RULE VII - CLASSIFICATION AND GENERAL REQUIREMENTS OF ALL BUILDINGS BY USE OR OCCUPANCY

SECTION 701. Occupancy Classified


1. There are 10 Groups of Occupancies sub-divided into 25 Divisions.
a. Buildings proposed for construction shall be identified
according to their use or the character of its occupancy and shall be classified as follows:

Residential R-1 - low density zone; single family, single detached dwellings.

CONDITIONAL: 1. Preparatory schools, not exceed 3 classrooms, not less than 500m from nearest existing school offering or as provided in
the local zoning ordinance. 2. Boarding houses, not more than 8 boarders. 3. Neighborhood convenience stores, not exceed 10% of the
GFA, no liquor. 4. Computer rental shops, not exceed 10% of the total floor. 5. Home occupation, in house business, not more than 20% of
the TFA; not exceed 3 persons inclusive of the owner; no change in the outside appearance of the building 7. Home industry, not more than
30% GFA, not exceed 5 persons

Division A-2 (residential building for the exclusive use of non- leasing occupants not exceeding 10 persons)
Residential R-2- medium density use, low-rise single attached, duplex or multi-level building for multiple family
a. Basic R-2: single-attached or duplex building 1 - 3 storeys height, separate single use unit
b. Maximum R-2 : low-rise multi-level building 3 - 5 storeys height, multiple family
PRINCIPAL: 1. Single-attached/duplex/town houses, each privately owned 2. School dormitories 3. Convents and
monasteries 4. Military or police barracks 5. All uses allowed in Division A-1 (R-1) building 6. Pre-schools, elementary and high
schools, not exceed 16 classrooms 7. Outpatient clinics, medical clinics 8. Branch library and museum
ACCESSORY: 1. Customary incidental home occupations such as barber and beauty shops, tailoring and dress shops,
neighborhood convenience stores, retail drug stores.
CONDITIONAL: 1. Dance/voice studios is soundproofed and
air-condition 2. Sanitaria, nursery homes 3. Charitable institutions
4. Offices with no actual display, or lending of the office commodities, GFA not exceeding 30%. 5. Apartment
hotels/hometels 6. Processing, refilling and retailing of bottled drinking water with clearances from local health department 7. Home
occupation for profession practice, in-house, not exceed 30% GFA
Group B – Residential (Buildings/ Structures, Hotels and Apartments)
Division B-1
Residential R-3 - high-density use, low rise or medium-rise for multiple family with mixed housing types.
a. Basic R-3 : rowhouse building of 1 storey up to 3 storeys height, separate use unit as single-family
b. Maximum R-3 : medium-rise multi-level building of 6 up to 12 storeys height. multiple family
Residential R-4 - medium to high-density, low-rise townhouse, multiple family
PRINCIPAL: 1. Permitted R-1 and R-2 buildings 2. Leased single- detached unit, with more than 1 independent unit and duplexes.
3. Boarding/lodging houses
ACCESSORY: 1. Allowed R-1 and R-2 buildings 2. Branch library, museum 3. Hometel 4. Vocational school
CONDITIONAL: 1. All conditions in R-1 and R-2 with appropriate regulations

Residential R-5 - very high density, medium-rise or high-rise condominium, multiple family
PRINCIPAL: 1. Multi-family residential such as condominium,
high-rise residential, more than 5 storeys but not more than 12 storeys

Group C – Education and Recreation Division C-1


PRINCIPAL: 1. Educational institutions, including school
auditoriums 2. Seminar/workshop facilities 3. Training centers 4. Libraries, museums 5. Community centers. 6. Places of worship 7. Civic
centers 8. Other government buildings

Division C-2
GI (General Institutional) - community to national level of institutional use, low rise/medium-rise/high-rise, educational, training activities.
PRINCIPAL: 1. Amusement halls 2. Massage parlors 3. Health
studios 4. Billiard halls, golf 5. Dancing schools 6. Gymnasia/sports complex
ACCESSORY: 1. Government centers 2. Colleges, and other of
higher learning 3. General hospitals, medical centers 4. Scientific, cultural, academic centers except high risk warfare facilities 5.
Convention centers 6. Religious structures 7. Museums 8. Embassies/ consulate 9. Student housing

Group D – Institutional (Government and Health Services) Division D-1 (Institutional, where personal liberties of inmates are restrained,
or quarters of those rendering public
GI (General Institutional) - community to national level/low- rise, medium-rise/high-rise , medical government.
PRINCIPAL: 1. Mental hospitals 2. Police/fire stations 3. Jails, prisons, correctional institutions 4. Rehabilitation centers 5. Leprosaria,

SECTION 707. Maximum Height of Buildings


1. The maximum height and number of storeys shall be dependent upon the character of use and type of construction, considering end-
user population density, light and ventilation, width of RROW/streets particularly of its roadway/carriageway component, parking
requirements, etc.

2. Determination of Building Height:


a. BUILDING HEIGHT LIMIT (BHL) - the maximum height for buildings based on their use determined after considering the site
conditions, view, etc. BHL excludes the height of permitted projections above the roof
b. The Building Height Limit (BHL) of any proposed
building/structure shall only be as allowed under this Rule or under the duly approved local zoning ordinance, whichever is more
restrictive.

i. Every court have a width not less than 2m for 1 or 2 storey. However, if as a yard or vice versa, reduced to not less than
1.50m in cluster living units such as quadruplexes, with adjacent courts with area not less than 3 sqm. Separation walls/fences, not be

ii. For buildings 2 storeys in height, the min width of the rear or side court increased at the rate of 300 mm for each additional storey up

iv. Front yard may be partly paved/hardscaped (converted into a courtyard) to serve as a carport for a basic R-2 or basic R-3 or R-4
(individual lot), i.e., all for single-family dwelling units only

SECTION 703. Mixed Occupancy


1. General Requirements
Mixed occupancy for more than one occupancy, the whole building shall be subject to the most restrictive requirement
pertaining to any of the type of occupancy found therein except in the following:
a. One-storey building houses more than one occupancy, each portion of the building shall conform to the requirement of the
particular occupancy housed and;
b. Major use of the building shall determine the occupancy classification if minor accessory do not occupy more than 10% of
the area of any floor, nor more than 10% of the basic area permitted in the occupancy requirements
2. Forms of Occupancy Separation
Vertical or horizontal or both for occupancy separation, other forms may be required to afford a complete separation between the various
occupancy divisions in the building.

3. Types of Occupancy Separation


Classified as “One-Hour Fire-Resistive”, “Two-Hour Fire-Resistive”, “Three-Hour Fire-Resistive” and “Four-Hour Fire-Resistive.”
a. One-Hour Fire-Resistive Occupancy Separation - not less than 1 hour fire-resistive construction. All openings protected by a fire-
assembly having a 1 hr fire-resistive rating.
b. Two-Hour Fire-Resistive Occupancy Separation - not less than 2 hr fire-resistive construction. All openings protected by a fire
assembly having a 2 hr fire-resistive rating.
c. Three-Hour Fire-Resistive Occupancy Separation - not less than 3 hr fire-resistive construction. All openings forming separation shall be
protected by a fire assembly having a 3 hr fire-resistive rating and protected by vertical enclosures extending above and below openings.
Total width of all openings not exceed 25% of the length of the wall, no single opening have an area greater than 10 sqm. All openings shall
be protected by a fire assembly having a 3 hr fire-resistive rating.
d. Four-Hour Fire-Resistive Occupancy Separation - no openings therein and not less than 4 hr fire-resistive construction.

4. Fire Rating for Occupancy Separation


Provided between groups, subgroupings, or divisions of occupancies. Occupancy separation required, min. is “One-Hour Fire-Resistive
Occupancy Separation” with horizontal separation, and protected by an equivalent fire-resistive construction.

SECTION 704. Location on Property


1. General
a. No building shall be constructed unless it adjoins or has direct access to a public space on at least one side.
b. Centerline of an adjoining street/alley an adjacent property line.
c. Eaves over required windows not less than 750 mm from the side and rear property lines.

2. Fire Resistance of Walls


Exterior walls shall have fire resistance and opening protection in accordance with the requirements. Projections beyond the
exterior wall not exceed beyond a point one third the dist. from vertical plane located. When openings in exterior walls are
required to be protected due to distance from property line, sum of the areas of such openings not exceed 50% of the total area of the wall
in that storey.

3. Buildings on Same Property and Buildings Containing Courts Required wall and opening protection, buildings on the same property and
court walls shall be assumed to have a property line between them. New building on the same property with an
existing building, the assumed property line from the existing building shall be the distance to the property line for each occupancy. Two
or more buildings on the same property may be considered as one building if the aggregate area of such building is within the limits of
allowable floor areas for a single building.

4. Building Footprint and Firewall Requirements


Without a firewall, footprint of a proposed building measured horizontally from the property line to the outermost faces of the exterior
walls of the building. The resultant area established at
grade level upon which the proposed building/structure may stand shall be the AMBF

Footprint Based on Firewall Provisions


i. Firewall on one side, footprint of a proposed building measured horizontally from the property line with a firewall to the outermost faces
of the opposite exterior walls of the building

ii. Firewall on 2 sides one side and rear property line, footprint of a proposed building measured horizontally from the opposing property
lines in case of a firewall on 2 sides or from the rear property line with a firewall to the outermost faces of the
opposite exterior walls of the building

iii. No firewalls for R-1; abutment permitted of up to 3.20m from established grade level solely for supporting a carport roof; abutment
constructed of perforated/decorative concrete blocks above 1.50m measured vertically from the established grade
level; not be longer than 7m or 50% of the side property line in total length

iv. For R-2, erected max of 80% of the total length of a side property line; one side property line for a firewall in the case of a R-2 structure

v. For R-3, 2 types of firewall construction may be permitted


(a) firewall 2 sides, erected max of 85% of the total length of
each side property line; not exceed 65% of the total perimeter of property, firewalls not allowed for a max 2 storey
(b) 1 side property line and rear property line, erected max of
90% of the total length of the side and rear property lines and up to 100% in case the rear property line is only 4m wide; not exceed 50% of
the total perimeter of property, firewall allowed for max of 2 storey but not at the rear property line where the max allowed firewall height
3.20m measured vertically from established grade

vi. For townhouse (R-4), firewalls on 2 sides of each townhouse; erected max of 85% of the total length of each side property line; not
exceed 50% of the total perimeter of each property, each allowed for a max 3 storey

vii. For residential condominium (R-5), 2types of firewall construction may be permitted:
(a) Firewall on 2 sides, erected max of 75% of the total length of each side; not exceed 50% of the total perimeter of property, allowed for
a max 8 storey, i.e., the podium
(b) One side and rear property line, erected max of 65% of the total length of the side and on max of 50% of the total length of the rear;
not exceed 60% of the total perimeter, allowed for a max 8 storey; and at rear property line, the max height 14m
measured vertically from established grade
