LAST WILL AND TESTAMENT
This document is hereby executed as a DEED.
This is the last will and testament of me [INSERT NAME] of [ADDRESS].
I, [INSERT NAME], [ADDRESS] revoke on [INSERT DATE] all former wills and testamentary
dispositions made by me and DECLARE THIS TO BE MY LAST WILL AND TESTAMENT.
1. Appointment of Executors
I appoint [INSERT NAME] (date of birth INSERT) of [INSERT ADDRESS]to be the executor of this
will but if he should die or be unable or unwilling to act as my executor I appoint [INSERT NAME]
of [INSERT ADDRESS] to fill any vacancy thereby arising.
2. Defined Terms
Where definitions refer to Shariah law or Islamic terminology, such as divorce or marriage, the
interpretation of such terms will be confined to the meaning of the terms as defined by the writings
of classical scholars of the Hanafi School of Jurisprudence.
3. Resolution of Dispute over Defined Terms
Where there is dispute over any matter regarding definitions of Islamic terms I hereby appoint
[INSERT NAME & ADDRESS] to resolve such dispute/s, his resolution must be in line with the
dominant position found in the Hanafi school of Jurisprudence as defined in the renowned work of
Hanafi Fiqh ‘al-Ikhtiyar’.
4. Disposal of Body
I wish my body to be buried in strict accordance with the Islamic rules of Shariah with reference to
Hanafi Fiqh.
5. Disposal of Property
I DEVISE all my real and personal property unto my executors upon trust to distribute to my Islamic
Heirs in accordance with Islamic Shariah Law with reference to Hanafi Fiqh.
6. Dispute by a Party
In the event that any party does dispute the validity of this will or make any claim against my estate
whether under the Inheritance (Provision for Family and Dependants) Act 1975 or any re-
enactment or statutory modification thereof or otherwise (save in respect of any valid debt owed to
[INSERT NAME] by my estate at the date of my death) any entitlement under this will in favour of
[INSERT NAME] shall be forfeited and shall be distributed to my Islamic Heirs in accordance with
Islamic Shariah Law with reference to Hanafi Fiqh.
7. The Wasiyah
According to Islamic sacred law the heirs are dictated however the testator does have the freedom
to apportion up to one third of his/her estate to any person or institution he/she chooses, the only
restriction being he/she cannot apportion any amount to an individual who is a valid inheritor at the
