 ST Guidelines on Licensing under Section 9 of the Act, refers to
Guidelines/ST/No.5/2016 stipulated:-

 “Public Installation” is an installation operated by a licensee for the


supply of electricity to any person other than the licensee: Provided
that the licensee may use electricity for his own purposed where the
use is consistent with the terms of the licence

 “Private Installation” is an installation operated by a licensee or owner


solely for the supply of electricity to and use thereof on the licensee’s
owner’s own property or premises, or, in the case of a consumer,
taking electricity from a public installation or supply authority, for use
only on the licensee’s or owner’s property or premises”

Activities under Public Installation Section 1.3 stipulate:-


i. operation of electricity generation for with an efficient
method such as co-generation for own consumption
and supply/sell surplus energy to others in the
complex or specific areas such as Gas District Cooling
(KLIA) Sdn. Bhd. at the airport or
ii. the supply/sale of electricity and other services to
users in complex or multi-storey buildings with
electricity purchased from the utility such as operating
of Malakoff Utilities in KL Sentral, Kuala Lumpur

 Section 2.2 stipulate the Government had outlining important


policies related to the electricity supply industry which includes:-
 iii) use advanced or efficient technology such as co-generation
and district cooling;
 iv) use of efficient technologies and methods in energy
management and provision of other services that have value
added to the users such as project Petronas CUF and Gas District
Cooling (GDC);
 v) provide a more efficient service, fast, economical and
satisfying to consumers such as electrical distribution in complex
multi-tenant;

 Appendix 12 FQA item 2 stated the minimum requirement of paid-
up capital is at least 2% of the total project cost or in case of
licence for distribution activities, 2% of connection charge.

 Licence period for public installation mentioned. Up to 21 yrs for


thermal and hydro depend on PPA. Distribution Licence – 10 yrs.

 Company can hold more than one licence. Eg same shopping mall
owner hold distribution licence at different locations.

 Generating Licence refer to Appendix 7 of the Guidelines on


Licensing under Section 9 of the Act (Electricity Supply Acct
1990)– Generating Licence issued by Main Office (i)
Utility/IPP Generating Licence
 Part II refers to Grant of Licence, stipulate expiry of the
completion date
 Part II refers to Interpretation and Construction
 Part III refers to Conditions of the Licence, stipulated 27
conditions licensee required to meet.
 Part IV refers to revocation of licence.

 Distribution licence refer to Appendix 10 of the


Guidelines on Licensing under Section 9 of the Act
(Electricity Supply Acct 1990)– Distribution Licence
issued by Main Office
 i. Part II refers to Terms of Licence, stipulate expiry of
the completion date
 ii. Part II refers to the Condition, stipulated 22
conditions licensee required to meet.Part III refers to
revocation of licence.

installation shall be refers to oas.st.gov.my

 Section 3.1 item vii) stated Minister of Energy,


Green Technology and Water approval is required
for licence application with capacity of 30MW and
above.

 Section 3.1 stated at the Commission’s main office, an application


of licence for public installation will be processed by Licensing
Unit, Department of Industry Development and Electricity Market
Regulation. It is advisable to submit the application at least 3
months before Initial Operation Date (IOD) through online
application system (OAS).
 
 Appendix 12 item 7 stipulated the processing time for the
Commission to approve the application of licence for public
installation for online application is 60 working days.
 
 Based on the feedback from those who have dealt with ST, actual
application process normally takes 6-9 months to obtain approval
including discussion with ST prior submission.
