Leave means the authority/permission granted to the employee by the employer/competent
authority to keep away from his Bonafide Duties. Grant of Leave will benefit both the
employee as well as employer as the employee return refreshed after leave.

Kinds of Leave Rules to Railway Employees


1) Company Leave Rules
2) State Railway Leave Rules
3) Railway Services (Liberalised) Leave Rules 1949
⮚ रे लवे सेवाएँ (उदारीकृत) अवकाश नियम, 1949 w.e.f. 01.02.1949 (Para 501)
Briefly discussed in Chapter-V of IREC Vol-I
⮚ Applicable to all the Railway Servants who were joined on or after 01.02.1949 (502)
⮚ Leave cannot be claimed as “Matter of Right” except ML, PL. (503)
⮚ Counting of previous Leave balance in case of Tech. Resig./Re-instatement in
service/legal strike (504)
⮚ Conversion of one kind of leave to another kind is permissible within one month from
date of reporting from leave on request of the employee before he retires. (505)
⮚ Prefixed and suffixed holidays/rest should be treated as duty. The holidays falls between
the leave period will be counted as Leave (508)
⮚ Should not take any employment during the leave period (509)
⮚ Maximum amount of 5 years leave can be sanctioned (510). Beyond 5 yrs. POI
⮚ If, employee is unable to sign (1) Spouse (2) Parents if, u/m (3) Major Children (511)
⮚ Priority for sanction of Leave (i) Best can be spared (ii) Higher Leave Balance (iii)
Quality of service after last leave availed (iv) If, compulsory recalled from leave (v)
Leave refused in public interest (512)
⮚ Maintenance of Leave Records :Gaz. Officers –Accounts Department and NG staff --
head of the office or an officer authorised by him (Para 513)
⮚ Recall to duty before expiry of leave
Within India –Treating the journey period as on duty with TA
Outside India- Treating the journey period as on duty, Air Fare to India, duty pass, TA
and refund of Air Fare from India if, he/she has not completed the 50% of sanctioned
leave or 3 months whichever is shorter (516)
⮚ Willful absence from duty after the expiry of leave liable to disciplinary action. (518)

⮚ Encashment of Leave (i) while in service (ii) On cessation of Service
Leave on Average Pay (LAP) (Para 523, 524, 525)
⮚ 30 days in a calendar year to all the Railway Servants other than School Staff
⮚ 15 days in advance on 1st January and 1st July of every year
⮚ School Staff: (RBE No. 64/2019) w.e.f. 14.12.2018
10 days in a calendar year; 5 days on 1st Jan & 5 days on 1st July
⮚ Previous leave Balance carry forward, maximum accumulation 300 days
⮚ Maximum of 180 days can be granted at a time

⮚ Debit: Extraordinary Leave/Absence period (Non-qualifying service) during the


previous half year, the credit shall be reduced by 1/10th of the period of
EOL/Absence maximum of 15 days.
⮚ Fraction of day should be rounded off to the nearest day.
⮚ Full Pay (Average pay) while on LAP, Workshop staff are eligible for ½ day LAP.
⮚ Can’t be declined ordinarily last ten years of service.
Leave on Half Average Pay (LHAP) (Para 526)
⮚ 20 days in a calendar year to all the Railway Servants other than School Staff
⮚ 10 days in advance on 1st January and 1st July of every year
⮚ School Staff: (RBE No. 64/2019) w.e.f. 14.12.2018
Not eligible for credit of LHAP
⮚ Previous leave Balance carry forward, No limit in accumulation
⮚ Maximum of 24 months can be granted at a time

⮚ Debit: Extraordinary Leave/Absence period during the previous half year, the
credit shall be reduced by 1/18th of the period of EOL/Absence maximum of 10
days. Fraction of day should be rounded off to the nearest day.
⮚ Half Pay (Average pay) while on LHAP.
⮚ The LHAP may be granted on Medical Certificate or Private Affairs
Commuted Leave (Para 527)
⮚ Not exceeding the half the amount of LHAP on Medical Certificate (Sick & Fit)
⮚ Employee should return to duty after expiry of Commuted Leave
⮚ Twice the amount of LHAP will be debited and paid Full Salary
⮚ No Limit in entire service, 180 days can be sanctioned on Study Leave
⮚ If, the employee resigns/VR without returning to duty, should be treated as
LHAP and difference amount should be recovered
⮚ If, the employee Resign/VR on Medical incapacitation or death no recovery

Leave Not Due (Para 528)


⮚ Permanent Railway employee with one year service
⮚ When no kinds of Leave balance to the employee and on production of Medical
Certificate
⮚ Maximum 360 days in entire service or limited to LHAP likely to earn
⮚ Should be debited against future LHAP credit, Half payment (LHAP)
⮚ If, the employee resigns/VR before he earns such leave liable to refund the
leave salary
⮚ If, the employee Resign/VR on Medical incapacitation or death no recovery
⮚ During Maternity Leave – 60 days
Extra Ordinary Leave (Para 530)
⮚ When no kind of leave is available
⮚ When other of kind of leave is available, but employee requests for EOL
⮚ Permanent employee maximum 5 years including all kinds of leave due
⮚ No pay & allowances during the EOL
⮚ EOL with Medical Certificate is Qualifying Service for Increments/leave credit
⮚ In case of Temporary Railway Servant:
3 months – Without Medical Certificate
6 months – With Medical Certificate
18 months – TB, Cancer, Leprosy
24 months – Higher Studies

Leave to Apprentices (Para 532, 533, 534, 535)

Maternity Leave (Para 551)
⮚ A Female Railway Servant (Permanent/Temporary/Apprentice) with less than
two surviving children can be sanctioned with 180 days of ML
⮚ Should be availed in single spell, can be combined with any other kind of leave
⮚ 60 days commutation of leave, maximum leave up to 2 years
⮚ ML followed by EOL without MC doesn’t count as Qualifying service
⮚ No debit against the leave balance, full payment during the ML
⮚ (i) In case of still born child and (ii) in case a female employee who has married
a widower with children from his former wife, Maternity Leave would be
admissible provided the female employee has less than two surviving children at
the time of child birth.
⮚ 45 days of Abortion Leave in entire service of the employee.
Paternity Leave (Para 551(B))
⮚ A Male Railway Servant (Permanent/Temporary/Apprentice) with less than two
surviving children
⮚ 15 days of Paternity Leave, can be combined with any other kind of leave
⮚ During the confinement of his wife or 15 days prior to birth of the child or within 6
months of the birth of child
⮚ No debit against the leave balance, full payment during the PL
⮚ in case a male employee who has married a widow with children from her
former husband, Paternity Leave would be admissible provided the male
employee has less than two surviving children at the time of child birth.
Maternity Leave (Adoptive mother) (Para 551(C))
⮚ A Female Railway Servant (Permanent/Temporary, Apprentice) with less than
two surviving children on valid adoption of child below the age of one year
can be sanctioned with 180 days of ML on par with natural mother.
⮚ No debit against the leave balance, full payment during the ML
⮚ Can be combined with any kind of leave up to 1 year including 60 days
LND/Commutation of leave without MC.
⮚ In case of surrogacy, the surrogate, as well as the commissioning mother
with less than two surviving children, may be granted maternity leave of
180 days, in case of either or both of them are Railway servants. The
expression 'surrogate mother' shall mean the woman who bears the child
on behalf of the commissioning mother. It is effective from 18.06.2024.)

Paternity Leave (Adoptive Father) (Para 551(D))
⮚ A Male Railway Servant (Permanent/Temporary, Apprentice) with less than
two surviving children on valid adoption of child below the age of one year can
be sanctioned with 15 days of PL
⮚ No debit against the leave balance, full payment during the PL
⮚ In case of a child begotten through surrogacy, the commissioning father
who is a male Railway servant with less than two surviving children may
be granted paternity leave. It is effective from 18.06.2024.) [RBE No.
52/2025]
Study Leave (Para 556)
⮚ A Permanent Railway employee with 5 years of regular service
⮚ Course is directly and closely connected with the sphere of official duties
⮚ Not due for superannuation within 3 years after completion of study/course
⮚ Should execute a bond to serve Railways for 3 years/8 years (doctors)
⮚ 12 months at a time max. 24 months, in case of doctors 36 months
⮚ Should not be debited against the leave balance can be combined with any
other kinds of leaves but max. 24 months (in case of Ph.D/PG Medicine – 36
months)
⮚ If resigns/VR without serving 3 years/8 years (Dr.) after study leave or fail to
submit the certificate liable to refund the entire cost of training if, VR on Medical
De-categorisation/Death or Deputation purely on public interest no recovery.
⮚ Within India - DRM/PHOD/GM; Out of India - Railway Board

Ex-India Leave
⮚ Railway servant should take prior permission to proceed on Abroad
⮚ The Railway servant should submit a declaration stating that “I am aware that I
am not entitled for overseas medical reimbursement and I will bear all the
medical expenses while on overseas”.
Child Care Leave (Para 551 (E)) RBE No. 52/2025
(w.e.f. 18.06.2024)
⮚ A Female Railway Servant and Single male Railway servant (Unmarried or
widower or divorcee). In case surrogacy, commissioning mother (RBE 52/25)
⮚ Max. 730 days to take care of two eldest surviving children education and sick
⮚ Child age – below 18 years or any age of offspring with 40% disability
⮚ Not more than 3 spells in a calendar year (single female parent 6 spells).
More than 3 spells can be relaxed child is admitted as inpatient. (RBE No. 101/24)
⮚ Not less than 5 days at a time
⮚ 100% salary for 1st 365 days and 80% salary for next 365 days
⮚ Can be combined with any other leave, CCL balance sheet to be maintained
Work Related Illness and Injury Leave (WRIIL) (Para 552)
⮚ Special Disability Leave + Hospital Leave = WRIIL
⮚ Railway servant (Perm./Temp.) who suffers Illness or injury that is attributable to
or aggravated in the performance of her or his official duties or In consequence
of her or his official position are eligible for WRIIL with full payment for entire
hospitalization period. Beyond Hospitalization period
Other than RPF/RPSF
⮚ Full payment for 6 months after hospitalization, 12 months half pay after 6
months (can be commuted)
For RPF/RPSF Staff: Officers: Full payment 6 + 24 months; NG: Full payment
for entire period of sick.
⮚ WRIIL amount should be reduced by the compensation under WCA 1923
⮚ No LAP/LHAP credit during the WRIIL period
Special Casula Leave
All the SCL are sanctioned excluding the closed holidays
Category Details
Organ Donors 42 Days
Blood Donors 1 day on the day of blood donation. Maximum 4 times
in a calendar year on production of certificate from
licensed blood bank
Participation in Sports Up to 30 days JAG
Events Up to 90 days SAG
Beyond 90 days with the recommendations of RSPB
Cultural Activities 30 days in a calendar year.
Participation in Dance, Drama, Music etc. approved by
Railway Administration
Scout/Guides Activities 30 days in a calendar year.
Unions/Associations/So 30 days in a calendar year.

SCL for the various Family Welfare Schemes

Casual Leave/Special Casual Leave
⮚ CL is not a recorded leave
⮚ Can be sanctioned ½ day either AN/FN, the closed Holidays in between the CLs
will be counted as duty.
⮚ Irrespective of joining date CLs for Office Staff: 8+2 (RH) days; Open Line Staff:
10 days; RPF staff: 15 days.
⮚ Can’t be combined with LAP/Vacation/Joining Time; can’t be accumulated
⮚ ½ day CL debit for 3 late attendance/early leaving the office for an hour
⮚ Spl. CLs can be sanctioned on Sports Account, Scouts & Guides, Blood
Donation, Participating in PNM/Society Meetings, Cultural, Parades, Civil
Disturbances, etc.

Joining Time
⮚ Granted on Administrative grounds transfers
⮚ Within same municipality limits – 1 day
⮚ Less than 1000 kms – 10 days; More than 1000-12 days;
⮚ More than 2000 Kms-15 days (in case of air travel 12 days)
⮚ If, not availed the remaining portion will be credited to LAP account
Encashment of Leave - While in
Service
⮚ Maximum 60 days of LAP,
⮚ 10 days each at the successive blocks (1st Block 01.09.2008-31.08.2010; 2nd
Block : 01.0.2010-31.08.2012 so on)
⮚ On availing Pass/PTO and at least one day Leave (other than RH)
⮚ 10 days leave salary calculated as (Basic Pay + DA)/30 X 10
⮚ There must be LAP balance of 30 days after availing Leave Encashment and
leave availed

Encashment of Leave - On Retirement


⮚ Maximum 300 days of LAP. If, sufficient LAP balance to make good the LHAP
Balance can be taken into account.
⮚ Leave salary calculated as:
[((BP+DA)/30 X LAP days)) + ((BP+DA)/30 X LHAP days)/2)]
⮚ On resignation only 50% of LAP
⮚ On removal/dismissal - No Leave encashment
