FIRST STATUTES
UNDER SECTION 39(1) OF THE
PUDUCHERRY TECHNOLOGICAL UNIVERSITY ACT 2019

In exercise of the powers conferred by sub-section (1) of Section 39 of the Puducherry

Technological University Act, 2019 (Act No. 4 of 2020), the Government of Puducherry , after obtaining

the prior approval of the Chancellor, hereby, makes the following first Statutes of the Puducherry

Technological University, Puducherry, namely:-

Short title and commencement. 1. (1) These Statutes may be called the Puducherry

Technological University (First) Statutes, 2022;

(2) They shall come into force on and from the date of their

publication in the official Gazette of Puducherry.

Definitions. 2. (1) In these Statutes, unless the context otherwise requires,-

(a) “Act” means the Puducherry Technological

University Act, 2019 (Act No.4 of 2020);

(b) “Affiliation and Academic Enhancement

Committee” means the Affiliation and Academic

Enhancement Committee of the University;

(c) “Appointing Authority” means the authority who

appoints the employees of the University to

such grade or post, as the case may be;

(d) “Directors” means the Director of Academic and

Educational Innovations and the Director of

Planning and Development;

(e) “Dean” means the Dean of the School of

Studies, Head of the Campus Centre, Head of

the Constituent College of the University;

(f) “Inspection Committee” means the Inspection

Committee appointed by the Academic council

for inspection of colleges or institutions;

(g) “Off-Campus Centres” means a centre of the

University established and maintained by it,

outside its campus, or outside the jurisdiction of

the University;

(h) “Officers” for the purpose of this statutes means

all whole-time salaried officers specified in

Section (11) of the Act;

(i) “Ordinance” means the Ordinance as defined

under the Act;

(j) “Other Academic Staff” means the Librarian,

Deputy Librarian, Director of Physical

Education, Training and Placement personnel

and such other staff as may be decided by the

Board of Governors;

(k) “Planning Board” means the Planning Board of

the University;

(l) “Regulations” means the Regulations as

defined under the Act.

(m) “Research Committee” means the Research

Committee of the University;

(n) “Section” means a section of the Act;

(o) “Selection Committee” means the Committee

constituted by the Vice-Chancellor as and when

required for a specific purpose;

(p) “Staff” for the purpose of sub-section (14) of

Section 15 of the Act mean the teachers, other

academic staff and employees of the University;

(p) “Sub-section” means a sub-section of the Act.

(2) Words and Expressions that are used but not defined in

these Statutes and defined in the Act shall have the

same meaning as assigned to them in the Act.

The Chancellor. 3. (1) The Lieutenant Governor of the Union territory of

Puducherry shall, by virtue of his office, be the

Chancellor of the University;

(2) All the Officers of the University shall be subordinate to

the Chancellor;

(3) The Chancellor shall have the right to suspend or

remove any of the officers of the University and to take

measures for the interim administration of the University:

Provided that before taking any such action, the

Chancellor shall give an opportunity to such Officer to

show cause his case, as to why such an action should

not be taken.

(4) An appeal shall lie to the Chancellor against any order of

dismissal or any other major penalty or suspension

passed by the Board of Governors or by the

Vice-Chancellor against any teacher or other

academic staff and the appeal shall lie to the

Vice-Chancellor against any employee in the service

of the University;

(5) An appeal under sub-clause (4) shall be filed within sixty

days from the date of serving of the order on the person

concerned;

(6) The Chancellor shall, before passing any order on an

appeal under sub-clause (4), shall refer the matter for the

advice of a Committee appointed by him for the purpose.

The Pro-Chancellor. 4. (1) In the absence of the Chancellor or during his inability to

act, the Pro-Chancellor shall exercise all the powers and

perform all the functions of the Chancellor including

presiding over the convocation of the University;

(2) The Pro-Chancellor shall also exercise such powers and

perform such duties of the Chancellor as the Chancellor

may, by order, in writing delegate to the Pro-Chancellor

and such delegation may be subject to such restrictions

and conditions as may be specified in such order.

The Vice-Chancellor. 5. (1) The Vice-Chancellor shall be a person possessing the

highest level of competence, integrity, morals and

institutional commitment. The person to be appointed as

a Vice-Chancellor should be a distinguished

academician, with a minimum of ten years’ of experience

as Professor in the field of Engineering and Technology

in a University or ten years’ of experience in a reputed

research and / or academic administrative organisation

with proof of having demonstrated academic leadership;

(2) The Vice-Chancellor shall be a whole-time salaried

officer of the University;

(3) The emoluments and other terms and conditions of

service of the Vice-Chancellor shall be as follows:-

(i) The Vice-Chancellor shall be paid a monthly salary

and allowances other than House Rent Allowance

at the rates fixed by the University Grants

Commission, from time to time:

Provided that if a person in receipt of any

pension is appointed, his salary and allowances

shall be reduced by the gross amount of his

Pension prior to commutation;

(ii) The Vice-Chancellor shall be entitled to use rent

free, fully furnished residential accommodation

maintained/ provided by the University;

(iii) The Vice-Chancellor shall be entitled to use

University vehicle for official purposes. He shall

also be entitled to use a University vehicle for

private purpose for which he shall be liable to pay

charges to the University, on the conditions

prescribed by the Government of Puducherry from

time to time for use of Government vehicles for

private purposes by officers of Government of

Puducherry;

(iv) The Vice-Chancellor shall be entitled for retirement

benefits under the General Provident Fund-

Pension-Gratuity Scheme of the University:

Provided that if he has not attained the normal

age of superannuation prior to his appointment as

Vice-Chancellor and was holding a pensionable

post under the Central Government or the State

Government or the Central Autonomous Body or

the State Autonomous Body or in a Central

University or a State University, he shall be entitled

to the benefit of combining his past service with his

service as Vice-Chancellor upto the normal age of

superannuation for the purpose of pensionary

benefits, subject to the condition that his previous

employer agrees to share the liability for such

benefits;

(v) (a) The Vice-Chancellor shall be entitled to avail

leave on full pay for 30 days in a calendar year.

The leave shall be credited to his account in

advance in two half yearly installments of 15 days

each on the first day of January and the first day of

July every year:

Provided that if the Vice-Chancellor assumes or

relinquishes office during the currency of a half

year, the leave shall be credited to his

account proportionately at the rate of 2½ days for

each completed month of service.

(i) The leave at the credit of the Vice-Chancellor at

the close of half-a-year shall be carried forward

to the next half year, subject to the condition

that the total accumulation of leave at his credit

should at no time shall exceed 300 days;

(ii) At the time of relinquishing office, the

Vice-Chancellor shall be entitled to receive a

sum equivalent to the leave salary, for the

number of days for which leave on full pay is

due to him, subject to a maximum of 300 days:

Provided that the number of days for which

benefit of leave encashment has been availed

of by the Vice-Chancellor in his previous

employment shall be deducted from the ceiling

of 300 days;

(iii) The Vice-Chancellor shall be entitled to avail

leave on half pay for 20 days for each

completed year of service. The leave on half

pay may also be availed of as Commuted

Leave on full pay on medical grounds. In such a

case, twice the number of days of leave availed

of on full pay shall be debited against the leave

on half pay due;

(iv) (a) The Vice-Chancellor shall be entitled to

avail himself of extra-ordinary leave without

pay for a maximum period of 3 months during

his full term of five years on medical grounds

or otherwise;

(b) The Vice-Chancellor shall be entitled to

avail the benefits of Medical Attendance and

Leave Travel Concession as admissible to

employees of the University;

(c) The Vice-Chancellor shall be entitled to

Traveling Allowance on transfer on his

appointment as Vice-Chancellor and on

relinquishing office.

Powers & Functions of 6. (1) The Vice-Chancellor shall be the Ex-officio Chairperson

of the Vice-Chancellor. of the Academic Council, the Finance Committee, the

Planning Board and the Affiliation and Academic

Enhancement Committee;

(2) The Vice-Chancellor shall be entitled to be present and

address, any meeting of any other authority or any other

body of the University, but shall not be entitled to vote,

unless he is a member of such authority or body;

(3) The Vice-Chancellor shall exercise control over the

affairs of the University and shall give effect to the

decisions of all the authorities of the University;

(4) The Vice-Chancellor shall have all the powers necessary

for the proper maintenance of discipline in the University

and he may delegate any such power to such other

officer or officers, as he may deem fit;

(5) The Vice-Chancellor shall grant leave to officers of the

University and make necessary interim arrangements for

the discharge of the regular functions of such officer, in

his absence;

(6) The Vice-Chancellor shall grant leave of absence to any

teacher, other academic staff or employee of the

University, in accordance with the rules and, if he so

decides may delegate such power to any other officer of

the University.

The Registrar. 7. (1) The Board of Governors shall constitute a Selection

Committee for the appointment of Registrar consisting of

the following namely:-

(i) The Vice-Chancellor -- Chairperson;

(ii) A nominee of the Chancellor;

(iii) A nominee of Board of Governors;

(iv) An academician representing SC/ST/OBC/

Minority/ Women/Differently-abled categories to be

nominated by the Vice-Chancellor, if any of the

candidates from any of these categories is an

applicant and if any of the above members of the

Selection Committee does not belong to that

category;

(2) The Registrar shall be appointed by the Vice-Chancellor

with the approval of the Board of Governors on the

recommendation of the Selection Committee constituted

under sub-clause (1) and he shall be a whole-time

salaried officer of the University;

(3) The Registrar shall hold the office for a period of three

years and shall be eligible for extension for another term;

Provided that the Registrar shall retire on attaining

the age of superannuation as may be prescribed by the

UGC from time to time or on attaining the age of

superannuation in the parent post, whichever is earlier;

(4) The qualification, emoluments and other conditions of

service of a Registrar shall be such as prescribed by the

Ordinance;

(5) The Registrar shall have the power to initiate disciplinary

action against such of the employees, excluding

teachers, and other academic staff or as may be

specified by the Board of Governors;

(6) An appeal shall lie to the Vice-Chancellor against any

order made by the Registrar in pursuance of

sub-clause (5):

Provided that in such a case a second appeal shall

lie to the Board of Governors against any order of the

Vice-Chancellor imposing any penalty on an employee;

(7) The Registrar shall be:-

(i) Ex-officio Member Secretary to the Board of

Governors;

(ii) Ex-officio Member Secretary to the Academic

Council;

(iii) Secretary to the Planning Board;

(iv) Secretary to the Affiliation and Academic

Enhancement Committee;

(8) The Registrar shall furnish the copy of the minutes of

every meeting of the University to the Chancellor with the

approval of the Vice-Chancellor;

(9) When the office of the Registrar becomes vacant due to

death, resignation, ill health or otherwise, his functions

shall be performed by such other person/officer as the

Vice-Chancellor may designate for the purpose;

(10) The Registrar shall perform such other functions as may

be specified in the Act, Statutes, Ordinances or

Regulations and as may be required from time to time by

the Board of Governors or the Vice-Chancellor.

The Controller of Examinations. 8. (1) The Board of Governors shall constitute a Selection

Committee for the appointment of Controller of

Examinations consisting of the following namely:-

(i) The Vice-Chancellor – Chairperson;

(ii) A nominee of the Chancellor;

(iii) A nominee of Board of Governors;

(iv) An academician representing SC/ST /OBC

/Minority/Women/Differently-abled categories to be

nominated by the Vice Chancellor, if any of the

candidates from any of these categories is an

applicant and if any of the above members of the

Selection Committee does not belong to that

category;

(2) The Controller of Examinations shall be appointed by the

Vice-Chancellor with the approval of the Board of

Governors on the recommendation of the Selection

Committee constituted under sub-clause(1) and he shall

be a whole-time salaried officer of the University;

(3) The Controller of Examination shall be an academician in

the field of Engineering, Technology, Management and

Applied Sciences with five years of service as

Professor/Principal, appointed on such terms and

conditions as may be fixed by the Board of Governors;

(4) The Controller of Examinations shall perform such

functions as may be specified in the Act, Statutes,

Ordinances or Regulations and in addition thereto, as

may be required from time to time by the Board of

Governors or the Vice-Chancellor;

(5) The emoluments and other conditions of service of the

Controller of Examinations shall be such as prescribed

by the Ordinance;

(6) When the office of the Controller of Examinations

becomes vacant due to death, resignation, ill-health or

otherwise, his functions shall be performed by such other

person/officer as the Vice-Chancellor may designate for

the purpose.

The Finance Officer. 9. (1) The Board of Governors shall constitute a Selection

Committee for the appointment of the Finance Officer

consisting of the following namely:-

(i) The Vice-Chancellor – Chairperson;

(ii) A nominee of the Chancellor;

(iii) Accountant General of Tamil Nadu & Puducherry or

his nominee;

(iv) A nominee of Board of Governors representing SC/

ST/ OBC/ Minority/ Women/ Differently-abled

categories, if any of the candidates from any of

these categories is an applicant and if any of the

above members of the selection committee does

not belong to that category;

(2) The Finance Officer shall be appointed by the Board of

Governors on the recommendation of the Selection

Committee constituted under sub-clause(1) and he shall

be a whole-time salaried officer of the University and

shall work under the control of the Vice-Chancellor;

(3) The emoluments and other conditions of service of the

Finance Officer shall be such as prescribed by the

Ordinance;

(4) When the office of the Finance Officer falls vacant due to

death, resignation, ill-health or otherwise, his functions

shall be performed by such other person/officer as the

Vice-Chancellor may designate for the purpose;

(5) The Finance Officer shall perform such other financial

functions as may be assigned to him by the Board of

Governors or as may be prescribed by the Act, Statues

or the Ordinance;

(6) Subject to the control of the Vice-Chancellor and the

Board of Governors, the Finance Officer shall:-

(1) hold and manage the properties and investments of

the University, including Trust and immovable

properties, for fulfilling any of the objects of the

University;

(a) Funds: Income from fees, grants, donations,

gifts (if any), any contribution or grant made by

the Government (UT and Central), UGC, or like

authority, any local authority or any Corporation

owned or controlled by the Government,

endowments and other receipts;

(b) Government Grants:

(i) grants in respect of the activities of the

institutions transferred to the University

including the estimated expenditure on pay and

allowances of the staff, contingencies, supplies

and services of the University;

(ii) grants to meet such additional expenditure,

recurring and non-recurring, as the Government

may deem necessary for the proper functioning

and development of the University;

(2) ensure that the registers of properties of the

University are maintained properly and that the stock

verification is conducted for the equipments and

other materials in the offices of the University

including colleges and centres maintained by the

University;

(3) call any information or report from any office of the

University, including colleges and centres maintained

by the University, that he may consider necessary for

the performance of his functions.

Directors. 10. (1) The Directors shall be appointed by the Vice-Chancellor

with the approval of the Board of Governors generally by

seniority on rotation from among the Professors of the

University for a period of three years;

(2) The emoluments and other conditions of service of the

Directors shall be such as prescribed by the AICTE or

UGC;

(3) The Directors shall have such powers and perform such

functions in his field, as may be prescribed by the

Vice-Chancellor or as may be prescribed by the Act,

Statues or Ordinances.

Deans. 11. (1) The Dean shall be appointed by the Vice-Chancellor

generally by seniority on rotation from among the

Professors for a period of three years;

Provided that the Dean of a school of studies shall be

appointed by seniority on rotation from among the

Professors of the respective schools;

Provided further that a Dean on attaining the age of

superannuation as per the regulations of AICTE or UGC

shall cease to hold office as such;

Provided also that if at any time when there is no

Professor, then the Director or a Dean authorized by the

Vice-Chancellor in his behalf, shall exercise the powers

of the Dean;

(2) When the office of the Dean falls vacant due to death,

resignation, ill health or otherwise, his functions shall be

performed by such other person/officer as the

Vice-Chancellor may designate for the purpose;

(3) The Dean shall perform such other functions as may be

prescribed by the Statutes and Ordinance and the

Vice-Chancellor;

(4) The Dean shall have the right to be present and speak at

any meeting of the Board of Studies or Committee but

shall not have the right to vote, unless he is a member

thereof.

Head of the Department. 12. (1) The Head of the Department shall be appointed by the

Vice-Chancellor generally by seniority from among the

Professors on rotation;

(2) In the case of Departments, where there is only one

Professor, the Vice-Chancellor shall have the option to

appoint either the Professor or an Associate Professor as

the Head of the Department;

Provided that it shall be open to a Professor or

Associate Professor to decline the offer of appointment

as the Head of the Department;

(3) A person appointed as the Head of the Department shall

hold office for a period of three years and shall be eligible

for re-appointment;

(4) A Head of a Department may resign his office at any time

during his tenure of Office;

(5) A Head of a Department shall perform such functions as

may be prescribed by the Ordinance.

Librarian. 13. (1) The Librarian shall be a whole-time salaried officer

appointed by the Vice-Chancellor with the approval of the

Board of Governors on the recommendation of a

Selection Committee constituted for the purpose, as per

the regulations of AICTE or UGC, from time to time, and

shall possess such qualifications as prescribed in the

regulations of AICTE or UGC:

Provided that a Librarian on attaining the age of

superannuation shall cease to hold office as such.

(2) Every Librarian shall exercise such powers and perform

such duties as may be assigned to him by the Board of

Governors and Vice-Chancellor or as may be prescribed

by the Act, Statutes or Ordinance;

(3) The Librarian shall be eligible for the emoluments,

allowances and other terms and conditions of the

service, as per the regulations of AICTE or UGC.

Director of Physical 14. (1) The Director of Physical Education shall be a

Education. whole-time salaried officer for the University appointed

by the Vice-Chancellor with the approval of the Board of

Governors on the recommendation of a Selection

Committee constituted for the purpose as per the

regulations of AICTE or UGC, issued from time to time,

and shall possess such qualifications as prescribed in

the regulations of AICTE or UGC:

Provided that the Director of Physical Education on

attaining the age of superannuation shall cease to hold

office as such;

(2) The Director of Physical Education shall exercise such

powers and perform such duties as may be assigned to

him by the Board of Governors and the Vice-Chancellor

or as may be prescribed by the Act, Statutes or

Ordinance;

(3) The Director of Physical Education shall be in-charge of

Sports, National Service and Students’ Welfare;

(4) The Director of Physical Education shall be eligible for the

emoluments, allowances and other terms and conditions

of the service, as per the regulations of AICTE or UGC.

Board of Governors. 15. The Board of Governors shall be constituted and perform the

functions as prescribed in the Act, Statutes or Ordinances.

Powers and Functions of 16. (1) The Board of Governors shall have the power of

Board of Governors. management and administration of the revenues and

properties of the University and shall conduct all

administrative affairs of the University, not otherwise

provided for;

(2) Subject to the provisions of the Act, the Board of

Governors shall have the following powers, namely:

(i) To create Campus Centres in the campus of the

University for the conduct of the Under graduate,

Diploma and Certificate courses in Engineering,

Technology, Management and Applied Sciences;

(ii) to create teaching and other academic posts and to

define the functions and conditions of service of the

professors, Associate Professors, Assistant

Professors, other teachers and other academic

staff employed by the University after taking into

consideration of the recommendations of the

Academic Council and Finance Committee;

(iii) to prescribe qualifications and make appointments

of such Professors, Associate Professors, Assistant

Professors and such other academic staff as may

be found necessary, on the recommendations of

the Selection Committees constituted for the

purpose as per the regulations of AICTE or UGC;

(iv) to manage and regulate the finances, accounts,

investments and properties of the University;

(v) to create administrative, technical, ministerial and

other posts after taking into account the

recommendations of the Finance Committee and to

specify the manner of appointment thereto; and

(vi) to delegate any of its powers to the

Vice-Chancellor, Registrar, the Finance Officer or

any other officer, employee or authority of the

University, or to a committee appointed by it;

(3) The Board of Governors shall exercise all the powers of

the University not otherwise provided for by the Act, the

Statutes, the Ordinances and the Regulations for the

fulfillment of the objectives of the University.

Academic Council. 17. The Academic Council shall be constituted and shall perform

the functions as prescribed in the Act, Statues or Ordinances.

Powers and Functions of 18. (1) Subject to the relevant provisions of the Act, the Statutes

the Academic Council. and the Ordinances, the Academic Council shall, in

addition to all other powers vested in it by or under the

Statutes, shall have the following powers, namely:

(i) to exercise general supervision over the academic

policies of the University and to give directions

regarding methods of instruction, evaluation or

research or improvement in academic standards;

(ii) to consider matters of general academic interest

either on its own initiative or on a reference from

the Planning Board or a School of Studies or the

Board of Governors or Vice-Chancellor and to take

appropriate action thereon; and

(iii) to frame such regulations as are consistent with the

Statutes and the Ordinances regarding the

academic functioning of the University, including

discipline, admissions, award of fellowships

and studentships, fees and other academic

requirements.

Finance Committee. 19. (1) The Finance Committee shall be constituted as

prescribed in the Act;

(b) All the members of the Finance Committee other than

Ex-officio Members shall hold office for a term of three

years, from the date of nomination;

(3) All proposals relating to revision of grades, up-gradation

of the pay-scales and those items which are not included

in the budget, shall be examined by the Finance

Committee, before they are being considered by the

Board of Governors;

(4) The Annual Accounts and the Financial Estimates of the

University prepared by the Finance Officer shall be laid

before the Finance Committee for approval and

thereafter submitted to the Board of Governors within the

overall ceiling fixed by the Committee;

(5) The Finance Committee shall fix the limits for the total

recurring and non-recurring expenditure for the year,

based on the income and resources of the University,

and no expenditure shall be incurred by the University in

excess of the limits so fixed, without the approval of the

Finance Committee.

Planning Board. 20. (1) The Planning Board shall consist of the following
members, namely:-
(i) The Vice-Chancellor ... Chairperson;

(ii) The Director of Higher & Technical Education,

Government of Puducherry;

(iii) The Director of Planning and Development of the

University;

(iv) Senior most Dean of the University;

(v) The Deans of the Constituent Colleges;

(vi) The Finance Officer;

(vii) One nominee of the Chancellor;

(viii) Two members of the Academic Council nominated

by the Vice-Chancellor;

(ix) Two officers of the University nominated by the

Vice-Chancellor;

(x) Two Professors of the University nominated by the

Vice-Chancellor;

(2) The Registrar shall be the Member Secretary of the

Planning Board and shall convene the meetings of the

Planning Board in consultation with the Vice-Chancellor;

(3) All the members of the Planning Board, other than the

Ex-officio Members, shall hold the office for a term of

three years, from the date of nomination;

(4) The Planning Board shall constitute such committees as

may be found necessary for planning and monitoring the

programmes of the University;

(5) The Planning Board shall meet at such intervals as it

deems expedient, but it shall meet at least twice in a

year;

(6) One half of the Members of the Planning Board shall

form the quorum for a meeting of the Planning Board;

Powers & Functions of the 21 (1) The Planning Board shall be the principal planning body

of Planning Board reviewing the educational programmes offered by the

University;

(i) organizing the structure of education in the

University so as to provide opportunities to students

to study different combinations of subjects,

appropriate for their development of personality and

skills, for useful work in the society;

(ii) creating an atmosphere and environment

conducive to value-oriented education; and

(iii) developing new teaching-learning processes which

will combine the lectures, tutorials, seminars,

demonstrations, self-studies and collective practical

projects.

(2) The Planning Board shall have the power to advise on

the development of the University and review the

progress of implementation of programmes, so as to

ascertain whether, they are on the lines recommended

by it and shall also have the power to advise the Board of

Governors and the Academic Council, on any matter in

connection therewith;

(3) The Board of Governors and Academic Council shall be

bound to consider the recommendations made by the

Planning Board and shall implement such of the

recommendations as are accepted by it;

(4) Such of those recommendations of the Planning Board

as have not been accepted by the Board of Governors or

the Academic Council, shall be submitted by the

Vice-Chancellor, along with the recommendations of the

Board of Governors or the Academic Council to the

Pro-Chancellor for decision and the decision of the

Pro-Chancellor shall be implemented by the Board of

Governors or the Academic Council, as the case may be.

Research Committee. 22. (1) The Research Committee shall consist of the following

members, namely:-

(i) The Director of Academic and Educational

Innovations -- Chairperson;

(ii) Controller of Examinations;

(iii) Two Deans of Schools of the University;

(iv) One Professors of the University nominated by the

Vice-Chancellor;

(v) One Professor from any Technological

University/National Institutes nominated by the

Vice-Chancellor;

(2) The Controller of Examinations shall be the Member

Secretary of the Research Committee and he shall

convene the meetings of the Research Committee after

consultation with the Vice-Chancellor;

(3) Four members of the Research Committee shall form a

quorum for a meeting of the Committee;

(4) All the members of the Research Committee, other than

the Ex-officio Members, shall hold the office for a term of

three years from the date of nomination;

(5) The Research Committee shall exercise such powers

and perform such duties as prescribed in the Ordinance

and assigned by the Board of Governors.

Boards of Studies. 23. (1) The composition of Boards of Studies, functions and the

term of office of its members shall be as prescribed in the

Ordinance;

(2) All members of the Boards of Studies other than

Ex-officio Members shall hold office for a term of three

years, from the date of nomination;

(3) Each Faculty of Teaching shall advise on academic

matters of the Department or School, as the case may be

including matters relating to formulation of curriculum

and its regular update;

(4) The functions of Boards of Studies shall be to approve

subjects and curriculum for various Degrees, Diplomas

and Certificates based on the regulations of AICTE or

UGC prescribed from time to time and to recommend to

the concerned, in the manner prescribed in the

Ordinance:-

(i) courses of studies and appointment of Examiners

for various courses; and

(ii) measures for further improvement of the standard

of teaching at Post-graduate, undergraduate,

Diploma and Certificate level:

Provided that the above functions of a Board of

Studies shall, immediately after the commencement

of the Act, be performed by the Department;

(5) The Boards of Studies constituted by the Pondicherry

Engineering College before the commencement of the

Act shall be deemed to be the Boards of Studies, until

the Boards of Studies are constituted under the Act and

Statutes.

Affiliation and Academic 24. (1) The Affiliation and Academic Enhancement Committee

Enhancement Committee. shall consist of the following members, namely:-

(i) The Vice-Chancellor -- Chairperson;

(ii) The Director of Academic and Educational

Innovations;

(iii) The Director of Higher & Technical Education,

Government of Puducherry;

(iv) One nominee of the Board of Governors;

(v) One nominee of the Academic Council;

(vi) One of the Deans nominated by the

Vice-Chancellor;

(vii) Two Professors of the University nominated by the

Vice-Chancellor.

(2) The Registrar shall be the Member Secretary of the

Affiliation and Academic Enhancement Committee;

(3) A member of the Affiliation and Academic Enhancement

Committee other than the Ex-officio Members shall hold

office for a term of three years from the date of

nomination;

(4) Four members of the Affiliation and Academic

Enhancement Committee shall form a quorum for a

meeting of the Board;

(5) The procedure for considering proposals for affiliation

shall be as specified in the Ordinance.

The Selection Committee. 25. (1) There shall be a Selection Committee constituted for

making recommendations to the Board of Governors for

appointment to the posts of teachers, and other

academic staff of the University;

(2) The Selection Committee for appointment to the posts

specified in sub-clause (1) shall consist of the members

specified in the regulations of AICTE or UGC issued from

time to time;

(3) If the Board of Governors is not able to accept the

recommendations made by the Selection Committee,

shall record its reasons and submit to the Chancellor for

final orders;

(4) The Selection Committee appointed for various

categories of posts of employees, other than the

teachers and other academic staff, shall invariably

consist of the following members, namely:-

(i) The Director of Academic and Educational

Innovations of the University;

(ii) The Registrar of the University;

(iii) Senior-most Dean of the University;

(iv) A nominee of the Vice-Chancellor for each of the

category representing SC/ST/OBC /Minority/

Women / Differently-abled categories, if any of the

candidates from these categories is an applicant;

(v) One-third members shall form the quorum for the

meeting of the Selection Committee;

(vi) The procedures to be followed by the Selection

committee constituted under sub-clause (4) shall be

as laid down in the Ordinance.

(5) The Registrar shall appoint the employees below trhe

rank of Deputy Registrar based on the recommendations

of the Selection Committee constituted under sub-clause

(4) above with the approval of the Vice-Chancellor;

(6) Appointment to temporary posts shall be made by the

Vice-Chancellor in the manner indicated below:-

Any temporary vacancy that exists for a period of

less than a year shall be filled on the advice of the

Selection Committee consisting of the Dean of the

School concerned, the Head of the Department and

a nominee of Vice-Chancellor, in accordance with

the procedure indicated in the foregoing

sub-clauses:

Provided that the Vice-Chancellor is satisfied

with the requirement to fill the vacancy, the

appointment shall be made purely on temporary

basis based on the recommendation of the

Selection Committee for a period not exceeding

one year;

Provided that any of the member holds the

office of the Dean and also the Head of the

Department, the Selection Committee shall have

two nominees of the Vice-Chancellor.

Building and Works Committee 26. (1) The Building and Works Committee consists of the

following members:-

(i) The Vice-Chancellor - Chairperson;

(ii) The Director of Academic and Educational

Innovations;

(iii) The Registrar;

(iv) The Finance Officer;

(v) The Chief Engineer, PWD, Government of

Puducherry;

(vi) The Executive Engineer of the University;

(vii) Four Professors from the department of Civil,

Electrical, Electronics and Computer Science

nominated by the Vice-Chancellor;

(viii) A nominee of the Chief Town Planner, Government

of Puducherry;

(2) Five members shall form a quorum for a meeting of the

Committee;

(3) All the members of the Committee, other than the

Ex-officio Members, shall hold the office for a term of

three years, from the date of nomination;

(4) The Building and Works Committee shall exercise such

powers and perform such duties as prescribed in the

Ordinance and assigned by the Board of Governors.

Schools of Studies. 27. (1) The University shall have such Schools of Studies as

may be specified in the Ordinances;

(2) Each School of Studies shall be headed by a Dean as

prescribed in the Act and Statutes;

(3) The composition and functions of the Schools of Studies

and other related matters shall be as specified in the

Ordinance;

(4) Every School shall have a Board of School. Each Board

of School shall consist of the following members, who

shall hold office for a period of three years:

(i) The Dean of the School -- Chairperson;

(ii) Heads of Department in the School;

(iii) All Professors of the School;

(iv) One Associate Professor and one Assistant

Professor from each of the Departments by rotation

according to seniority;

(v) One representative from each of the Board of other

schools, which have inter-disciplinary work with the

School, to be nominated by the Vice-Chancellor;

(vi) Atleast one expert for each subject / department

from outside, who are not employees of the

University or any of its affiliated colleges /

institutions to be nominated by the Vice-Chancellor;

(5) The powers and functions of the Board of School shall be

as prescribed by the Ordinances;

(6) The conduct of the meetings of a Board of School and

the quorum required for such meetings shall be as

prescribed by the Ordinances.

Campus Centres. 28. The undergraduate courses of the University shall be

conducted in the Campus Centres established within the

campus of the University.

Special mode of appointment. 29. (1) Notwithstanding anything contained in the Act and the

Statutes, the Board of Governors may invite a person of

high academic distinction and professional attainment to

accept the post of a professor or any other equivalent

academic post in the University, on such terms and

conditions as it may deem fit, and appoint the person to

such post, as per the regulations of AICTE or UGC;

(2) The Board of Governors may appoint any member of the

teacher or other academic staff working in any other

University or organisation on a teaching assignment or

for undertaking a project or any other work on such terms

and conditions, as may be determined by the Board of

Governors in accordance with the manner specified by

the Statutes.

Constitution of Funds. 30. The Constitution of provident funds, pension, insurance,

gratuity and other benefits of the teachers, other academic

staff and employees shall be as prescribed in the Ordinances.

Leave rules for teachers other 31. The leave rules for the teachers, other academic staff and

academic staff and employees. employees of the University shall be as per the regulations of

the AICTE or UGC or Government of Puducherry, as

applicable to their respective catergory, issued from time to

time.

Terms and conditions of 32. (1) All the teachers and other academic staff of the

service and code of University shall, in the absence of any contract to the

conduct of the teachers contrary be governed by the terms and conditions of

and other academic staff service and code of conduct as specified in the

of the University. Ordinances:

Provided that the qualifications and other conditions

of eligibility shall be as prescribed by AICTE or UGC;

. Provided further that till such time the Ordinances are

notified, they shall be governed by the rules and

regulations applicable to Government service or their

previous service;

(2) Any temporary teacher or member of the other academic

staff shall be appointed on a written contract;

(3) A copy of every contract referred to in sub-clause (2)

shall be deposited with the Registrar.

Terms and conditions of 33. (1) All the employees of the University other than the

the service and code of teachers and other academic staff shall, in the conduct

for employees absence of any contract to the contrary, be governed by

of the University. the terms and conditions of service and the code of

conduct as specified in the Statues and the Ordinance:

Provided that till such time the Ordinances are

notified, they shall be governed by the rules and

regulations applicable to Government service or their

previous service;

Provided further that for maintaining efficiency in

administration, officers holding analogous posts in the

Government of Puducherry shall be drawn on deputation

basis, whenever necessary, to the post entrusted with the

similar duties, relating to service / administrative matters, so

as to make suitable selection from wider source.

Removal of teachers, other 34. (1) When there is an allegation of serious misconduct

academic staff and employees against a teacher or a member of other academic staff or

of the University. any employees of the University, the Vice-Chancellor

may in the case of teacher or other academic staff and

the appointing authority competent to appoint in the case

of any employees, as the case may be, by order in

writing, place such teacher, member of other academic

staff or employees, under suspension and shall forthwith

report to the Board of Governors the circumstance on

which the said order was made;

(2) Notwithstanding anything contained in the terms of the

contract of appointment or in any other terms and

conditions of service of the employee, the Board of

Governors in respect of teachers and other academic

staff, and the appointing authority, in respect of

employees, as the case may be, shall have the power to

remove on grounds of misconduct;

(3) No teacher, other academic staff or employee shall be

removed under sub-clause (2) unless he has been given

a reasonable opportunity of showing cause against the

action proposed to be taken against him;

(4) The removal of a teacher, other academic staff or

employee shall take effect from the date on which the

order of removal is made and the procedure for appeal

shall be as prescribed in the Ordinances;

(5) Notwithstanding anything contained in the foregoing

provisions of this Statute, a teacher, a member of other

academic staff or employee may resign:–

(i) if he is a permanent staff, only after giving three

months’ notice in writing to the Board of Governors

or the appointing authority, as the case may be, or

by paying three months’ salary in lieu thereof; or

(ii) if temporary / contractual staff, only after giving one

month’s notice in writing to the Board of Governors

or the appointing authority, as the case may be, or

by paying one month’s salary in lieu thereof:

Provided that such resignation shall take effect

only from the date on which the resignation is

accepted by the Board of Governors, or the

appointing authority, as the case may be;

Provided further that the sub-clause (5) shall

not apply to persons against whom, disciplinary

proceeding is pending or contemplated.

Maintenance of discipline 35. (1) The powers regarding maintenance of discipline and

among the students. initiation of disciplinary action with regard to the students

of the University shall vest with the Vice-Chancellor, who

may delegate all or any of his powers to any officer, as

he may deem fit;

(2) Without prejudice to the generality of his powers relating

to the maintenance of discipline and initiating such action

as he may deem fit and appropriate for the maintenance

of discipline, the Vice-Chancellor may, in exercise of his

powers, by order, direct that any student or students be

expelled or rusticated for a specified period and not

admitted to a course or courses of study in the University

or an affiliated college or institution for a stated period or

be punished with a fine for an amount to be specified in

the order, or debarred from any examination or

examinations conducted by the University or an affiliated

college or institution for one or more years or that the

result of the student or students concerned in the

examination or examinations in which he has or they

have appeared, to be withheld or cancelled. The

procedure for appeal to the Board of Governors shall be

as prescribed in the Ordinances;

(3) The Heads of campus centres, constituent colleges,

affiliated colleges and institutions shall have the authority

to exercise all such disciplinary powers, over the

students in their respective colleges and institutions as

may be found necessary for the proper, smooth and

efficient functioning of such colleges and institutions.

Seniority list. 36. (1) Whenever, in accordance with the Statutes, any person

is to hold an office or be a member of an authority of the

University, the seniority shall be determined as per the

regulation of AICTE or UGC and in accordance with such

other principles, as the Board of Governors may, from

time to time, prescribe;

(2) It shall be the duty of the Registrar to prepare and

maintain, in respect of each cadre/class of

officials/persons, to whom the provisions of the Statutes

apply, a complete and upto date seniority list, in

accordance with the provisions of sub-clause (1);

(3) Any other matter relating to seniority, other than specified

in sub-clause (1) and (2) the Registrar may, on his own

motion shall submit the matter to the Board of

Governors, whose decision thereon shall be final.

Other provisions in respect of 37 (1) The Vice-Chancellor shall exercise all the powers of the

transfer from erstwhile erstwhile Principal, Pondicherry Engineering College and

Pondicherry Engineering College Colleges mentioned in the Schedule-I of the Act and in

and Constituent colleges respect of all the employees of the erstwhile Pondicherry

Engineering College and Colleges mentioned in the

Schedule-I of the Act;

(2) Until the University is able to make specific Statues or

Ordinance or Regulations on this subject, general

regulations or procedures applicable to the then

Pondicherry Engineering College and Colleges

mentioned in the Schedule-I of the Act shall continue to

apply to these employees.

Honorary Degree . 38. (1) The Board of Governors may, on the recommendation of

the Academic Council and by a resolution passed by a

majority of not less than two-third of the members

present and vote, shall make proposals to the Chancellor

for the conferment of honorary degrees of achievements:

Provided that in case of emergency, the Board of

Governors may, on its own, make such proposals;

(2) The Board of Governors may, by a resolution passed by

a majority of not less than two-third of the members

present and vote, shall withdraw, with the prior approval

of the Chancellor, any honorary degree conferred by the

University.

Withdrawal of degree 39. (1) The Board of Governors may, by a special resolution

passed by a majority of not less than two-third of the

members present and vote, shall withdraw any degree or

academic distinction conferred on or any certificate or

diploma granted to, any person by the University for

good and sufficient cause:

Provided that no such resolution shall be passed until

a notice in writing has been served on the concerned

person calling upon him to show cause within such time,

as may be specified in the notice, why such a resolution

should not be passed and until his objections, if any, and

any evidence he may produce in support, has been

considered by the Board of Governors.

Admission of Colleges 40. (1) Upcoming Colleges, Polytechnic Colleges and other

to the privileges of the institutions situated within the jurisdiction of the

University University may be admitted to such privileges of the

University as the Board of Governors may decide, on the

following conditions, namely;

(i) Every such College or Polytechnic College or other

Institution shall have a regularly constituted

Governing Body, consisting of not more than fifteen

persons approved by the Board of Governors and

including among others, two teachers of the

University to be nominated by the Board of

Governors and three representatives of the

teaching staff of whom the Principal of the College

or Institution shall be one. The procedure for

appointment of members of the Governing Body

and other matters affecting the management of a

College or an Institution shall be as prescribed by

the Ordinances;

(ii) Every such College or Polytechnic College or other

Institution shall satisfy the Board of Governors as

per the regulations of the University in force and

changes effected from time to time, on the following

matters, namely:-

(a) the suitability and adequacy of Its

accommodation and equipment for teaching;

(b) the qualifications and adequacy of its

teaching staff and the conditions of their

service;

(c) the arrangements for the residence, welfare,

discipline and supervision of students;

(d) the adequacy of financial provision made for

the continued maintenance of the College or

Institution; and

(e) such other matters as are essential for the

maintenance of the standards of University

education.

(iii) No College or Polytechnic College or other

Institution shall be admitted to any privileges of the

University except on the recommendation of the

Academic Council made after considering the

report of a Committee of Inspection appointed for

the said purpose;

(iv) Colleges, Polytechnic College and other Institutions

desirous of admission to any privileges of the

University shall be required to intimate their

intention to do so in writing, so as to reach the

Registrar not later 31st October, preceding the year,

for which the permission is applied for its

consideration;

(v) A College or a Polytechnic College or an other

Institution shall not without the prior permission of

the Board of Governors and the Academic Council

suspend instruction in any subject or course of

study, which it is authorized to teach or teaches.

(2) Appointment of the teaching staff and other academic

staff of Colleges or Polytechnic Colleges or Institutions

admitted to the privileges of the University shall be made

as per the regulations of AICTE or UGC:

Provided that nothing in this sub-clause shall apply to

Colleges and Institutions owned or maintained by the

Government;

(3) The service conditions of the employees of every

College or Institution referred to in sub-clause (2) shall

be such as may be laid down in the Ordinances:

Provided that nothing in this sub-clause shall apply to

Colleges, Polytechnic Colleges and Institutions owned

and/or maintained by the Government.

(4) Every College or Polytechnic Colleges or Institution

admitted to the privileges of the University shall be

inspected at least once in every two academic years by

the Inspection Committee appointed by the Academic

Council, and the report of that Committee shall be

submitted to the Academic Council, which shall forward

the same to the Board of Governors with such

recommendations as it may deem fit. The Board of

Governors after considering the report and the

recommendations, if any, of the Academic Council shall

forward a copy of the report to the Governing Body of the

College or Polytechnic Colleges or Institution with such

remarks, if any, as it may deem fit for appropriate action;

(5) The Board of Governors may, after consulting the

Academic Council, shall withdraw any privileges granted

to a College or Institution, at any time, if it considers that

the College or Institution does not satisfy any of the

conditions, on the fulfillment of which the College or

Polytechnic Colleges or Institution was admitted to such

privileges initially;

Provided that before any privileges are so withdrawn,

the Governing Body of the College or Polytechnic

Colleges or institution concerned shall be given an

opportunity to represent to the Board of Governors why

such action should not be taken;

(6) Subject to the conditions set forth in sub-clause (1), the

Ordinances may prescribe, -

(i) such other conditions as may be considered

necessary;

(ii) the procedure for the admission of Colleges and

Polytechnic Colleges or Institutions to the privileges

of the University and for the withdrawal of those

privileges.

Convocation 41. Convocations of the University for the conferring of degrees or

for other purpose shall be held in such manner as may be

prescribed by the Ordinances.

Resignation 42. Any member other than an Ex-officio member of the Academic

Council or any other authority of the University or any

Committee of such authority may resign by a letter addressed

to the Registrar and the resignation shall take effect as soon

as such letter is received by the Registrar.

Disqualification 43. (1) A person shall be disqualified from being chosen as, and

from being a member of any of the authorities of the

University;

(i) if he is of unsound mind;

(ii) if he is an un-discharged insolvent;

(iii) if he has been convicted by a court of law of an

offence involving moral turpitude and sentenced in

respect thereof to imprisonment for not less than

six months.

(2) If any question arises as to whether a person is or had

been subjected to any of the disqualifications mentioned

in sub-clause (1), the question shall be referred for the

decision of the Chancellor and his decision shall be the

final and no suit or other proceeding shall lie in any civil

court against such decision.

Residence condition for 44. Notwithstanding anything contained in the Statutes, no person

membership and office. who is not ordinarily a resident of India shall be eligible to be

an officer of the University or a member of any authority of the

University.

Membership authorities by 45. Notwithstanding anything contained in the Statutes, a person

virtue of membership of who holds any post in the University or is a member of any

other bodies. authority or body of the University in his capacity as a member

of a particular authority or body or as the holder of a particular

appointment shall hold such office or membership as long as

he continues to be a member of that particular authority or

body or the holder of that particular appointment, as the case

may be.

Alumni Association 46. (1) There shall be an Alumni Association for the University;

(2) The subscription for membership of the Alumni

Association shall be prescribed by the Ordinances;

(3) No member of the Alumni Association shall be entitled to

vote or stand for election unless he has been a member

of the Association for atleast one year prior to the date of

election and, is a graduate of the University of at least

five years standing;

Provided that the condition relating to the completion

of one year's membership shall not apply in the case of

the first election.

The Students’ Council 47. (1) The office bearers of the Students’ Council shall be

election procedure and elected based on the guidelines as prescribed by the

functions. Ordinances;

Provided that any student of the University shall have

the right to bring up any matter concerning the University

before the Students’ Council if so permitted by the

Chairperson, and he shall have the right to participate in

the discussions at any meeting when the matter is taken

up for consideration;

(2) The functions of the Students' Council shall be to make

suggestions to the appropriate authorities of the

University with regard to the programme of studies,

students' welfare and other matters of importance, with

regard to the working of the University in general and

such suggestions shall be made on the basis of

consensus of opinion;

(3) The Students' Council shall meet at least thrice in an

academic year preferably in the month of July, October

and January of that academic year.

Delegation of Powers 48. Subject to the provisions of the Act and the Statutes, any

officer or authority of the University may delegate all or any of

his or its powers to any other officer or authority or person

under his or its administrative control and subject to the

condition that the overall responsibility for the exercise of the

powers so delegated shall continue to be vested with the

officer or authority delegating such powers.
