Background
• The PLEB is a check and balance mechanism. it
is part of the Rule of Law under which an
ordinary citizen can have redress of his
grievance against law enforcers who abuse
their authority. The PLEB involves the active
participation of the community as a whole in
instilling discipline in the ranks of our law
enforcers, or providing rewards and incentives
for exceptional performance.
 There is a current push to strengthen the PLEBs to
empower citizens in consideration of recent events and
relevant developments in our country today. President
Rodrigo Roa Duterte has emphasized that while he
supports the police, he will not tolerate graft and
corruption and abuses. In other words, there is no place
for rogue policeman in the PNP. Thus, the PLEB plays a
role in weeding out police scalawags and helping good
cops remain good.
Creation

 The Sangguniang Panlungsod/Bayan in every city and


municipality shall create such number of People's Law
Enforcement Boards (PLEBs) as may be necessary:
Provided, That there shall be at least one (1) PLEB for
every five hundred (500) city or municipal police personnel
and for each of the legislative districts in a city.

 The PLEB shall be the central receiving entity for any


citizen’s complaint against the officers and members of the
PNP.
Functions, Powers and
Duties
 The PLEB empowers the people against abusive and
erring policemen. It has the power to hear and
adjudicate all citizen’s complaints formally filed with, or
referred to it, against any uniformed member of the
PNP, and if warranted, impose the corresponding
penalty.
Composition
1. Any member of the Sangguniang Panlungsod/Bayan chosen by his respective
Sanggunian;
2. Any barangay captain of the city or municipality concerned chosen by the
association of barangay captains; and
3. Three (3) other members who are removable only for cause to be chosen by
the local peace and order council from among the respected members of the
community known for their probity and integrity, one (1) of whom must be a
woman and another a member of the Bar, or, in the absence thereof, a college
graduate, or the principal of the central elementary school in the locality.

 The Chairman of the PLEB shall be elected from among its members.
 Membership in the PLEB is a civic duty.
 Quorum – Presence of 3 members of the PLEB: Provided that at least 3
members shall be required in rendering a decision.
 If for any reason, the chairperson is absent or is disqualified from
participating in the hearing, them members, there being a quorum, shall
elect from among themselves a temporary chairperson to perform the
duties of a chairperson.
 When a PLEB member, after sufficient notice, fails or refuses to attend the
hearings and/or deliberations of the Board without any valid and justifiable
reason and it could not proceed for lack of quorum, the Chairperson or the
designated presiding officer may request the Sangguniang
Panlungsod/Bayan or the Liga ng mga Barangay or the City/Municipal Peace
and Order Council, as the case may be, to designate a temporary
representative to enable the body to constitute a quorum: Provided, that
such temporary representative shall act as such only for the specific case.
 Disqualification by Reason of Affinity or Consanguinity. –
The Chairperson or any member of the PLEB who is related to the
complainant or respondent by affinity or consanguinity within the
fourth civil degree shall be disqualified from participating in the
proceeding and the case shall be tried by the remaining members:
Provided, that there is a quorum. in the event that the PLEB could
not proceed with the hearing for lack of quorum, the Peace and
Order Council, the Sangguniang Panlungsod/Bayan, or the Liga ng
mga Barangay of the city/municipality concerned shall appoint a
temporary member for that specific case only.
Procedure
 The PLEB, by a majority vote of all its members and its Chairman shall determine whether or not
the respondent officer or member of the PNP is guilty of the charge upon which the complaint is
based.

 Each case shall be decided within sixty (60) days from the time the case has been filed with the
PLEB.

 The procedures in the PLEB shall be summary in nature, conducted in accordance with due
process, but without strict regard to technical rules of evidence.

 The Commission may assign the present NAPOLCOM hearing officers to act as legal consultants
of the PLEBs and provide, whenever necessary, legal services, assistance and advise to the PLEBs
in hearing and deciding cases against officers and members of the PNP, especially those involving
difficult questions of law: Provided, That these lawyers may also be assigned to investigate claims
for death and disability benefits of PNP members or their heirs.

 Decisions — The decision of the PLEB shall become final and executory: Provided, That a decision
involving demotion or dismissal from the service may be appealed by either party with the
Jurisdiction of PLEB

 Citizen’s Complaints. – Any complaint by a natural or


juridical person against any member of the PNP shall be
brought before the People's Law Enforcement Board, where
the offense is punishable by withholding of
privileges, restriction to specified limits, suspension
or forfeiture of salary, or any combination thereof,
for a period exceeding thirty (30) days; or demotion
or by dismissal from the service.
