What are IPR’s?
 Intellectual property (IP) is a category of property that includes
intangible creations of the human intellect.
 IPR's are extremely essential for fostering
creativity and contribute towards the
economic growth of a nation.
 Such rights allow creators and inventors
to have control over their creations.
Types of IPR
 Copyright
 Trademark
 Geographical indications
 Patent
 Design
 Plant variety
 Semiconductor Integrated Circuits Layout Design
Importance of IPR’s in
nurturing businesses
IPR encourages innovation, attracts
investment, and ensures businesses can
confidently bring new ideas to market without
fear of unauthorized use or replication. IPR
fosters a conducive environment for
entrepreneurship, stimulating economic growth
and promoting a culture of innovation.
Copyrights
Copyright is a legal concept that grants the creator
of an original work exclusive rights to its use and
distribution. This protection is applicable to a wide
range of creative works, including literature, music, art, and
software. It gives the creator or copyright holder the right to control
how their work is reproduced, distributed, performed, and displayed.
This system encourages artistic and intellectual production by
providing creators with a level of control over their creations and
potential financial benefits from their use
Trademark
A trademark is any word, name, or symbol ) that
lets us identify the goods made by an individual,
company, organization, etc. A trademark helps in distinguishing
similar products in the market from its competitors.
Trademarks prevent others from using similar logos or names that
may confuse or deceive consumers. Trademarks can appreciate in
value over time leading your brand increasing in value.
Geographical Indication
A geographical indication is a sign used on products
that has a specific geographical origin and includes
the qualities or reputation of that origin.
Gi is primarily an indication which identifies
agricultural, natural products originating from a
definite geographical territory, where a given
quality, reputation or other characteristic are
essentially attributable to its geographical origin.
Patent
A 'patent' is an exclusive right granted by the
government, preventing others from making, using, offering for
sale, selling, or importing the invention. It is a form of IPR
safeguarding scientific inventions, demonstrating technical
advancement over existing products.
The purpose of patent is to encourage innovation in scientific
field a patent grants exclusive rights to the inventor for a period
of 20 years once the term of patent expires the invention is in
public domain, which is then free to use by the public domain
Design
In the realm of intellectual property, a "design" refers to
the unique aesthetic appearance of an object,
encompassing its visual features and ornamental elements.
A design patent protects only the appearance of the article.
In India, protecting such designs is achieved through design patents.
Eg: The specific design elements of Crocs footwear, such as the
ventilation holes and overall shape, have been protected by design patents.
Plant Variety
A plant variety is a specific type of plant that has unique traits,
like its color or size. To protect the rights of those who develop
these new plants, there are rules in place, like PPVFR. Plant
variety protection in India is safeguarded through the Plant
Variety Protection And Farmers Rights (PPVFR) Act, 2001.
These rules encourage innovation in plant
breeding by giving legal rights to those who
create new and distinct plant varieties.
Semiconductor Integrated
Circuits Layout Design
The arrangement of various components on a
semiconductor wafer to create an integrated
circuit (IC). The layout design specifies the
placement and interconnections of transistors,
resistors, capacitors, and other elements to achieve the
desired functionality.
Recent News in IPR
Mickey Mouse entered US public domains
on 1st January 2024. The expiration of
Copyright for early versions of Mickey
Mouse, particularly those in "Steamboat
Willie" and "Plane Crazy," opens the door for their use in new
creative works. This means that you can incorporate the original
Mickey and Minnie Mouse characters from these early works
into your own creative projects without infringing on copyright.
