victim was one Reymond A. Malayan, 25 years old, single , tricycle driver, and lastly resided at
Brgy. San Pablo, Tacloban City. The suspect is

FACTS OF THE CASE​
​
​
​ Investigation conducted by this office disclosed that the incident involves a case of Arson
with Reckless Imprudence Resulting in Damage to Property (DOA) wherein the victim is
Reymond A. Malayan, 25 years old, single, tricycle driver, and a resident of Brgy. San Pablo,
Tacloban City.

At around 11:45 PM on April 1, 2025, a fire broke out at the victim’s residence located in Brgy.
San Pablo, Tacloban City. Responding fire units from Tacloban Central Fire Station, led by SFO2
Kyrie A. Irving and FO2 Chris A. Paul, arrived at the scene to contain the blaze and assist in
evacuation and damage control operations.

The operation was conducted in coordination with PEMS. Kevin A. Durant and PSSg. James A.
Harden of Tacloban Police Station 1, who assisted in securing the area, documenting the
incident, and gathering initial witness accounts.

Eyewitnesses identified Edward A. Garcia, 30 years old, single, security officer, and a resident of
the same barangay, as the individual last seen in the vicinity before the fire started. The suspect
was allegedly involved in a personal conflict with the victim, which may have been the motive
for the incident.

Although no incendiary devices were recovered at the scene, circumstantial evidence and the
suspect’s proximity, along with positive identification by witnesses, supported probable cause for
arrest. The suspect was apprehended by elements of the Bureau of Fire Protection and the
Philippine National Police shortly after the incident.

Due to a special medical condition, the victim was unable to personally file a complaint. As a
result, his brother, Reymart A. Malayan, voluntarily appeared before the authorities and served
as the complainant on behalf of the victim.

The fire resulted in significant damage to the property, though no fatalities were recorded. The
case is filed as Arson with Reckless Imprudence Resulting in Damage to Property (DOA) and
has been referred to the City Prosecutor’s Office for inquest proceedings and appropriate legal
action.

SAGOT: Ganito po iyon, Sir. Noong Abril 1, 2025 bandang 11 ng gabi habang kami ay pauwi,
nasalubong namin si Edward A. Garcia sa daan na may bitbit na container. Ilang sandali lang po,
nakita na naming nasusunog na ang bahay ng aking kapatid. Agad kaming humingi ng saklolo at
tinulungan siyang makalabas.

10. TANONG: May nalalaman ka bang dahilan kung bakit may nag-tangkang patayin ang iyong
kapatid?​
SAGOT: Ayon sa mga nakalap na impormasyon, mayroon daw silang personal na alitan dati,
pero wala po akong tiyak na dahilan.

11. TANONG: Papaano mo naman nalaman na si Edward A. Garcia ang nag-tangkang pumatay?​
SAGOT: Nakita po siya ng mga saksi sa paligid ng bahay bago pa man nagsimula ang sunog, at
siya po ay positively identified.

SAGOT: May mga saksi po mula sa aming lugar at pati sina Alden M. Gomez at Richard M.

I, SFO2 Kyrie A. Irving, of legal age, Filipino, a bona fide member of the Bureau of Fire
Protection and presently assigned at Tacloban Central Fire Station, after having been duly sworn
to in accordance with law, do hereby depose and state:

1.​ That on April 1, 2025, at about 11:45 PM, we received a fire alarm involving a residential
structure at Brgy. San Pablo, Tacloban City.​

2.​ I, together with FO2 Chris A. Paul, responded immediately as part of the dispatched team
to suppress the fire and conduct rescue operations.​

3.​ Upon arrival, we observed a residential house fully engulfed in flames. Coordinating with
Tacloban Police Station 1, led by PEMS Kevin A. Durant and PSSg. James A. Harden,
we were informed that the fire was possibly deliberate and that a suspect was seen near
the area prior to the blaze.​

4.​ Based on information from responding witnesses and residents, the suspect was identified
as Edward A. Garcia, 30 years old, single, security officer, and a resident of Brgy. San
Pablo, Tacloban City.​

5.​ In joint operation with PNP personnel, we conducted a search in the immediate vicinity.
At approximately 12:10 AM of April 2, 2025, we saw the suspect attempting to walk
away from the fire scene.​

6.​ The suspect was positively identified by witnesses on the ground. I approached and
identified myself as a uniformed officer of the Bureau of Fire Protection, informed him of
the nature of his arrest, and advised him of his constitutional rights in a dialect known to
him.​

"Ikaw ay inaresto sa kasong Arson with Reckless Imprudence Resulting in Damage

to Property. May karapatan kang manahimik. Lahat ng sasabihin mo ay maaaring
gamitin laban o pabor sa iyo sa alinmang hukuman. May karapatan kang kumuha
ng abogado. Kung wala kang abogado, ang pamahalaan ay magbibigay sa iyo.
Naiintindihan mo ba ang iyong mga karapatan?"

7.​ The suspect did not resist arrest and was peacefully turned over to the custody of
Tacloban Police Station 1 for documentation, investigation, and booking procedures.​

1.​ That on April 1, 2025, at about 11:45 PM, I, together with SFO2 Kyrie A. Irving,
responded to a reported fire incident involving a residential structure at Brgy. San Pablo,
Tacloban City.​

2.​ Upon arriving at the scene, we found a one-story residential house already engulfed in
flames. Our team initiated fire suppression efforts while coordinating with the Tacloban
Police Station 1, led by PEMS Kevin A. Durant and PSSg. James A. Harden.​

3.​ We were informed by police investigators that witnesses reported seeing a

suspect—identified as Edward A. Garcia, 30 years old, single, and a resident of Brgy. San
Pablo—near the location just before the fire broke out.​

4.​ Working jointly with PNP personnel, we proceeded to canvass the surrounding area. At
approximately 12:10 AM on April 2, 2025, we spotted an individual matching the
suspect’s description walking away from the vicinity.​

5.​ After confirmation from eyewitnesses, we approached the suspect. I assisted in the arrest,
introduced myself as a fire officer, and informed him of the reason for his arrest and of
his constitutional rights, as follows:​

"Ikaw ay inaresto sa kasong Arson with Reckless Imprudence Resulting in Damage

to Property. May karapatan kang manahimik. Lahat ng sasabihin mo ay maaaring

PARTICULARS OF THE INCIDENT

At approximately 11:45 PM on April 1, 2025, this station received a report from Mr. Alden M.
Gomez, a resident of Brgy. San Pablo, regarding a fire incident at the residence of Reymond A.
Malayan, 25 years old, single, tricycle driver.

Fire responders were immediately dispatched to the area and arrived to find the residential
structure engulfed in flames. Initial suppression and evacuation efforts were initiated in
coordination with the Tacloban City Police Station 1 and concerned barangay officials.

The fire was declared under control at 12:10 AM and completely extinguished at 12:25 AM,
April 2, 2025. The victim was safely rescued with the help of his relatives and neighbors.

FIRE CAUSE DETERMINATION

Witness accounts and circumstantial evidence suggest intentional ignition. A joint investigation
was conducted by the BFP and PNP. The suspect, Edward A. Garcia, 30 years old, single,
security officer, was seen near the property carrying a container minutes before the blaze and was
arrested shortly after the incident.

Malayan. This indicates that the blood at the crime scene likely belongs to the victim and
supports the presence or involvement of the victim in the examined area or object.​

DETAILS OF INVESTIGATION​
​ On April 1, 2025, at around 11:45 PM, a fire broke out at the residence of Reymond A.
Malayan in Brgy. San Pablo. The victim, who was inside the residence at the time, was safely
rescued by relatives and neighbors and did not sustain any injuries.

Eyewitnesses identified Edward A. Garcia, a 30-year-old security officer and resident of the
same barangay, as the suspect. He was seen near the victim’s house shortly before the fire
started, carrying a container suspected to contain a flammable substance. He was apprehended
during a hot pursuit operation by personnel from the Bureau of Fire Protection and Tacloban
Police Station 1.

Initial investigation revealed that the suspect and the victim had a prior personal conflict.
Statements from Reymart A. Malayan, Alden M. Gomez, and Richard M. Gomez supported this
claim and confirmed the presence of the suspect at the scene before the incident. No incendiary
devices were recovered, but the suspect was positively identified by witnesses and found near the
vicinity at the time of the incident. These facts provided sufficient probable cause for his arrest.

The suspect was informed of his constitutional rights upon arrest and turned over to authorities
for custodial investigation. Sworn statements, photographs, and supporting evidence were
secured and are currently under review. The case has been forwarded to the Office of the City
Prosecutor for appropriate legal action under the charge of Arson with Reckless Imprudence
Resulting in Damage to Property.

FACTS OF THE CASE

On April 1, 2025 at around 11:45 PM, a fire broke out at the residence of Reymond A.
Malayan in Brgy. San Pablo, Tacloban City. The Tacloban Central Fire Station, led by SFO2
Kyrie A. Irving and FO2 Chris A. Paul, responded and coordinated with the Tacloban Police
Station. Witnesses identified Edward A. Garcia as the suspect. He was seen carrying a container
minutes before the blaze and had a known personal conflict with the victim. Though no
incendiary devices were found, circumstantial evidence and positive witness identification led to
his arrest at 12:10 AM on April 2, 2025. The suspect was positively tested for the presence of
fire accelerants and blood traces at the scene matched his blood type. The victim sustained mild
smoke inhalation but survived.​
​
The suspect, Edward A. Garcia, is currently under custody after being arrested without
resistance. He was properly booked and underwent a medical examination confirming he was
physically fit at the time of arrest. The victim, Reymond A. Malayan, was safely rescued and
treated for mild smoke inhalation. The complaint was officially filed by Reymart A. Malayan,
the victim’s brother, due to the victim's inability to file the case himself. Supporting the case are
sworn statements from the complainant and two key witnesses, as well as laboratory reports
confirming the presence of fire accelerants and blood evidence linking the suspect to the crime.
Additional evidence includes the victim’s medical certificate and autopsy report, photographs
and a sketch of the crime scene, and pertinent documents such as the booking sheet, arrest
reports, police blotter, and chain of custody certification.​
​
This case has sufficient grounds for the filing of formal charges. Inquest proceedings are
