The present Writ Petition under Article 226 of the
Constitution of India is being filed by the Petitioner
in person, seeking urgent directions from this
Hon'ble Court to permit him to undergo medical
verification for benchmark disability status for
claiming a seat under the PWD quota for NEET UG
Counselling 2025.
The Petitioner appeared for the NEET UG 2025
examination but, subsequent to submission of his
application form, was diagnosed with Bone
Tuberculosis which has resulted in a Kyphotic
Deformity. Due to this unforeseen medical condition,
the Petitioner now qualifies as a Person with
Benchmark Disability under the Rights of Persons
with Disabilities Act, 2016.
At the time of filling the NEET application, the
Petitioner did not claim the PWD quota as he was
not diagnosed and did not have a PWD certificate
or UDID card. As per the NEET UG Information
Bulletin, final disability verification is to be
conducted by a designated Disability Certification
Centre notified by the Medical Counselling
Committee (MCC), and the certificate issued by such
centre is final for seat allotment under the PWD
quota.
The Petitioner is ready and willing to appear before
the competent Medical Board as designated by
MCC. However, if the Respondents proceed to
announce or finalize the State Merit List (SML)
without completing the Petitioner's medical
verification, the Petitioner will be deprived of his
statutory and fundamental rights under Articles 14
and 21 of the Constitution.
Hence, the Petitioner seeks directions restraining the
Respondents from finalizing the State Merit List
(SML) till his medical verification is duly completed,
and further seeks directions to treat such
verification as final for seat allotment under the
PWD quota.
