COMPLAINT-AFFIDAVIT

I, CRYSTEL MEDICE, of legal age, Filipino, single, and a resident of Barangay Dalakit ,

Catarman Northern Samar, after having been duly sworn to in accordance with law, do hereby

state:

1. Personal Background

I am 23 years old, currently residing at Barangay Dalakit , Catarman Northern Samar and I am
employed as a cashier in hyper market (SM).

2. Allegation of Facts

That on the evening of June 15, 2024, at around 10:30 PM, in Macagtas road, I was walking

home from work when I was suddenly approached by the respondent JEAN PAUL LAGARTO,

who is a neighbor known to me.

Without any warning or provocation, he forcibly dragged me into an unlit alley near Macagtas

road. Despite my resistance and continuous pleading, the respondent physically overpowered me,

covered my mouth, and raped me against my will.

After the act, he fled the scene while threatening me not to report the incident or he would harm

my family.

3. Medical and Police Reports

Immediately after the incident, I reported the crime to the Barangay and was referred to the

Women and Children Protection Desk at Catraman Police Station. I underwent a medico-legal

examination at Northern Samar Provincial Hospital (NSPH) , and a copy of the report is attached

as Annex "A."

4. Relief Sought

I am executing this affidavit to file a formal criminal complaint for Rape under Article 266-A of

the Revised Penal Code, as amended by Republic Act No. 8353 (Anti-Rape Law of 1997), against

JEAN PAUL LAGARTO and to support the filing of appropriate charges in court.

5. Prayer

WHEREFORE, premises considered, I respectfully pray that this Honorable Office take

cognizance of this complaint and file the necessary Information for Rape against the respondent.

Further reliefs just and equitable under the circumstances are likewise prayed for.

RAPE

At about 10:30 pm of June 15, 2024, this station received a report from the victim, Crystel
Medice that she was sexually abused by Jean Paul lagarto a resident of Barangay Dalakit,
Catarman Northern Samar. The victim was sexually abused in Macagtas road, Catarman Norther
Samar . Immediately elements of this station composed of PO3 Felix Lim and PO2 Jomar
Adlawan proceed at the above mentioned place to conduct investigation.

Investigation conducted revealed that on the evening of June 15, 2024, at around 10:30 PM, in
Macagtas road, Crystel Medice legal age, Filipino, single, and a resident of Barangay Dalakit ,
Catarman Northern Samar, currently residing at Barangay Dalakit , Catarman Northern Samar
and employee as a cashier in hyper market (SM). She was heading home from work when
someone secretly approaching her and suddenly grabbed her into an unlit alley near Macagtas
road, she was resisting and try to please him but he refuses and because of his strength he
overpowered her and covered her mouth then he start loosing her under garment and rape her
without hesitation against her will.

JUDICIAL AFFIDAVIT OF THE WITNESS

I, CRYSTEL FAYE T. MEDICE, 23 years old, single, employed cashier in hyper market
(SM), and a resident of Brgy. Dalakit, Catarman N. Samar.
After having sworn in accordance with the law hereby depose and state:
That it was Police Investigator Felix Lim,examination of the undersigned affiant in Catarman
Police Station, Catarman Northern Samar;
That I hereby state that in answering the questions asked of me as appearing below, I was
fully conscious that I did so under oath and that I may face criminal liability for false testimony or
perjury;

QUESTION 1: Why are you here in our office? ( Nano kay adi ka saam opisina?)

ANSWER 1: I came here to testify and complaint regarding the incident that transpired about
10:30 PM of June 15, 2024 at Brgy. Macagtas, Northern Samar, me as witness (also victim). (Nag
kadi ak para mag patotoo ngan reklamo tungkol sa nahinabo nga insidente nga nangyari sito
10:30 pm san June 15, 2024 sa Brgy. Macagtas,Northern Samar, sa pagiging saksi ko (ngan
biktima).

QUESTION 2: Can you describe in detail what happened on the night of June 15, 2024? (Pwede
mo bai g istorya sim detalyado kung nano nahinabo siton na gab-e san June 15 2024?)

ANSWER 2: On the night of June 15, 2024, I was heading home from work when someone
secretly approaching me and suddenly grabbed me into an unlit alley near Macagtas road, I was
resisting and try to please him but he refuses and because of his strength he overpowered me and
covered my mouth then he start loosing my under garment and rape me without hesitation against
my will.( san gab-e siton na June 15, 2024, tiuli nak tikang sa trabaho sin yaun sayo nga -nag
sinunod sak ngan tigda ak gn bugnot pakadto sa masirom nga iskinita apiki sa kalsada san
macagtas,nag pupumiglas ak ngan nag mamakaluoy sa kanya pero wara ak niya pamatii,dara san
kanya kusog nalupig ak ngan gin takpan niya ak hiwa ngan gin tikangan niya hubuon ak pan ubos
ngan gin rape ak niya sin wara alinlangan ngan labag saak buot.

QUESTION 3:If you were the victim and got raped, how did you fled from him that night? (Kun
ikaw an biktima ngan gin rape ka,pano kaman naka takas Saiya siton na gabe?)

ANSWER 3: He threatened me that night that if I tell/report this to anyone and to the police he
will come back and hurt my family then he fled immediately. ( gin hadok ak niya siton na gab-e
nga kun mag sumat ak or report sa iba ngan pulis babalikan niya ak familya ngan papasul-an niya
ngan tinakas na siya daritso.
QUESTION 4: As you have been said that he will return and hurt your family, is this suspect
have any relations with you or do you know each other? (sa imo gin sugad nga babalikan ngan
papasulan niya im pamilya, in ini ba na suspect yaun relasyon saim or mag kakilala ba kam?)

ANSWER 4: Yes we know each other but we don’t have any relations, infact we’re neighbors.
( opo kilala namon an tagsa pero wara kami relasyon, sa kamatuuran mag kapit bahay kami.)

QUESTION 5: How can you tell that you know this suspect and he’s your neighbor back when
you have stated that the alley is unlit? ( pano mo na sugad nga kila ngan kapit bahay mo an
suspect na gin sugad mo nga masirom man an iskinita?)

ANSWER 5: By the way he have threatened me about my family and even tho its dark in that
area I still can see his face faintly and that’s confirmed my thought that the suspect is Jean Paul
Lagarto.

QUESTION 6: Do you any more details to add to your statements? ( yaun kapa ba iba na detalye
na ig dudugang saim salaysay?)

ANSWER 6: That is the only information I can give sir, I’m begging for an immediate response
of this case. ( itun la po tanan na inpormasyon ak maihahatag sir, nakikimaluoy ak sin malaksi
nga baton sin kaso.)

QUESTION 7: Ok, thank you ma’am. Our office and staffs assures a fair and fast investigation of
this case. ( ok, salamat ma’am. Am opisina ngan staffs insisigurado nga magkakamay ada sin
patas ngan malaksi nga inbistigasyon sin na kaso.)

ANSWER 7: Thank you also sir. ( salamat liwat sir.)

July 6, 2024

TO WHOM IT MAY CONCERN;

This is to certify that Ms. Crystel Medice 23years old, with resident at Barangay Dalakit,
Catarman Northern Samar, was examined and treated in the medical examination facilities at
Northern Samar Provincial Hospital in Catarman on June 16, 2024 with the following findings.

- Deep laceration at the 9 o’clock position within the vaginal wall

- With emission and traces of semen found in uterine lining
- Tears in the vaginal wall and discoloration in the cervix

Issued this 6th day of July 2024 with appendices, for whatever legal purpose it may serve
