Legal Maxims (Basic - 40)

Actus non facit reum nisi mens sit rea: The act does not make a person guilty
unless the mind is also guilty.

Audi alteram partem: Hear the other side.

Nemo debet esse judex in propria causa: No one should be a judge in his own
cause.

Ignorantia juris non excusat: Ignorance of the law is no excuse.

Ubi jus ibi remedium: Where there is a right, there is a remedy.

Res ipsa loquitur: The thing speaks for itself.

Volenti non fit injuria: To a willing person, no injury is done.

Qui facit per alium facit per se: He who acts through another does the act
himself.

De minimis non curat lex: The law does not concern itself with trifles.

Actio personalis moritur cum persona: A personal action dies with the person.

In pari delicto potior est conditio possidentis: In equal fault, the condition of the
possessor is better.

Salus populi suprema lex esto: The welfare of the people shall be the supreme
law.

Lex non cogit ad impossibilia: The law does not compel the impossible.

Caveat emptor: Let the buyer beware.

Caveat venditor: Let the seller beware.

Dura lex sed lex: The law is harsh, but it is the law.

Ex turpi causa non oritur actio: No action arises from an immoral cause.

Fiat justitia ruat caelum: Let justice be done though the heavens fall.

Injuria sine damno: Legal injury without actual damage.

Damnum sine injuria: Damage without legal injury.

Nemo dat quod non habet: No one can give what he does not have.

Nullum crimen sine lege: No crime without law.


Nemo tenetur seipsum accusare: No one is bound to accuse himself.

Pacta sunt servanda: Agreements must be kept.

Qui prior est tempore potior est jure: He who is earlier in time is stronger in law.

Res judicata: A matter already judged.

Sub judice: Under judgment or pending decision.

Ut res magis valeat quam pereat: It is better for a thing to have effect than to be
void.

Vigilantibus non dormientibus jura subveniunt: The law assists those who are
vigilant, not those who sleep.

Lex posterior derogat priori: A later law repeals an earlier one.

Lex specialis derogat legi generali: A special law prevails over a general one.

Lex loci: The law of the place.

Mens rea: Guilty mind.

Obiter dictum: Something said in passing (non-binding remark by a judge).

Ratio decidendi: The reason for the decision.

Stare decisis: To stand by decided matters.

Sine qua non: An essential condition or element.

Prima facie: At first sight or on the face of it.

Status quo: The existing state of affairs.
