Since the time when Governor Phillip first read the delegated legislation
proclaiming the establishment of the colony that was to become New South
Wales, legislation made by delegates of parliaments has governed the lives of
members of the public. In number, delegated legislative instruments (which
for present purposes can be taken to embrace regulations, rules, by-laws,
ordinances and other legislative instruments) exceed the enactments of the
parliaments. However, the use of, and controls exercised over, such
instruments have largely passed unexamined. The previous editions of this
book have sought to fill that gap.
In the preface to the second edition, the authors noted that the use of
delegated legislation in Australia had increased rapidly in the 22 years since
the publication of the first edition. The authors also noted significant
developments in some jurisdictions, in areas such as requirements for public
consultation prior to the making of delegated legislation. An unstated issue
was that, after decades of leading the world in relation to parliamentary
scrutiny of delegated legislation, the Commonwealth jurisdiction was lagging
behind several of its state and territory counterparts.
However, in the preface to the third edition, the authors observed that
this trend was reversed in 2003, when the Commonwealth Parliament passed
the Legislative Instruments Act 2003 (Cth). That Act introduced a
comprehensive and coherent methodology for the making, publication and
parliamentary scrutiny of ‘legislative instruments’, a term that covers not only
the ‘traditional’ classes of delegated legislation but also the vast array of ‘quasi-
legislation’ considered in Chapters 1 and 2 of the second edition. Its
enactment necessitated the rewriting of Chapters 1 and 2 for the third
edition.
In the preface to the fourth edition, the authors noted that, in the closing
stages of preparation for that edition, another significant development took
place in the Commonwealth, with the enactment of the Human Rights
(Parliamentary Scrutiny) Act 2011 (Cth). That Act established a
Parliamentary Joint Committee on Human Rights. The Joint Committee had
been given the task of examining bills and legislative instruments that come
before the Commonwealth Parliament for compatibility with ‘human rights’,
defined by reference to a list of international human rights instruments. The
authors noted that, in establishing the Joint Committee, the Commonwealth
had followed the lead of the Australian Capital Territory and Victorian
legislatures in expressly providing for scrutiny of legislation by reference to
‘human rights’ issues. The authors noted that, at the time of finalising the
fourth edition, the Joint Committee did not appear to have commenced
operation in any meaningful way, so the authors awaited with interest the
impact of the new committee on legislative
scrutiny in the Commonwealth jurisdiction. In recognition of the
development of scrutiny of legislation against human rights issues, the authors
introduced in the fourth edition a new chapter dealing with that topic. In this
edition, that chapter discusses the performance of the Joint Committee and its
impact on legislative scrutiny in the Commonwealth jurisdiction.
Another significant development discussed in the fourth edition was the
2010–11 reform of the parliamentary committee system in the Queensland
Parliament. This resulted in the abolition of the Scrutiny of Legislation
Committee which, since 1995, had been performing a dual scrutiny of bills
and scrutiny of delegated legislation role. Under the reforms, the role of the
Scrutiny of Legislation Committee has been (in effect) devolved to a series of
portfolio committees, organised around the subject matter dealt with by the
various government departments. At the time of finalising the fourth edition,
it was not possible to discern how the new arrangements would work and the
authors awaited with interest the impact of the new arrangements. This
edition discusses the operation of the new arrangements, including the
establishment by the Queensland Parliament of the Technical Scrutiny of
Legislation Secretariat (TSS).
Other significant developments discussed in this edition include (in the
Commonwealth jurisdiction) the evolution of the Legislative Instruments Act
2003 (Cth) into the Legislation Act 2003 (Cth) and the increased accessibility
of the work of the Senate Standing Committee on Regulations and
Ordinances, as a result of the regular publication of the enhanced Delegated
Legislation Monitor. Wider issues discussed include concerns expressed in
various jurisdictions — led by the work of the Western Australian Parliament
— in relation to the incorporation of Australian Standards, etc into delegated
legislation.
In the fourth edition, the authors took the opportunity to restructure the
chapters dealing with the making, commencement and publication of
delegated legislation and with the various legislative scrutiny committees. The
focus of the restructure was to develop more meaningful discussion of the
various principles against which delegated legislation is scrutinised by
legislative scrutiny committees and to lessen the focus on the day-to-day
operation of the various committees. The authors noted that the advent of the
internet, and the extent to which the various committees made their work
available to the public through that medium, had meant that the kind of
detail relating to the work of legislative scrutiny committees that was provided
in previous editions of this work was mostly available through means that are
more suited to keeping up with the ever-changing world of Australian
legislative scrutiny committees. That approach is continued in this edition.
The rewriting of Chapters 1 to 11 was undertaken primarily by Stephen
Argument. Stephen thanks Professor Pearce for his comments on early drafts
of these chapters but takes sole responsibility for their final content.
Judicial review of delegated legislation has not seen any great change in
principle since the fourth edition, although there is a hint of a desire by the
courts to broaden the grounds for reviewing the validity of delegated
legislation to embrace some grounds that have in the past been used to review
administrative decisions only. There
have been many significant decisions of the courts since the last edition
notably in the application of proportionality as a ground of review. These
decisions have been included and discussed in this edition, resulting in some
expansion of the text.
Dennis Pearce assumed principal responsibility for this part of the book
(Chapters 12–32). Dennis acknowledges with thanks the assistance provided
by Stephen Argument in the management of the substantial body of case law
that is cited.
