AMAKYE OKOGYEADE II acting for and behalf OBREMPONG of
ABENKYIM Traditional Area in the Ashanti Region of the Republic of Ghana
(hereinafter called ‘The Lessor’ which expression shall where the context so admits or
requires of the Principal Elders of the ABENKYIM Stool which consent and concurrence
are testified by some of such Principal Elders subscribing their names and witness to
these presents of the one part and AMINA ISSAKA AMABIRIKA of ABENKYIM
in the Ashanti aforesaid (hereinafter called ‘” The Lessee’”which expression shall where
the context so admits or requires include their executors administrators successors
according to Native Customary Law and assigns) of the other part………..
WHEREAS the Abenkyim Stool of which the Lessor is the Lawful representative and
Head in possession and whereas the premises hereinafter described is free from
encumbrances……………………AND WHEREAS the Lessor with the consent and
concurrences of his Elders aforesaid has agreed with the Lessor to demise the said
herediterment unto the Lessee………………. NOW THIS INDENTURE
WINESSETH
That in pursuance of the said agreement and in consideration of the rent hereby reserved
and the covenants and conditions hereinafter contained and on the part the Lessee to be
observed and performed the Lessor hereby demised unto the Lessee ALL THAT piece or
parcel of land known as PLOT NO. 9B BLOCK ‘C’ ABENKYIM Layout in the
Ashanti Region of the Republic of Ghana bounded on the North by PLOT NO. 9C and
measuring ONE HUNDRED Feet (100’-0”) bounded on the South by PROPOSED
ROAD and measuring on that side a distance of ONE HUNDRED Feet (100’-0”)
bounded on the East by PLOT NO. 9A and measuring on that side a distance of ONE
HUNDRED (100’-0”) and on the West by PLOT NO. 11 and measuring on that side a
distance of ONE HUNDRED Feet (100’-0”) thus enclosing an approximate area of
0.22 Acre Approx. be the same several dimensions little more or less the same piece or
parcel of land is more particularly delineated on the plan attached hereto and hereon
shown edged pink TOGETHER with all the rights easements and appurtenances to the
said demised premises unto the Lessee for term of Ninety –nine (99) years from the first
day of ……Determinable nevertheless heretheless hereinafter provided YIELDING
AND PAYING therefore unto the Lessor during the said term the yearly rent of (GH ¢
………..) payable in advance on the first day of July, in every year and that the Lessee
covenants with the a Lessor in the manner following that is to say:-
1. That the Lessee will from time to time and during the said term pay unto the
Lessor the yearly rent hereby reserved at the times and in the manner
aforesaid……………
2. And also will not without the prior consent in writing of the Lessor assign under
mortgage or part with the possession of the demised premises or any part thereof
or any building or buildings erected thereon or part or such building or buildings
or any interest…………………………………
3. And also will not do to be done upon the said demised premises or any part any
part thereof any building or act thing which may be or become a nuisance damage
annoyance to the Lessor or to the occupiers of the adjoining plots and in particular
will but use or permit to be used the demised premises or any part thereof for any
noxious or offensive trade or business whatever……………………………….
4. And also will bear pay and discharge all existing imposed on the said demised
premises or any building or buildings which may be erected thereon during the
said term or imposes upon or payable by the said term of imposes upon or payable
by the owner or occupiers in respect thereof PROVIDED ALWAYS or all or any
part that in the event of the Lessor at any future date being found liable for
payment of all or any part of such rates taxes charges in any such on case it shall
be lawful for the Lessor to add such amount to be paid to the amount or rent
payable next after such as if the had been read hereby reserved and then due and

5. And also will permit the Lessor or his duly after said agent at any between the
hours of six o’clock in forenoon six in the afternoon. AND WILL repair and
made good within a reasonable time and devects or which notice in writing shall
be shall given by the Lessor to the Lessee or to the agent of the
Lessees……………
6. And also will use demised premises for RESIDENTIAL PURPOSE and any
other building or structures unto the other purposes incidental
thereto…………………..
7. And also will the demised premises and the said tenancy is subject to renewal for
further term of years the expiration date provided always at that there is not
existing breach of any condition………………………………………….
8. THE LESSOR HEREBY COVENANTS WITHIN THE LESSEE that the
Lessee paying the hereby reserved and observed and performing the several
covenants and stipulations herein on his part contained shall peaceable hold and
enjoy he demises during the said without interruption by the Lessor or any person
rightfully claiming under or in trust for him……………………………..
PROVIDED ALWAYS and these presents are upon this condition that if the
yearly rent hereby reserved or any part thereof shall be in arrears for (3) Calendar
Months whether legal demanded or act of it the Lessee shall at any time fail or
neglect to perform or observe any of the covenants and stipulation on his part
herein contained it shall be lawful for the Lessor to re-enter upon the demised
shall absolutely determine but without prejudice to the rights of action the Lessor
in respect of any of Lessee’s covenants herein contained………………………..
