MOST RESPECTFULLY SHOWETH:


1. That the petitioner filed this Petition for Special leave to
Appeal under Article 136 of the constitution of India
against the Judgement order passed by the Hon’ble High
Court of Andhra Pradesh at Amaravati in C.R.P.No. 2912 of
2023 and C.R.P. No. 154 of 2024 dated 22. 08. 2024.
2. The petitioner in hindsight has realized that he has not
filed certain documents which are part of the lower court
records and the same are found to be material for
deciding the present dispute. Hence the same are filed
along with this application and the same may be treated as
part and parcel of the SLP.
3. The first document is the petition and affidavit filed by the
respondents in I.A. No. 871/2023 in O.S. No. 273/2020
before Learned Junior Civil Judge Gajuwaka seeking
condonation of delay of 242 days to set aside the
Judgement decree dated 03. 01. 2023 . True Copy of the
petition and affidavit in I.A. No. 871/2023 in O.S. No.
273/2020 is annexed herewith as ANNEXURE P-8.
4. The order passed by the Learned Junior Civil Judge
Gajuwaka dismissing the I. A. No. 871/2023 in O.S. No.
273/2020 took note of the respondent/ defendants filing
Vakalat on 31-03-2021. Subsequently the suit was posted
for written statement on 04-05-2021, 15-07-2021, 01-09-
2021, 22-01-2021, 25-11-2021 and on 06-01-2022. After
ample opportunity given to respondents/defendants the
Learned Junior Civil Judge Gajuwaka proceeded exparte on
06-01-2022. Thereafter, the Learned Junior Civil Judge
Gajuwaka passed a decree and Judgement in favour of this
petitioner/plaintiff and against the
respondents/defendants on 26-03-2022. The Learned
court recorded a finding that the respondents/defendants
were grossly negligent and filed the petition to condone
delay of 243 days with false and frivolous grounds. Hence
the court dismissed the petition on 14 08.2023. True typed
copy of the dismissal order in I.A. No. 871/2023 in O.S. No.
273/2020 dated 14.08.2023 is annexed herewith as
ANNEXURE P-9.
5. The respondent/ defendants after the above mentioned
order was passed approached the appellate court with
petition under order XLI Rule 3A CPC to condone the delay
of 522 days in filing the appeal. The XIII Additional District
Judge Gajuwaka on 12.01.2024 in I.A. No. 1082/2023 in
unnumbered A.S. No. of 2023 dismissed the petition
after hearing both sides in detail on the ground that the
reasons stated in appeal for delay are altogether different
reasons etc. True copy of the Judgement order passed by
the XIII Additional District Judge Gajuwaka on 12.01.2024
in I.A. No. 1082/2023 in unnumbered A.S. No. of 2023 is
annexed herewith as Annexure P-10.
6. That the above documents are vital and necessary for
hearing and adjudication of the case and hence may be
taken on record in the interest of justice.
7. That the present application has been moved bonafiede
and in the interest of justice.
PRAYER
It is therefore most respectfully prayed that this hon’ble

court may graciously be pleased to:-

a) Permit the respondent to file additional documents

mentioned in para 3 to 5 as ANNEXURE – P-8 to P/10

herein above;

b) Pass such further or other orders as this hon’ble court

may deem fit and proper in the facts and

circumstances of the case and thus render justice.

AND FOR THIS KINDNESS THE APPLICATION AS IN DUTY
