BARANGAY ORDINANCE NO. 4 S-2024

AN ACT AUTHORIZING THE MUNICIPAL GOVERNMENT OF BONGABON TO ISSUE
BARANGAY CLEARANCE AND COLLECT BARANGAY FEE AS A PREREQUISITE FOR
RENEWAL AN APPLICATION OF BUSINESS PERMIT OR LICENSE OF ANY ACTIVITY OR
BUSINESS LOCATED WITHIN ITS JURISDICTION SUBJECT TO THE REMITTANCE OF
THE AFORESAID FEE TO THE BARANGAY AND THE CONDITIONS HEREUNDER.
WHEREAS, the Municipality of Bongabon has long ventured in a policy to streamline the issuance of
the licenses and/or permits in all activities or business within jurisdiction; and pursuant thereof initiated
the "one stop shop policy"; whereby all necessary permits/licenses and documents needed for the issuance
of business permit of a particular activity or businest, should be within the reach or available to the
application in one location.
WHEREAS, the Municipality may issue any license or permit for any business or activity unless
clearance is first obtained from the Barangay where such business or activity is located or conducted; the
application however for clearance shall be acted upon within seven (7) working days from the filing
thereof by the Barangay concerned otherwise the Municipality may issue the said license or permit (Sec.
152(2) of LGC):
WHEREAS, Barangay Santor in unison with the standing policy of the Municipal Government of
Bongabon regarding the "one stop shop policy" hereby authorizes the Municipal Government of
Bongabon to issue Barangay Clearance and to collect the same in all cases of renewal and application of
business permit and licenses of any activity or business located within its jurisdiction subject to the
remittance of the aforesaid fee to the Barangay.
NOW THEREFORE, be it ORDAINED, as it is hereby ORDAINED by the Barangay Council of
Barangay Santor„ Bongabon, Nueva Ecija, in session assembled, that:
Section 1. Policy/Application - Barangay Santor is in the harmony with the policy of the Municipal
Government to streamline the issuance or licenses and/or permits, particularly business permit under the
nomenclature of "one stop shop". Pursuant thereto, the need to authorize the Municipal Government of
Bongabon to issue the necessary barangay clearance and collect fees corresponding thereto is of
paramount importance in order to successfully implement the aforesaid policy.
Section 2. Coverage - the ordinance shall apply only to the collection of corresponding payment in all
cases of new application for business permit or license and renewal of any activity or business located
within jurisdiction.
Section 3. Authority to collect Barangay Clearance fee and All Other Business Regulated Fees and
Charges - the Municipality of Bongabon is given authority to collect barangay clearance fee
subject to the remittance of the aforesaid fee to the barangay.
Further, the Municipality of Bongabon is likewise authorized to issue barangay clearance to the preceding
paragraph.
Section 4. Remittance and Information - The Municipality of Bongabon shall remit the Fifty Percent
(50%) of barangay clearance fee and other regulated fees mentioned in preceding provision to the account
of Barangay and shall furnished the Barangay the list of the names and addresses of the company or
individual person paid with barangay clearance fee every quarter.
Section 5. Barangay Inspection - after receipt of the list of names and addresses of the company or
individual person issued with barangay clearance, the Barangay shall immediately inspect, or cause the
inspection of the company or individual person listed thereat, and shall inform the Municipal Government
through BPLO within reasonable time days from receipt of the aforesaid list of its negative finding.
Notwithstanding this period, the Barangay may conduct its inspection pursuant to the Local Government
Code provision.
Within five (5) working days from receipt of the business permit, the applicant shall mandatorily post
hard copy of the Barangay clearance together with the Business Permit (Mayor's Permit) in conspicuous
place inside their respective office/company place of business. Failure to post Barangay clearance shall be
considered ground for negative findings for purpose of revocation under the succeeding paragraph.
Should there be violations, as reported by the Barangay, the Municipal Government through the BPLO
and shall immediately order the revocation or cancellation of the business permit.
The Following shall be considered as negative findings for purpose of violations and/or revocation of
barangay clearance, to wit:
a. Violation of Section 19 and 20 of Philippines Clean Air Act of 1999(Republic act. No.8749).
b. Non-Compliance with sanitary requirements under the Code of Sanitation of the Philippines (PD 856)
c. Disposal of water waste without undergoing prior waste water treatment as provided under Clean
Water Act (RA 9275).
d. Discharging, depositing or causing to be deposited material of any kind directly or indirectly into the
water bodies or along the margins of any surface water, where, the same shall be liable to be washed into
such surface water, either by tide action or by storm, floods or otherwise, which could cause water
pollution or impede natural flow in the water body as provided under Clean Water Act (RA9275).
e. Discharging, injecting or allowing to seep into the soil or sub-soil any substance in any form that would
pollute groundwater as provided under Clean Water Act (RA9275).
f. Disposal of potentially infectious medical waste into river or water;
g. Unauthorized transport or dumping into waters of sewage sludge or solid waste as defined under
Republic Act No.9003;
h. Transport, dumping or discharging of prohibited chemicals, substance or pollutants listed under
Republic Act No.6969.
i. Importation, manufacture, processing, handling storage, transportation, sale, distribution, use,
re-use/recycling, treatment and disposal of all unregulated chemical substances and mixtures in the
Philippines that may pose threat to public health and the environment pursuant to Toxic Substances and
Hazardous and Nuclear Wastes Control Act of 1990 (RA 6969).
Violation of Building Code (RA 6541).
k. Refusal to allow entry, inspection and monitoring by the Barangay authorized personnel;
Section 7. Rate of Barangay Clearance Fee - the rate of One Hundred Pesos (P100.00) will be collected
for the issuance of barangay clearance.
Section 8. Repealing Clause - Except as otherwise provided herein, all barangay orders, administrative
regulations, barangay ordinances, barangay resolutions, which are inconsistent with and contradictory to
any of the provisions of this Ordinance are hereby repealed or modified accordingly.
Section 9. Separability Clause - If for any reason, any section or provisions of this Ordinance shall be
held to be unconstitutional or invalid, the order sections shall not be affected thereby.
Section 10. Effectivity Clause - This Ordinance shall take effect immediately after its approval.
