(1)The process of deposit of earnest money through offline instruments like Bank Draft, Pay Order etc. will
be stopped for e–tender procurement of this Division wef. 01.09.2016. Necessary Earnest Money will be
deposited by the bidder electronically: online – through his net banking enabled bank account,
maintained at any bank or: offline – through any bank by generating NEFT/ RTGS challan from the e–
tendering portal. Intending Bidder will get the Beneficiary details from e–tender portal with the help of
Digital Signature Certificate and may transfer the EMD from their respective Bank as per the Beneficiary
Name & Account No., Amount, Beneficiary Bank name(ICICI Bank) & IFSC Code and e–Proc Ref No.
Intending bidder who wants to transfer EMD through NEFT/RTGS must read the instruction of the Challan
generated from E–Procurement site.
Bidders are also advised to submit EMD of their bid, at least 3 working days before the bid submission
closing date as it requires time for processing of Payment of EMD.

(2) Eligibility criteria for participation in the tender:-

(a) Resourceful, Bonafide, Electrical contractors.

(b)Subletting of contract is strictly prohibited.

(ii)Credential:-
a) Intending Tenderers should produce credentials of a similar nature of completed work of the
minimum value of 40% of the estimated amount put to tender during 5 (five) years prior to the
date of issue of this tender notice ;or,

b) Intending Tenderers should produce credentials of 2 (two) similar nature of completed work, each of
the minimum value of 30% of the estimated amount put to tender during 5 (five) years prior to the date of
issue of the tender notice; or,

c) Intending Tenderers should produce credentials of one single running work of similar nature which has
been completed to the extent of 80% or more and value of which is not less than the desired value at
above.

d) In case of running works, only those Tenderers who will submit the certificate of satisfactory running
work from the concerned Executive Engineer, or equivalent competent authority will be eligible for the
tender. In the required certificate it should be clearly stated that the work is in progress satisfactorily and
also that no penal action has been initiated against the executed agency, i.e., the tenderer. (G 0 No.04-
A/PW/0/10C-02/14 dated 18/03/2015.

e) Payment certificate will not be treated as credential.

f) Credential certificate issued by the Executive Engineer or equivalent or competent authority of a State/
Central Government, State/ Central Government under taking, Statutory / Autonomous bodied constituted
under the Central / state statute on the executed value of completed /running work will be taken as
credential.

Clarification: Certificate of Work completion within India only will be considered as credential.
iii) Additional performance Security @ 10% of the tendered amount is to be deposited by the successful
bidder when the bid rate is 80% or less of the estimated amount put to tender.
The additional Performance Security shall be submitted in the form of Bank Guarantee from any
Scheduled Bank before issuance of the Work Order. If the bidder fails to submit the Additional
Performance Security within seven working days from the date of issuance of Letter of Acceptance, his
Earnest Money will be forfeited and other necessary actions as per NIT like blacklisting of the contractor,
etc, may be taken. The Bank Guarantee shall have to be valid up to end of the Contract Period and shall
be renewed accordingly, if required (Vide order No. 4608-F(Y) Dt. 18/07/2018 of the Addl. Chief Secretary
to the Govt. of West Bengal)

iv) Valid 15-digit Goods and Service Taxpayer Identification Number (GSTIN) under GST Act, 2017.

v) Tax invoice(s) needs to be issued by the supplier for raising claim under the contract showing separately the
tax charged in accordance with the provisions of GST Act. 2017.

(vi)Valid Trade Licence , Tax Challan, Pan Card ,Income Tax Acknowledgement Receipt for AY 2024-25 to
be accompanied with the Technical Bid Documents, to be submitted. [Non statutory Documents]

(vii)Valid Trade Licence, Pan Card ,P Tax, to be accompanied with the Technical Bid Documents, Income Tax
Acknowledgement Receipt for AY2024-25 / latest assessment year to be submitted. [Non statutory Documents]
viii) The Tax Audit Report in 3CD Form/ Auditors report as the case along with the balance sheet and profit and loss
account, and all the schedules forming the part of Balance Sheet and Profit & Loss Account in favour of applicant, for last
3(three) Financial Years, are to be submitted. The Balance Sheet, Profit & Loss Account and all related schedules
must be examined and signed by a competent Chartered Accountant, failing which the bid will be liable for
rejection .
(ix) Where there is a discrepancy between the unit rate & the line item total resulting from multiplying the unit rate
by the quantity, the unit rate quoted shall govern.
(x) The Bidder must have valid Electrical Contractors License with Electrical Supervisor holding
Valid Supervisor Competency Certificate (SCC) on the parts 1, 2, 4, 6A, 6B, 7A & 11 as per I.E. Rules.
Supervisor should be available at site as and when required.
(xi) The bidders must be Government ESI & EPF Registered for participating the tender & Contractor shall have to comply
with the provisions of (a) minimum wages Act. 1948 (b) Employees’ Provident Funds & Miscellaneous Act 1952 and (c)
E.S.I. Act, 1948. Respective bidders are requested to upload the necessary challan regarding ESI & EPF.

(3)No mobilization /secured advance will be allowed.

(4) PROHIBITION ON SUSPENDED / DEBARRED PERONS / ENTITIES TO PARTICIPATE IN THE BIDDING

OF GOVERNMENT PROJECTS / CONTRACTS OF THE DEPARETMENT.
A person / entity that is suspended / debarred by a procuring entity shall not be allowed to
participate in any procurement process under Public Works Department during the period of suspension
/ debarment unless the same has been revoked.
A joint venture or consortium which is suspended / debarred or which has suspended / debarred
member/s and / or partner/s as well as a person / entity who is a member of a suspended / debarred joint
venture or consortium shall, likewise, not be allowed to participate in any procurement process under
Public Works Department during the period of suspension / debarment unless the same has been
revoked.
(5) Defect liabilities period should be 1(one) year from the date of completion.
(6) Bids shall remain valid for a period not less than 120 days (One Hundred Twenty) from the last date of
submission of Financial Bid / Sealed Bid. If the bidder withdraws the bid during the period of bid validity the
earnest money as deposited will be forfeited forthwith without assigning any reason thereof.

(7) Agencies shall have to arrange for storage of materials, labour shed etc. at their own cost and responsibility.

(8) Rate should be quoted the rate online basis.

(9) In connection with the work, Arbitration will not be allowed. The Clause No. 25 of WBF 2911(ii) is to be
considered as deleted clause vide gazette notification no 558/SPW-13th December, 2011.

(12) All the Prospective Bidders shall have to execute the work in such a manner so that appropriate service level
of the work is kept during progress of work to the successful completion of the work to the entire satisfaction of
the Engineer-in-Charge may be considered towards release of full “Security Deposit”. Clause-17 of
2911/2911(i)/2911(ii) form is revised in connection to release of Security deposit as per order no 177-
CRC/2M-57/2008 dated 12/07/12 of PWD, 52-CRC/2M-06/2014 dated 27/10/14, 874-W(C)/1M-192/2014
DATED 27/11/14 of PWD.

No interest would be paid on the Performance Security Deposit.

(13) All Bidders are requested to present in the Office of EE, Kolkata Central Electrical Division PWDte, during
opening the financial bid Executive Engineer, Kolkata Central Electrical Division, P.W.Dte. may call fresh
tender after opening of the said bid to obtain the suitable rate further, if it is required. No objections in this respect
will be entertained raised by any Bidder who will present during opening of bid, or from any Bidder who will absent
at the time of opening of Financial Bid. No informal Bidder will be entertained in the Bid further.

(14)
(A) Earnest Money: - The amount of Earnest Money @ 2% (two percent) of the estimated amount/amount put to
tender i.e; Rs 66,584/-( Rupees Sixty six thousand five hundred eighty four) Only, should be remitted his
net banking enabled bank account, maintained at any bank or: offline – through any bank by generating
NEFT/ RTGS challan from the e–tendering portal. Intending Bidder will get the Beneficiary details from e–
tender portal in favour of“ Executive Engineer, Kolkata Central Electrical Division, P.W.Dte against the work
.

(B)
1. As per memo no. -3975-F(Y) dated 28/07/2015 of Finance Department, Audit Branch, Govt. of West
Bengal, the system of online submission of Earnest Money Deposit / Tender fees by the bidders
participating in e-procurement through state Government e-procurement portal of Stat Govt.
departments and it’s subordinate offices, PSUS, Autonomous and Local Bodies, PRIs etc. will be
st
mandatory with effect from 1 September, 2016. Refunds / settlements will be made as per
st
procedures laid down in the said memo. Therefore, with effect from 1 September, 2016 no Demand
Draft or anything like this will be entertained as Earnest Money Deposit / Tender fees in respect of e-
tender.

2. As per memo no. 547-W(C)/1M-387/15 dated 16/11/2015, Government of West Bengal introduced panel
measures of Suspension and Debarment of Contractors Suppliers and Consultants who are participating
in tender process as well as selected for execution of Public Works for their false declaration or forgery or
falsification of records submitted or failure to execute committed contract or for their failure to perform
contractual obligations and thereby resulting delay in execution of the public works or execution of faulty
works. The detailed guidelines are annexed in the said memorandum.
3. The bidder should have capability to work at site 24 x 365 and may be required to do so for
which no additional payment would be entertained.

(C) As per order No. 460-CE(E)-I, PWD dated 03.03.2014 of Chief Engineer (Electrical)- I, PWD,
the
Tenderers /bidders who will not produce/deposit the instruments of EMD physically as stipulated
in the NIT shall be barred from participating any further tender of this Directorate for one (1)
year from the date of NIT.
(15) The Bidder, at his own responsibility and risk is encouraged to visit and examine the site of works and its
Surroundings and obtain all information that may be necessary for preparing the Bid and entering into a contract
for the work as mentioned in the Notice Inviting Tender, before submitting offer with full satisfaction, the cost of
visiting the site shall be at his own expense.

(16) (A)The intending Bidders shall clearly understand that whatever may be the outcome of the present invitation
of Bids, no cost of Bidding shall be reimbursable by the Department.

(B) Executive Engineer, Kolkata Central Electrical Division, P.W. Dte. Reserves the right to reject/cancel any
offer without assigning any reason whatsoever and is not liable for any cost that might have incurred by any
Bidder at the stage of Bidding.

(C) Executive Engineer, Kolkata Central Electrical Division, P.W .Dte., reserves the right to issue any corrigendum
to the NIT or cancel the N.I.T. due to unavoidable circumstances and no claim in this respect will be entertained.

(17) Refund of EMD: The Earnest Money of all the unsuccessful bidders will be refunded through online process
after uploading AOC (Award of Contract) procedure as per Government Order 441-F(Y), dated 27/01/2020 of
Additional Chief Secretary Finance Department, Govt. of West Bengal.

(18) Prospective applicants are advised to note carefully the minimum qualification criteria as mentioned
in ‘Instructions to Bidders’ before tendering the bids.

(19) Conditional/ Incomplete tender will not be accepted.

(20) No price preference is allowed for the bidder and no escalation of price is allowed in any circumstances
throughout the validity of the tender, execution of the work or before receiving the full payment.

(21) No mobilization/ secured advance will be allowed.

(22) Labour Welfare Cess will be deducted as per prevailing rule.

(23) If any bidder withdraws his/her offer before acceptance or refuse within a reasonable time without giving any
under this circle for minimum period of 1(one) year.

(24) During the scrutiny, if it come to the notice to tender inviting authority that the credential or any other paper
found incorrect/ manufactured/ fabricated, that bidder would not allowed to participate in the tender and that
application will be out rightly rejected without any prejudice
.
(25) Before issuance of the WORK ORDER, the tender inviting authority may verify the credential and
other original documents of the lowest bidder if required. After verification if it is found that the documents
submitted by the lowest bidder is either manufactured or false in that case work order will not be issued in favour
of the said bidder under any circumstances.

(26) If any discrepancy arises between two similar clauses on different notification, the clause as stated in later
notification will supersede former one in following sequence.

(i) Form No: 2911(ii)

(ii) N.I.T

(iii) Technical Bid.

(iv) Financial Bid.

(27) Qualification Criteria: -

The tender inviting & Accepting Authority through an “Evaluation Committee” will determine the eligibility of each
bidder. The financial offer of the prospective bidder will be considered only if the bidder qualifies in the Technical
Bid.
If any document submitted by a bidder is either manufacture or false, in such cases the eligibility of the bidder will
be out rightly rejected at any stage without any prejudice. The decision of Executive Engineer, Kolkata Central
Electrical Division, P.W.Dte. will be final and no challenge against such decision will be entertained.

(28) Issuance of work order as well as payment will depend on availability of fund and no claim what so ever will
be entertained for delay of Issuance of work order as well as payment, if any. Intending bidders may consider
these criteria quoting their rates.

(29) Where an individual person holds a digital certificate in his own name duly issued to him against the
company or the firm of which he happens to be a director or partner, such individual person shall while uploading
any tender for and on behalf of such company or firm, invariably upload a copy of power of attorney showing
clear authorization in his favour by the rest of the directors of such company or the partners of such firm to upload
such tender. The power of attorney shall have to be registered in accordance with the provisions of the
Registration Act,

(30) The successful bidder has to execute an agreement in West Bengal Form No. 2911(ii) before final
acceptance of the work.

(31) In case of exigency of work, work may have to be done on holidays as well as at night. No extra payment for
doing work in holidays or night will be made. The bidder should keep this in mind before offering rate in tender.

(32) The tender inviting authority is not obligated to offer work order to the lowest bidder.

(33) Tender inviting authority at his own discretion may relax minor shortfall (if any) of the qualification
criteria of the participants for the interest of Government works.
(34) Form – I and Form – III of section – B should be on respective bidder’s letterhead.
(35) Bidders are strictly instructed not to upload unnecessary documents.
(36) Contractor should have to ensure the engagement of job card holders registered under MGNREGA
as unskilled workers for execution of awarded works as per order of PWD vide memo no.-
25017(12)/17/2024 dated 01.03.2024.

INSTRUCTION TO BIDDERS

SECTION – A

1. General guidance for e-Tendering

Instructions/ Guidelines for tenders for electronic submission of the tenders have been
annexed for assisting the contractors to participate in e-Tendering.

2. Registration of Contractor

Any contractor willing to take part in the process of e-Tendering will have to be enrolled &
registered with the Government e-Procurement system; through logging on to
https://etender.wb.nic.in (the web portal of public works department) the contractor is to click
on the link for e-Tendering site as given on the web portal.

3. Digital Signature certificate (DSC)

Each contractor is required to obtain a class-II or Class-III Digital Signature Certificate (DSC)
for submission of tenders, from the approved service provider of the National Information’s
Centre (NIC) on payment of requisite amount details are available at the Web Site stated in
Clause 2 of Guideline to Tenderer DSC is given as a USB e-Token.

4. The contractor can search & download NIT & Tender Documents electronically from computer
once he logs on to the website mentioned in Clause 2 using the Digital Signature Certificate.
This is the only mode of collection of Tender Documents.

5. Participation in more than one work

A prospective bidder shall be allowed to participate in the job either in the capacity of individual
or as a partner of a firm. If found to have applied severally in a single job all his applications
will be rejected for that job.

6. Submission of Tenders.
General process of submission, Tenders are to be submitted through online to the website in
two folders at a time for each work, one in Technical Proposal & the other is Financial
Proposal before the prescribed date &time using the Digital Signature Certificate (DSC) the
documents are to be uploaded virus scanned copy duly Digitally Signed. The documents will
get encrypted (transformed into non readable formats).

A. Technical proposal

The Technical proposal should contain scanned copies of the following further two covers
(folders).

All statutory and non-statutory documents copy should be self-attested with rubber stamp
before uploading.

A-1.Statutory Cover Containing

i. Demand Draft/ bankers Cheque towards earnest money (EMD) as prescribed in the NIT
against each of the serial of work in favour of the Concerned Executive Engineer,
Kolkata Central Electrical Division, P.W. Directorate.

ii. Tender form No. 2911(ii) & NIT with all agenda & corrigendum (download & upload
the same digitally Signed, quoting rate will only encrypted in the B.O.Q. under
Financial Bid. In case quoting any rate in 2911(ii) the tender liable to
summarily rejected).

A-2. Non statutory Cover Containing

i. Valid Trade License & Electrical license, Pan Card, Income Tax Acknowledgement
Receipt for the Assessment year 2024-25, GS, Current P Tax Challan.

ii. Deed of partnership Firm/ Article of Association & Memorandum (if any).

iii. Power of Attorney (For Partnership Firm/ Private Limited Company, if any) or as
mentioned in SL No 27 of this NIT.

iv. Requisite Credential as per 2(ii)-(a to f) of this NIT.

v. Affidavit – Y to be submitted in Non-judicial stamp paper of appropriate value duly

notarized.

vi. The prospective bidder shall have in their full time engagement, experienced technical
personnel, minimum being one Electrical Diploma holder failing which the bid will be
liable for rejection.
vii. Valid Electrical Contractor License issued by Directorate of Electricity, Govt. of West
Bengal.
viii. The bidder must have valid Electrical Supervisors‟ Certificate of Competency in 1, 2, 4,
6A, 6B, 7A & 11 or equivalent National Supervisors‟ Certificate of Competency.
Note: - Failure of submission of any of the above mentioned documents (as stated in A1
& A2) if applicable to a bidder, will render the tender liable to summarily rejected for
both statutory & non statutory cover.
B. Financial proposal

i. The financial proposal should contain the following documents in one cover(folder) i.e., Bill of
quantities (BOQ) the contractor is to quote the rate online through computer in the space marked for quoting
rate in the BOQ.
ii. Only downloaded copies of the above documents are to be uploaded virus scanned & Digitally Signed by
the contractor.
iii. Overall quoted rate will be the criterion for schedule of agency.

7. Penalty for suppression / distortion of facts

Submission of false document by tenderer is strictly prohibited & if found action may be referred to the appropriate
authority for prosecution as per relevant IT Act with forfeiture of earnest money forthwith.

8. REJECTION OF BID
The tender accepting authority reserves the right to reject any or all the tenders without assigning any reason
and will not be bound to accept either the lowest tender or any of the tenders as per the general guidelines
and directions for guidance of contractors laid down in 2911(ii).

9. AWARD OF CONTRACT
After issuing provisional work order to the successful bidder, the bidder have to purchase 2911(ii) & schedule from the
respective Division office and submit the same after filling up properly within stipulated period mentioned in Provisional
order for agreement with The Government. Award of Contract will be issued accordingly
