FIVERR TERMS AND CONDITIONS

1. General Overview

 Fiverr is an online marketplace for buying and selling digital services.


 By using the site, you agree to Fiverr’s Terms of Service, Payment Terms, Community
Standards, and Privacy Policy.
 You must be 18+ to use Fiverr. Users aged 13–17 may only use it under a
parent/guardian’s account.
 Fiverr is unavailable to users under sanctions or trade restrictions.

2. Key Roles

 Buyers → purchase services.


 Sellers/Freelancers → offer services (“Gigs”).
 Gigs → services Sellers post for Buyers to order.
 Custom Offers → tailored service proposals for Buyers.
 Hourly Contracts → time-based agreements with weekly reporting.
 Fiverr Go → AI-powered tools for Sellers (AI models & virtual assistants).

3. Accounts & Payments

 Only registered users can buy or sell.


 Sellers set their own prices (minimum $5 for Gigs or $7.25/hour for hourly work).
 Buyers pay Fiverr in advance.
 Payments & fees follow Fiverr’s Payment Terms.
 All payments must be done within Fiverr (no external payments allowed).

4. Buyers’ Rights

 Buyers get full rights to delivered work unless otherwise stated.


 Some services may charge extra for commercial use licenses.
 Fiverr can use published works for marketing & promotion.

5. Sellers’ Rules

 Sellers create Gigs and must deliver them as described.


 Gigs can include Gig Extras, Packages, Subscriptions, and Milestones.
 Sellers’ ratings and account levels depend on performance and reviews.
 Low-quality services, frequent cancellations, or violations can lead to account
suspension.
 Business Sellers may need to provide ID, trade registration, and compliance
documents.
 Sellers are encouraged to have liability insurance.

6. Pro Freelancers

 Pro Sellers are vetted professionals with higher standards.


 Fiverr regularly reviews Pro Sellers; poor performance may remove Pro status.

7. Prohibited Gigs

Fiverr removes Gigs that:

 Offer illegal, fraudulent, or copyright-infringing services


 Include adult, obscene, or violent content
 Mislead Buyers or resell restricted goods
 Provide academic work on behalf of Buyers
 Deliver low-quality or deceptive services

8. Hourly Contracts

 Sellers report hours weekly; unreported hours are unpaid.


 Buyers pay weekly for approved hours.
 Either party can end or pause contracts with 24-hour notice.

9. Physical Deliveries

 Some services include physical shipping (arts, crafts, collectibles).


 Sellers handle shipping & costs; Fiverr isn’t responsible for shipping issues.

10. Stock Media

 Sellers may use licensed images/music (e.g., from Shutterstock) in Gigs.


 Stock Media is for one-time use within a project and can’t be reused or resold.

11. Arbitration & Legal

 US users must resolve disputes via arbitration and waive class-action rights.
 Fiverr may suspend or remove accounts for Terms violations.

In short: Fiverr connects Buyers & Sellers for digital services. Users must follow Fiverr’s rules
on accounts, payments, content, and quality. Fiverr enforces policies to maintain trust and may
suspend violators.

5. Buyers

 Payments must only be made through Fiverr—no external payment methods allowed.
 Fiverr may use completed work (e.g., logo designs) for marketing and promotional
purposes.
 Buyers are responsible for ensuring any AI-generated content fits their needs and
follows Fiverr’s Community Standards.
 Funds used to purchase orders must come from legal sources.

6. Orders

 Order Creation: Orders are created after payment confirmation. AI model orders
complete upon download or after 24 hours.
 Completion Rules: Orders auto-complete after set timeframes if Buyers don’t respond
(3–8 days depending on order type).
 Milestones & Subscriptions: Buyers can accept milestones, continue, or stop future
ones. Gig subscriptions auto-renew unless canceled.
 Local Services: Fiverr isn’t responsible for in-person service risks—Buyers should have
proper insurance.
 Revisions & Delivery: Sellers must meet deadlines and provide correct deliverables.
Misuse of the “Deliver Work” button can lead to penalties. Buyers can request revisions
if requirements aren’t met.

6.3 Reviews

 Reviews must be from legitimate orders. Misuse, fake orders, or review manipulation
may lead to suspension.
 Sellers can’t withhold delivery to gain positive reviews.
 Reviews become public after completion and aren’t removed unless they violate
Fiverr’s Terms.
7. Fiverr Go (AI Services)

 Buyers can generate content via AI models with daily usage limits.
 AI content may not be unique; Fiverr doesn’t guarantee accuracy.
 Ownership: Buyers own the AI-generated delivery after full payment, but similar content
may be given to others.
 Buyers are responsible for ensuring legal and proper use of AI-generated content.

8. Fiverr Logo Maker

 Sellers offer original logo designs for Buyers to customize.


 Buyers get a commercial use license, but Sellers retain ownership of the base logo
design.
 Reselling logo designs is forbidden, and Fiverr may limit or remove infringing content.

9. User Conduct & Protection

 Users must communicate and exchange files only on Fiverr.


 Prohibited behaviors:
o Sharing personal contact info to bypass Fiverr
o Rude/abusive language, harassment, discrimination, or hate speech
o Fraud, phishing, spam, fake accounts, multiple accounts for abuse
o Selling or transferring Fiverr accounts
o Adult/pornographic content, unlawful services, IP violations
 Fiverr may warn, suspend, or permanently disable accounts for violations.

Disputes & Moderation

 Fiverr encourages resolving disputes via the Resolution Center; otherwise, Customer
Support can intervene.
 Fiverr may moderate content and take action if violations are found.
 Users in the EU can escalate unresolved disputes to an external settlement body, but
Fiverr isn’t bound by its decisions.

Ownership & Site Restrictions

 Fiverr owns all site content, design, and intellectual property.


 Users can’t copy, reverse-engineer, scrape, or misuse the platform’s technology.
 Feedback given to Fiverr becomes Fiverr’s exclusive property.

Confidentiality

 Sellers must keep Buyers’ information confidential, use it only for delivering services,
and not share or reproduce it without permission.
10. User Generated Content (UGC)

 UGC is content uploaded by users (buyers or sellers). Fiverr does not pre-screen it for
appropriateness, copyright, or other violations.
 Users are solely responsible for ensuring they have the legal rights to upload/use content.
 Violating content can be reported and removed.
 Fiverr is not responsible for the quality of services, even from top-rated sellers.
 Sellers must have the rights/licenses to sell services and must comply with advertising
platform rules.
 Repeat infringers may have accounts terminated.

11. Ownership

 When a buyer pays for a service, they generally get full intellectual property (IP) rights
unless otherwise stated.
 Sellers waive moral rights and transfer copyright upon full payment.
 Some services require Commercial Use Licenses for business purposes.
 Voice Over Gigs:
o Basic rights = personal, non-commercial use.
o Commercial Rights = use for business (but not paid ads).
o Full Broadcast Rights = for TV, radio, or paid internet ads.
 AI-generated content and stock media follow specific license rules.
 Fiverr may use user-generated gig content for marketing without extra payment.

12. Disclaimer of Warranties

 Fiverr provides services “as is” with no guarantees on accuracy, security, reliability, or
quality.
 No warranty is given beyond what is required by law.

13. Machine Translation

 Some content may be automatically translated (e.g., by Google).


 Automated translations aren’t guaranteed accurate. The English version is the official
legal text.

14. Limitation of Liability


 Fiverr is not liable for damages (direct, indirect, or consequential) unless required by law.
 Losses like profit, business, goodwill, or data are not Fiverr’s responsibility.

15. Account Deactivation/Disabling

 Fiverr may disable accounts for rule violations or inappropriate use.


 Disabled accounts cannot buy/sell.
 Users can deactivate their accounts but must still fulfill pending payments.

16. Security Features

 Users can enable security features for account protection.


 Fiverr may require verification of account ownership.

17. Disputes with Fiverr (U.S. Users)

 Binding arbitration is required for most disputes (not court).


 No class actions or jury trials allowed.
 Arbitration takes place under AAA rules, usually in New York.
 Small claims court may apply for very small cases.
 Users can opt out of arbitration within 30 days of agreeing to the terms.

18. General Terms

 Fiverr can change terms anytime. Using the site after changes means acceptance.
 U.S. residents are governed by New York law.
 Users agree to indemnify Fiverr against claims caused by their actions/content.
 If any part of the terms is invalid, the rest still apply.
 Fiverr can assign its rights without notice; users cannot assign theirs without Fiverr’s
consent.
 The terms form the entire agreement between users and Fiverr.
 English is the official language of the terms.
