registration form to be completed by You in relation to Your registration.

"SourceBottle" means TheSourceBottle Pty Ltd (ACN 147 880 064).

"Subscription Services" has the meaning given in the “Paid Subscriptions” section.
