conferred by Article 234 of the Constitution of India, the Govemor of Bihar, in
consultation with the High Court of Judicature at Patna is pleased to make the
following Rules to amend the Bihar Civil Service (Judicial Branch)
(Recruitment) Rules, I 955:-
l. Short title, extent and commencement.-( I )Thes e rules may be called
the "Bihar Civil Service (Judicial Branch) (Recruitment)
(Amendment) Rules, 2025".
(2) It shall extend to the whole of the State of Bihar.
(3) It shall come into force with immediate effect.
2 Substitution of Rule-2(b) of the Bihar Civil
Service (Judicial
Branch) (Recruitment) Rules, 1955 (as amended from time to time).-
Rule-2(b) of the said rules shall be substituted as follows:-
"2(b)-Recruitment to the posts of Civil Judges (Senior Division) shall be
made by the High Court, from amongst Civil Judges (Junior
Division) confirmed under Rule 24 or appointed under Rule 26, as
far as possible, on yearly basis, in the following manner:-
(i) 90%o of the posts shall be filled by promotion from amongst the
Civil Judges (Junior Division) on the basis of seniority-cum-merit
subject to the suitability parameters as contained in Appendix 'E'.
(ii) 10% of the posts shall be filled through accelerated promotion on
the basis of merit through Limited Departmental Competitive
Examination conducted by the Patna High Court, Patna, from
amongst officers having not less than 3 years service as Civil Judge
(Junior Division). Selection shall be as per the procedure and
examination as specified in Appendix-'F'
(iii) If any post reserved for LDCE for Civil Judge (Senior Division)
remains vacant, the same shall be filled up through simultaneous
selection process carried out for regular promotion on the basis of
'seniority- cum-merit' in that particular year.
(iv) Vacancies for promotion as well as for the Limited Departmental
Competitive Examination (10%) quota shall be calculated on the
basis of cadre strength."

3 Addition of a new Rule 2(c) after the Rule 2(b) of the Bihar Civil
Service (Judicial Branch) (Recruitment) Rules, 1955 (as amended
from time to time)-The Rule 2(c) of the said Rules shall be Added as
follows:-
"2(c)- Seniority inter se of officers promoted to the cadre of Civil Judge
(Senior Division) shall be in accordance with their respective
seniority in Bihar Judicial Service on the post of Civil Judge
(Junior Division).
Further, the seniority of the members (as per their source of
appointment viz. 90Yo by promotion and l0o/o by Limited
Departmental Competitive Examination) of the Civil Judge (Senior
Division) cadre shall be f-rxed by Roster Points prepared on the
basis of post and irrespective of the fact as to when a person is
appointed. The roster point shall be prepared including all the posts
available in this cadre.
Explanation (i) - The 10 point roster for the cadre will be as
follows:
(a) For90% of theposts- 1,2,3,4,5,6,7,8 & 9 bypromotion
(b) For l0% posts- 0 by Limited Departmental

The vacancy of any roster point has to be filled from amongst the
category to which the post belongs in the roster.
(ii) - The roster for the cadre will operate on yearly

selection/appointment process is set in motion by the High Court in
respect of two different sources of promotion/ appointment."
4. Addition of the earlier repealed Rule 6(c) after the Rule 6(b) of the
Bihar Civil Service (Judicial Branch) (Recruitment) Rules, 1955 (as
amended from time to time)-Earlier repealed Rule 6(c) shall be added as
under:-
"6(c)-Be practitioner at Bar ofat least three (03) years on the date of the
a
advertisement. The number of years of practice shall be calculated
from the date of their provisional enrolment/registration with the
concemed State Bar Council.
The certificate of practice must be duly certified either by the
Principal Judicial Officer of the Court where the candidate is
practicing or by an Advocate of that Court having a minimum

standing of 10 years duly endorsed by the Principal Judicial Offrcer
of such a District or a Principal Judicial Officer at such a station.
Insofar as the candidates who are practicing before the High Courts
or Supreme Court, they shall be certified by an Advocate who has a
minimum standing of l0
years duly endorsed by an offrcer
designated by High Court or Supreme Court.
Experience as Law Clerks with any of the Judges or Judicial
Officers in the Country shall also be considered while calculating
their total number ofyears ofpractice."
5 Substitution of Rule-25 A of the Bihar Civil Service (Judicial
Branch) (Recruitment) Rules, 1955 (as amended from time to time).-
Rule-25 A of the said rules shall be substituted as follows:-
uzsA-It shall be essential for the newly appointed Judicial Officers to
undergo a training for a minimum period of one year before
presiding in a Court. However, the period of training may be
extended to two years after consultation with the High Court."
6 Addition of the Appendix-F after the Appendix-E of the Bihar Civil
Service (Judicial Branch) (Recruitment) Rules, 1955 (as amended
from time to time)-The Appendix-F of the said Rules shall be Added by
the following:-

l. Number of vacancies and list of eligible officers shall be placed
before the Selection & Appointment Committee of the High Court
before 3l't March of each year. After approval it shall be circulated
to all eligible officers through the Principal District and Sessions
Judges for seeking their willingness to appear at the Limited
Departmental Competitive Examination and application forms for
the said examination by 30th April of the concemed year.
2(a). Those Officers whose A.C.R.s of last three years are not found
satisfactory for the purpose of promotion shall not be included in
the list of eligible officers.
2(b). Those Officers against whom a preliminary enquiry or a
disciplinary proceeding is pending or against whom criminal case
is pending, the decision in respect of their suitability for promotion
will be maintained in a sealed cover till the disciplinary proceeding
is concluded or the criminal case is finally decided, as the case may
be.

2(c). For perfonnance appraisal the ollcer must not have scored 5 or
more entries of Poor/FairiAverage during the last l2 quarters or in
that proportion during last 3 years, failing which he shall stand
disqualilied fbr the promotion. Explanation subrritted with the self
appraisal, if any, may be considered in respect ofrelevant entries.
Provided that appraisal ofthe period during which the officer
was conferred the power of Judicial Magistrate 2nd Class, shall not
be considered as a disqualification for the purpose of prornotion if
the same talls short of the parameters prescribed.
3. Such Limited Departmental Competitive Examination shall be in
respect of both Temporary and Permanent posts of Civil Judge
(Senior Division).
4. The selection of the candidates shall be on the basis of Written
Test, Judgrnent Writing and Interview (Viva-voce Test). The full
marks for Written Test shall be 100 with 45 as qualilying marks.
Full marks for Judgment writing shall be 60 with 30 as qualifiing
marks. Full rnarks for Interview (Viva-voce Test) shall be 40 with
l8 as qualifoing marks.
Syllabus: (i) :-
Questions will be set on the
Written Test
Procedural Law (CPC, BNSS, BSA), BNS, Negotiable Instrument
Act, Hindu Law, Mohamrnedan Law, T.P. Act., Contract Act,
Specific Relief Act, Limitation Act, Civil Court Rules. Criminal
Court Rules and General Letters and Circulars.
(ii) Judgment Writing (Two each in Civil Matter and in Criminal
Matter):- One each of Civil and Criminal .Iudgment must be written
in English.
(iii) Viva-voce Test:- Updated knowledge of law, Comprehension,
Ethics/ Aptitude, Communication Skills, General perceptions and
awareness shall be taken into account in Interview (Viva-voce
Test).
) For removal of doubt or difficulties, the Standing Cornrnittee of
High Court may issue necessary orders/ directions or guidelines.
6 The State Govemment may make amendment. from time-to-time.
