MEANING OF ETHICS
• Derived from Greek word “ethos” meaning character.
• Object -to create self-awareness between good and desirable behaviour
from bad and undesirable behaviour.
• Involves study of moral values and principles and facilitates conduct of
proper human behaviour in their daily life.
• Thus both the words moral and ethics are mostly synonymous and refer to
a type of behavior practices by a group which tends to become customary.
But there is a slight difference in the two that moral or morality ordinarily
refers to the conduct itself, while ethics or ethical suggests the study of
moral conduct or the system of code which is to be followed
MEANING OF LEGAL ETHICS
• Code of conduct regulating the behaviour of Advocate.
• Various duties.
WHY DO WE NEED ETHICS IN LEGAL
PROFESSION?
• The Legal Profession plays an important role in the administration of Justice. The Lawyers are
considered to be the center of the administration of justice. Lawyers are the one who are related
to the parties, they listen to the party and collect all the relevant legal materials relating to the
case and argue the case in court, thus helping the Judge to arrive at the correct and fair judgment
• Object of Legal Profession
• Legal Profession not a business but a profession created by the state for public good.
• Unlike other profession, which are generally taken up with sole object of earning money, is a
profession of high dignity.
• An advocate has some moral obligation towards his client, courts and society in general-
situations of conflicting loyalties, therefore, study of ethics.
• Basic obligation- not to act contrary to the principles of morality and act honestly.

• Need of ethics :
1. To maintain dignity of profession
2. Friendly cooperation between Bench and Bar
3. Fair dealings of counsel with his client, opponents, witnesses.
4. Lawyers discharge their responsibility to the community generally.
• Ethics in contemporary times.
REGULATION OF LEGAL
PROFESSION
• The Advocates Act, 1961 governing law for legal profession in India.
• Disciplinary Committee of State Bar Council and Bar Council of India.
• In pursuance of power conferred u/s 49(1)(c) of the Act, BCI framed
Rules on Professional Standards included in Chapter II, Part VI of the
BCI Rules.
• Various Duties of Advocate- Court, Client, Colleagues, Opponents,
Society.
Why Codification of Legal Ethics?
• DEVIANT BEHAVIOUR NOT INTENTIONAL.
• SOCIAL CONTROL
• PREVENTS CONTROL/INTEREFERENCE BY GOVERNMENT/ANY OTHER
AGENCY.
• EDUCATIVE, APPRECIABLE VALUE.
• RAISE PROFESSIONAL STANDARDS.
