hi I'm Elizabeth Talbot and this is Matthew Talbot and we're with the Talbot law group in Walnut Creek California and we are a trusted estate law firm that specializes in trusts litigation so today we're going to talk about trustees who are being sued by beneficiaries or other code trustees and the types of things that beneficiaries are suing trustees over yes and so today what we're talking about our trust litigation and in particular what happens if your trustee the types of things that you might see if someone tries to sue you we've been handling these types of cases over for over thirteen years so I've seen hundreds of these types of cases from every angle and so I have a lot of experience dealing with this and what I tend to see are these types of litigations one something related to trustee mismanagement that this trustee took the money this trustee invested the money poorly this trustee failed to sell the house or failed to rent the house out for a period of time another client was damaged because of this mismanagement or misappropriation so that's one kind another kind might be where certain assets should be in the trust and the trustee is not taking action to bring them in so let's say there's an allegation that a house should been put into the trust and maybe it's in the trustees name and so the trustee gets sued to try to bring that house into the trust so the beneficiaries will get it another type of matter would relate to an accountant if there's concerns that the accounting of the trustee the accounting being what assets are managed and how they were managed in a form for the court to review if people feel that that was not appropriately done then it may be a litigation over that those tend to be very technical it's very important to get an attorney if you have an accounting dispute sometimes there's allegations that the trustee is failed to act and must be removed because they just aren't doing their job is no communication and there's nothing like that at all another type of item that I sometimes see in litigation is invalidation and what I mean by that is an allegation of the trustee pressure the elder into pudding and signing a document putting together and signing a document that gives the trustee a larger percentage than they really should have of the trust and so then people will sue to try to invalidate that trust or trust amendment so those are some of the types of cases that we see whether it's trustee mismanagement failure to act assets that maybe should be in the trust and aren't in appropriate accounting or invalidation of trust amendments if you are dealing with one of these and someone has sued you it is important to get an attorney to defend yourself you need to know your rights and you need to prepare to avoid disastrous legal results thank you so much thank you
