In India, the Indian Penal Code (IPC) is the main law regarding criminal offenses, covering those affecting property, the human body, public
Course order, defamation, public health, and offenses against the state. The IPC has been amended multiple times over the years to add new
Description : offenses, modify punishments, and update existing offenses. Additionally, various Law Commission reports have recommended
amendments to the IPC on topics such as food adulteration, offenses against women, and the death penalty. To reform India's criminal
justice system, the Bharatiya Nyaya Sanhita Bill 2023 was proposed, which consists of 358 sections, while the IPC consists of 511
sections. The Bharatiya Nyaya Sanhita, 2023 (BNS), marks a substantial overhaul of the Indian Penal Code (IPC) of 1860. While the IPC,
rooted in colonial legislation, often contains outdated provisions ill-suited to contemporary challenges, the BNS modernizes and streamlines
the criminal justice framework to better reflect present-day societal norms and technological advancements. Key differences include a
stronger emphasis on victim rights, stricter penalties for gender-based and sexual crimes, and provisions for handling cybercrimes and
digital evidence. The BNS also simplifies legal procedures, aiming to reduce judicial backlog and enhance the efficiency and accessibility of
justice delivery. By integrating community participation and aligning with international human rights standards, the BNS seeks to create a
more transparent, accountable, and effective legal system.
