QUESTION: 01st January, 2025: Adv. Omary while representing his client in an appeal
case at the Court of Appeal of Tanzania at Iringa, before a full bench panel of Justices of
Appeal chaired by Hon. Dr. Mkuki J.A. Lost a his civil appeal on preliminary objection.
He got so angered since that before the appeal got dismissed the chairman of the panel
blasted him in a way to discredit his competence and abilities in dealing with important
legal matters and interpretation of the black letters of the law. When asked to address the
court on the merit of the matter at hand, he told the chairman of the panel that “this so
called P.O. you entertained today had no legs fit to stand before this court. I am
surprised you dismiss this appeal on a baseless preliminary objection, leading to a huge
miscarriage of justice. If not for being corrupt then I don’t know what purpose you serve,
the judicial system in this miserable country is so corrupt. Since we know how things
operate in our judicial system, we will wait for that piece of judgment of which I know it
will be horrible then we will knock the doors of the East African Court of Justice, for
them to see how incompetent members of the bench in this country are.”
Hon. Dr. Mkuki J.A got so angered by the words uttered by the learned advocate, he
viewed them as a misconduct warranting punishment from him. He suspended adv.
Omary from practicing Law in Tanzania mainland for 2 years. In two days the file was
sent to the High Court of Iringa for reference of the punishment, to which the High Court
agreed and upheld the punishment to Adv. Omary.

that before the case got dismissed the learned magistrate blasted him in a way to discredit
his competence and abilities in dealing with important legal matters and interpretation of
the black letters of the law. When asked to address the court on the merit of the matter at
hand, he told the learned magistrate that “the whole process leading to this judgment was
so absurd and shambolic if clearly view between the lines. I am surprised that with all
the evidence tendered before this court by my client, this is a huge miscarriage of justice.
If not for being corrupt then I don’t know what purpose this court serve, the judicial
system in this miserable country is so poor and irritating. Since we know how things
operate in our judicial system, we will wait for that for that so called judgment of which I
know it will be so poor and easy to challenge, then we will knock the doors of the Court
of Appeal of Tanzania and litigate before proper and competent members of the bench.”

viewed them as a misconduct warranting punishment from him. He suspended learned
Kimbuta Michael from practicing Law in Tanzania mainland for 2 years. In two days the
file was sent to the High Court of Iringa for reference of the punishment, to which the
High Court agreed and upheld the punishment to Kimbuta Michael.

but working with you will take the name of this respected firm to the mad. So I am truly
sorry but you will have to look for another firm somewhere else”. At a huge point this

23rd October, 2024 Adv. Mwinyimkuu appeared before the District Land and Housing
Tribunal at Mbeya representing his client the respondent in a case between Mwajuma
Nyaugoko V. Anna Siingiliki Land Case No.645 of 2024 before Ally Mandy (CP).
Shortly before hearing Adv. Mwinyimkuu sought that there is a need for him to file an
application for injunction against Ms. Nyaugoko, so, he prayed for a three days
adjournment so that he can file his application. In two days he filed an application before
the DLHT, and short after he received a call from the chairman to meet him at Alexandria
Hotel for lunch, he honored the meeting but to his dismay the chairperson Mr. Ally
Mandy told him that “I saw your well drafted application for temporary injunction, which
shows how good you are in drafting and legal reasoning, but normally injunctions are not
given freely of which according the caliber and reputation of your firm you will have to
pay TZS 1,000,000/= for it to be granted or kiss your application goodbye”
26h July, 2024: the learned Chair Person Ally Mandy was spotted at Miami Bar & Grill
drinking and hugging with Mwaijuma Nyaugoko. After a thorough research Adv.
