REQUEST OF THE EMPLOYEE AND AT
THE DISCRETION OF THE AUTHORITY

R-1. THESE RULES MAY BE CALLED THE CENTRAL CIVIL SERVICES
(LEAVE) RULES, 1972 WHICH COME INTO FORCE ON THE 1ST DAY
OF JUNE, 1972.

R-2.- ALL CENTRAL GOVT EMPLOYEES BUT NOT APPLICABLE


TO :-
(i) RAILWAY SERVANTS;
(II) PERSONS IN CASUAL OR DAILY-RATED OR PART-TIME
EMPLOYMENT;

(III) PERSONS PAID FROM CONTINGENCIES;

(IV) WORKMEN EMPLOYED IN INDUSTRIAL ESTABLISHMENTS;

(V) PERSONS EMPLOYED IN WORK-CHARGED ESTABLISHMENTS;

(VI) MEMBERS OF THE ALL INDIA SERVICES;
(VII) PERSONS LOCALLY RECRUITED FOR SERVICE IN

• R-7(2) : THE COMPETENT AUTHORITY MAY REFUSE
LEAVE OF ANY KIND BUT CANNOT CHANGE THE KIND
OF LEAVE DUE AND APPLIED FOR.
• R-7 : GID(2) - EARNED LEAVE SHOULD NOT ORDINARILY
BE DENIED DURING THE LAST TEN YEARS OF SERVICE.
• R-8 : REGULATION OF CLAIM TO LEAVE – IT IS
REGULATED BY THE RULES IN FORCE AT THE TIME OF
LEAVE IS APPLIED FOR AND GRANTED.
• R-9 : EMPLOYEES, WHO ARE REMOVED OR DISMISSED,
CANNOT CLAIM TO THEIR LEAVE AT CREDIT FROM THE
DATE OF REMOVAL OR DISMISSAL.
CHAPTER-II (R-7 TO R-13)

R-10(I) :LEAVE OF ONE KIND TAKEN EARLIER


MAY BE CONVERTED INTO LEAVE OF A OTHER
KIND IF APPLIED WITHIN THIRTY DAYS AFTER
RETURN FROM LEAVE.
NOTE : EXTRAORDINARY LEAVE GRANTED ON
MEDICAL CERTIFICATE OR OTHERWISE MAY BE
COMMUTED RETROSPECTIVELY INTO LEAVE NOT DUE
SUBJECT TO PROVISIONS OF RULE 31.

R- 11 : ANY KIND OF LEAVE MAY BE GRANTED


IN COMBINATION WITH ANY KIND OF LEAVE
EXCEPT CASUAL LEAVE WHICH IS NOT
RECOGNIZED AS LEAVE UNDER THESE RULES.
CHAPTER-II (R-7 TO R-13)
R.12 : MAXIMUM AMOUNT OF CONTINUOUS LEAVE.
NO LEAVE OF ANY KIND CAN BE GRANTED FOR A
CONTINUOUS PERIOD EXCEEDING FIVE YEARS
EXCEPT THE SANCTION OF THE PRESIDENT. (READ
WITH FR-18).
PROVIDED THAT THIS RULE SHALL NOT APPLY TO A
CASE WHERE LEAVE IS APPLIED ON MEDICAL
CERTIFICATE, IN CONNECTION WITH A DISABILITY.
R.13 : ACCEPTANCE OF SERVICE OF EMPLOYMENT
WHILE ON LEAVE
A GOV. SERVANT INCLUDING LEAVE PREPARATORY
TO RETIREMENT SHALL NOT TAKE UP ANY SERVICE
OR EMPLOYMENT ELSEWHERE WITHOUT OBTAINING
THE PREVIOUS SANCTION OF THE COMPETENT
AUTHORITY.
CHAPTER-III - GRANT AND RETURN FROM LEAVE

R-17. – LEAVE SHALL NOT BE GRANTED IN WHERE COMPETENT


PUNISHING AUTHORITY HAS DECIDED TO DISMISS, REMOVE OR
COMPULSORILY RETIRE FROM GOVERNMENT SERVICE.
LEAVE MAY NOT BE GRANTED TO A GOVERNMENT SERVANT
UNDER SUSPENSION
R- 22. - COMBINATION OF HOLIDAYS WITH LEAVE.
R.22 (1) (II) (B) - WHEN A GOVT. SERVANT IS CERTIFIED
MEDICALLY FIT FOR JOINING DUTY, HOLIDAY (S) IF ANY,
SUCCEEDING THE DAY HE IS SO CERTIFIED (INCLUDING THAT
DAY) SHALL AUTOMATICALLY BE ALLOWED TO BE SUFFIXED TO
THE LEAVE, AND HOLIDAY(S), IF ANY, PRECEDING THE DAY HE
IS SO CERTIFIED SHALL BE TREATED AS PART OF THE LEAVE.
CHAPTER-III - GRANT AND RETURN FROM LEAVE

R.22(3)(A) - IF HOLIDAYS ARE PREFIXED TO LEAVE, THE


LEAVE AND ANY CONSEQUENT REARRANGEMENT OF
PAY AND ALLOWANCES TAKE EFFECT FROM THE DAY
AFTER THE HOLIDAYS ; AND

R.22 (3)(B) - IF HOLIDAYS ARE SUFFIXED TO LEAVE, THE


LEAVE IS TREATED AS HAVING TERMINATED AND ANY
CONSEQUENT REARRANGEMENT OF PAY AND
ALLOWANCES TAKES EFFECT FROM THE DAY ON
WHICH THE LEAVE WOULD HAVE ENDED IF HOLIDAYS
HAD NOT BEEN SUFFIXED.
CHAPTER-IV (R-26 TO R-42)
R-26 : EARNED LEAVE (EL) FOR GOVT. SERVANTS
SERVING IN OTHER THAN VACATION DEPTS.
CREDIT : ADVANCE 15 DAYS ON IST JAN. AND IST
JUL. OF EVERY YEAR. THE CREDIT WILL BE
REDUCED BY 1/10TH OF THE EXOL AVAILED
AND/OR PERIOD OF DIES NON DURING THE
PREVIOUS HALF YEAR SUBJECT TO MAXIMUM 15
DAYS.
IT CAN BE ACCUMULATED UP TO 300 DAYS IN
ADDITION TO NUMBER OF DAYS FOR WHICH
ENCASHMENT HAS BEEN ALLOWED ALONG WITH
LTC.
CHAPTER-IV (R-26 TO R-42)
R-26 -GID (2) -WHILE LIMITING THE MAXIMUM 300 DAYS,
WHERE THE BALANCE AT CREDIT IS 286-300 DAYS,
FURTHER ADVANCE CREDIT OF 15 DAYS ON IST JAN.
AND IST JUL. WILL BE KEPT SEPARATELY AND SET OFF
AGAINST THE EL AVAILED OF DURING THE HALF YEAR
ENDING 30TH JUNE/31ST DECEMBER.
R-26(1)(A)(II) UN-AVAILED JOINING TIME (MAX. 15 DAYS)
REDUCED BY THE ACTUAL NUMBER OF DAYS AVAILED,
SHALL BE CREDITED TO EL SUBJECT TO TWO
CONDITIONS –
(a)HE IS ORDERED TO JOIN THE NEW POST WITHOUT
AVAILING FULL JOINING TIME ; OR
(b)HE JOINS TO THE NEW POST WITHOUT AVAILING
FULL JOINING TIME AND TAKES HIS FAMILY LATER
WITHIN SIX MONTHS ;
R-26(2) : EL CAN BE AVAILED UP TO 180 DAYS AT A

R-27.(1) & (2) : CREDIT OF EL FOR THE HALF YEAR OF


INITIAL APPOINTMENT OR AT THE TIME OF
RETIREMENT WILL BE @ 2.5 DAYS PER MONTH FOR
EACH COMPLETED CALENDAR MONTH.

R-27(4) :WHILE AFFORDING CREDIT, FRACTION OF A


DAY SHOULD BE ROUNDED OFF TO THE NEAREST DAY
E.G. 7.5 DAYS TO BE ROUNDED OFF AS 8 DAYS.
CHAPTER-IV (R-26 TO R-42)
R-29 : HALF PAY LEAVE
WITH EFFECT FROM 01.01.1986, HPL IS CREDITED IN
ADVANCE A UNIFORM RATE 10 DAYS OF IST JAN. AND
IST JUL OF EVERY YEAR.
CREDIT IS 5/3 DAYS IS GIVEN FOR EACH COMPLETED
CALENDAR MONTH FOR INITIAL JOINING OR
RETIREMENT AT THE MIDDLE OF THE HALF YEAR.
HPL CREDITED IN EVERY HALF YEAR WILL BE
REDUCED BY 1/18TH OF THE PERIOD OF DIES
NON/SUSPENSION TREATED AS DIES NON DURING THE
PRECEDING HALF YEAR.

R-29 : HALF PAY LEAVE (CONTD…)


WHILE AFFORDING CREDIT, FRACTION SHALL BE
ROUNDED OFF TO THE NEAREST DAY.
IT CAN BE AVAILED WITH OR WITHOUT MEDICAL
CERTIFICATE.
CAN BE COMMUTED IN FULL DAY LEAVE WITH
MEDICAL CERTIFICATE OR FOR STUDY LEAVE (NOT
MORE THAN 180 DAYS DURING ENTIRE SERVICE).
CHAPTER-IV (R-26 TO R-42)
R-30 : COMMUTED LEAVE
COMMUTED LEAVE IS NORMALLY TAKEN ON MEDICAL
CERTIFICATE. IF IT IS TAKEN, TWICE THE NUMBER OF
DAYS SHOULD BE DEBITED IN THE HALF PAY LEAVE
ACCOUNT. IT MAY BE GRANTED AT THE REQUEST OF
THE GOVT. SERVANT EVEN WHEN EARN LEAVE (EL) IS
AVAILABLE.
IT CAN ALSO BE TAKEN WITHOUT MEDICAL
CERTIFICATE –
• UP TO 90 DAYS IN THE ENTIRE SERVICE IF UTILIZED
FOR APPROVED STUDY IN PUBLIC INTEREST
• UP TO 60 DAYS BY A FEMALE GOVT. SERVANT IF IT IS
IN CONTINUOUS OF MATERNITY LEAVE.
CHAPTER-IV (R-26 TO R-42)

R.31 : LEAVE NOT DUE (LND)


• NO BALANCE IN HPL.
• LND CAN BE GRANTED TO A PERMANENT GOVT.
SERVANT AND TEMPORARY OFFICIALS WITH
MINIMUM OF ONE YEAR’S SERVICE AND SUFFERING
FROM TB, LEPROSY, CANCER OR MENTAL ILLNESS
ETC.
• *THE AMOUNT OF LEAVE SHOULD BE LIMITED TO
THE HALF PAY LEAVE THAT THE GOVT. SERVANT IS
LIKELY TO EARN SUBSEQUENTLY.
• LND DURING THE ENTIRE SERVICE IS LIMITED TO A
MAXIMUM OF 360 DAYS.
CHAPTER-IV (R-26 TO R-42)
R.31(2)(A) : WHERE A GOVERNMENT SERVANT WHO
HAS BEEN GRANTED LEAVE NOT DUE RESIGNS
FROM SERVICE OR AT HIS REQUEST PERMITTED TO
RETIRE VOLUNTARILY WITHOUT RETURNING TO
DUTY, THE LEAVE NOT DUE SHALL BE CANCELLED,
HIS RESIGNATION OR RETIREMENT TAKING EFFECT
FROM THE DATE ON WHICH SUCH LEAVE HAD
COMMENCED, AND LEAVE SALARY SHALL BE
RECOVERED.
PROVIDED THAT NO LEAVE SALARY SHALL BE
RECOVERED IF THE RETIREMENT IS BY REASON OF
ILL HEALTH INCAPACITATING THE GOVERNMENT
SERVANT FOR FURTHER SERVICE OR IN THE EVENT
OF HIS DEATH.
CHAPTER-IV (R-26 TO R-42)

• RULE - R-32 : EXTRAORDINARY LEAVE (EOL)


• NO SALARY.
• EOL IS GRANTED TO GOVT. SERVANT –
• WHEN NO OTHER LEAVE IS ADMISSIBLE;
• WHEN OTHER LEAVE IS ADMISSIBLE, BUT THE
GOVT. SERVANT APPLIES IN WRITING FOR EOL.
• EOL CANNOT BE AVAILED CONCURRENTLY DURING
THE NOTICE PERIOD, WHEN GOING ON VOLUNTARY
RETIREMENT.
• LIMIT : (A) ALL OFFICIALS UP TO 3 MONTHS WITH
OR WITHOUT MEDICAL CERTIFICATE.

R-32 - : EXTRAORDINARY LEAVE (EOL) CONTD.


(B) ONE YEAR SERVICE – UP TO 18 MONTHS.
(C) MORE THAN ONE YEAR – UP TO 24 MONTHS FOR
STUDIES IN PUBLIC INTEREST.
• TWO SPELLS OF EOL, INTERVENED BY ANY OTHER
KIND OF LEAVE, SHOULD BE TREATED A ONE
CONTINUOUS SPELL FOR THE PURPOSE OF APPLYING
THE MAXIMUM LIMIT.
• EOL MAY ALSO BE GRANTED TO REGULARIZE PERIODS
OF ABSENCE WITHOUT LEAVE RETROSPECTIVELY.
CHAPTER-IV (R-26 TO R-42)

R.33 : LEAVE TO PROBATIONER, A PERSON ON PROBATION


AND AN APPRENTICE.
(1) A PROBATIONER SHALL BE ENTITLED TO LEAVE UNDER
THESE RULES IF HE HELD HIS POST SUBSTANTIVELY
OTHERWISE THAN ON PROBATION.
(2) A PERSON ON PROBATION SHALL BE ENTITLED TO
LEAVE UNDER THESE RULES AS TEMPORARY OR
PERMANENT GOVT. SERVANT.
(3) AN APPRENTICE SHALL BE ENTITLED TO LEAVE ON MC,
ON LEAVE SALARY EQUIVALENT TO HALF PAY FOR A
PERIOD NOT EXCEEDING ONE MONTH IN ANY YEAR OF
APPRENTICESHIP.
CHAPTER-IV (R-26 TO R-42
R-34 : PERSONS RE-EMPLOYED AFTER RETIREMENT
IN THE CASE OF PERSONS RE-EMPLOYED AFTER
RETIREMENT, THE PROVISIONS OF THESE RULES SHALL
APPLY AS IF HE HAD ENTERED GOVT. SERVICE.

R.38 : LEAVE PREPARATORY TO RETIREMENT (LPR)


• A GOVT. SERVANT MAY BE PERMITTED BY THE
COMPETENT AUTHORITY TO GRANT LEAVE TO
TAKE LEAVE PREPARATORY TO RETIREMENT TO
THE EXTENT OF EARNED LEAVE DUE, NOT
EXCEEDING (300 DAYS) TOGETHER WITH HALF
PAY LEAVE DUE, SUBJECT TO THE CONDITION
THAT SUCH LEAVE EXTENDS UP TO AND
INCLUDES THE DATE OF RETIREMENT.
RULE 38-A – ENCASHMENT OF EL WITH LTC

(i) (A) A BALANCE AT LEAST THIRTY DAYS EL IS AVAILABLE


TO HIS CREDIT AFTER AVAILING THIS AND
(B) THE TOTAL LEAVE SO ENCASED DURING THE ENTIRE
CAREER DOES NOT EXCEED SIXTY DAYS IN THE
AGGREGATE.
• (II) FORMULA = (PAY +DA) X NO OF DAYS*
30 *(MAX 10 DAYS)

• REFUND WITH INTEREST IF NOT AVAILING LTC.


CHAPTER-V (R-43 TO R-49)

R-39 : LEAVE/CASH PAYMENT IN LIEU OF LEAVE


BEYOND THE DATE OF RETIREMENT OR QUITTING OF
SERVICE.
(I) NO LEAVE SHALL BE GRANTED TO A GOVT.
SERVANT BEYOND HIS DATE OF RETIREMENT OR THE
DATE OF CESSATION OF HIS SERVICE.
(II) ON RETIREMENT, CASH EQUIVALENT TO LEAVE SALARY
IS PAYABLE FOR MAXIMUM 300 DAYS.
(III) FORMULA = (PAY +DA) X NO OF DAYS

(IV) THE OVERALL LIMIT FOR ENCASHMENT OF LEAVE
INCLUDING HALF PAY LEAVE SHALL NOT EXCEED 300 DAYS.

ENTITLED TO LEAVE SALARY EQUAL TO THE PAY

(4) A GOVT. SERVANT ON COMMUTED LEAVE IS

(5) A GOVT. SERVANT ON EOL IS NOT ENTITLED TO

DRAWAL OF LEAVE SALARY

R-41 : THE LEAVE SALARY PAYABLE UNDER THESE


RULES SHALL BE DRAWN IN RUPEES IN INDIA.

R-42 : A GOVT. SERVANT INCLUDING A GOVT.


SERVANT ON FOREIGN SERVICE, PROCEEDING ON
EAVE FOR A PERIOD NOT LESS THAN THIRTY DAYS
MAY ALLOWED AN ADVANCE IN LIEU OF LEAVE
SALARY UP TO A MONTH’S PAY AND ALLOWANCES
AS ADMISSIBLE AFTER DEDUCTIONS OF INCOME
TAX, PROVIDENT FUND, HOUSE RENT, RECOVERY OF
ADVANCES ETC.
CHAPTER-V (SPECIAL KINDS OF LEAVE-

• R.43 : MATERNITY LEAVE

• ADMISSIBLE TO MARRIED/UNMARRIED FEMALE


EMPLOYEES DURING ;
• PREGNANCY – 180 DAYS WEF 01.09.2018 (LESS THAN
TWO SURVIVING CHILDREN).
• MISCARRIAGE/ABORTION : TOTAL OF 45 DAYS IN THE
ENTIRE SERVICE EXCLUDING ANY SUCH LEAVE
TAKEN PRIOR TO 16-06-1994.
• IT IS NOT ADMISSIBLE ON ‘THREATENED ABORTION’
BUT ADMISSIBLE FOR INDUCED ABORTION.
• THE LEAVE IS NOT DEBITED TO LEAVE ACCOUNT.
SPECIAL MATERNITY LEAVE.

• A SPECIAL MATERNITY LEAVE IS GRANTED TO A FEMALE


CENTRAL GOVERNMENT SERVANT IN CASE OF DEATH OF

• BEFORE 15 DAYS OF WIFE’S CONFINEMENT OR UPTO
SIX MONTH FROM THE DATE OF DELIVERY.
• IF NOT AVAILED OF WITHIN THIS PERIOD, IT SHOULD BE
TREATED AS LAPSED.
• LEAVE ACCOUNT IS NOT DEBITED AND EQUAL TO LAST

WHO SUFFERS ILLNESS OR INJURY THAT IS ATTRIBUTABLE
TO OR AGGRAVATED IN THE PERFORMANCE OF HIS/HER
OFFICIAL DUTIES.
• FULL PAY AND ALLOWANCES DURING THE PERIOD OF
HOSPITALIZATION.
• BEYOND HOSPITILASITION ;-
• FULL PAYMENT UP TO SIX MONTHS IMMEDIATELY AFTER
HOSPITALIZATION ANDTHEREAFTER, HALF PAY LEAVE
ONLY FOR 12 MONTHS BEYOND THAT. THE HPL MAY BE
COMMUTED TO FULL PAY AFTER DEBITING
CORRESPONDING NUMBER OF HPL.
• NO EL OR HPL WILL BE CREDITED DURING THE PERIOD
THAT THE EMPLOYEE IS ON WRILL.

(I) LEAVE UP TO MAXIMUM90 DAYS SHALL BE
GRANTED TO AN AGGRIEVED FEMALE GOVT.
SERVANT, DURING THE PERIOD OF PENDENCY
OF INQUIRY ON THE RECOMMENDATION OF
THE INTERNAL COMPLAINT COMMITTEE (ICC).

(II) THIS LEAVE SHALL NOT BE DEBITED TO


THE LEAVE ACCOUNT.
RULE -66 : REPEAL AND SAVING
(1) ON
THE COMMENCEMENT OF THESE RULES, EVERY
RULE, REGULATION OR ORDER, INCLUDING OFFICE
MEMORANDUM (HEREINAFTER REFERRED TO IN THIS
RULE AS THE OLD RULE) IN FORCE IMMEDIATELY
BEFORE SUCH COMMENCEMENT SHALL, IN SO FAR
AS IT PROVIDES FOR ANY OF THE MATTERS
CONTAINED IN THESE RULES, CEASE TO OPERATE.
(2)NOTWITHSTANDING SUCH CESSER OF OPERATION,
ANYTHING DONE OR ANY ACTION TAKEN OR ANY
LEAVE EARNED BY, OR GRANTED TO, OR ACCRUED
TO THE CREDIT OF A GOVERNMENT SERVANT, UNDER
THE OLD RULE, SHALL BE DEEMED TO HAVE BEEN
DONE, TAKEN, EARNED, GRANTED OR ACCRUED
UNDER THE CORRESPONDING PROVISIONS OF
THESE RULES.
