COMPLAINT-AFFIDAVIT

I, RACHEAL B. SANTOS, of legal age, married and with resident


address at Brgy. 16 Ilawod, Rizal St. Legazpi City, Albay, after having
duly sworn in accordance with law hereby depose and state that:

1. I am the plaintiff in a complaint for small claims for collection of


sum of money amounting to SIX HUNDRED THOUSAND PESOS
(Php 600,000.00) against CRISTINE MAE P. UY
JOCELYN CENETA who is a
resident of Brgy. San Roque, Tabaco City, Albay, herein referred to
as Defendant;

2. That in September 5, 2019, the DEFENDANT, in order to handle


the expenses and processing fee of her working VISA in Taiwan,
which she alleged that in three months period will be approved,
entered into a CONTRACT OF LOAN with me amounting to
Php300,000.00, with an annual interest rate of 10% payable within
5 years;

3. That included in the CONTRACT OF LOAN is the agreement that


she will pay the annual interest amounting to Php30,000.00 every
September of the year and to pay the full amount of Php300,000.00
on or before September 5, 2024;

4. That on November 17, 2019, the DEFENDANT, went back to me,
begging to let her loan another Php300,000.00, as the money she
initially loaned was used for the improvement of their house;

5. That being a friend to her, I agreed and added the Php300,000.00


to her existing loan, which subsequently amended the previous
loan for a total amount of Php600,000.00, with an annual interest
rate of 10% and that she will pay Php60,000.00 every November of
the year and to pay the full amount of Php600,000.00 on or before
November 17, 2024;

6. That from November 17, 2020 onwards, I notified the DEFENDANT


several times and demanded her to pay the annual interest fee of
her loan;

7. That on December 4, 2020, I checked the DEFENDANT’s Facebook


and saw her posted pictures with captions “ATM: LIVING LIFE TO
THE FULLEST IN BAGUIO CITY”, “ATM: A TRAVELLER AND
WANDERER IN TAGAYTAY”, “ATM: ENJOYING THE NIGHT IN THE
CITY OF LIGHTS” and so forth;

8. That I presumed that the money loaned in favor of the


DEFENDANT, was not actually for the improvement of their house
and expenses/processing fee of her WORKING VISA as according to
her Facebook posts the latter was still in the Philippines travelling;

9. That the DEFENDANT, never responded to my messages and calls


thru SMS and Facebook Messenger and intentionally ignores such
demands;

10. That on February 2, 2021, I went to their Barangay Hall to put


into record regarding the money claim against the DEFENDANT,
and to summon her to settle the loaned amount;

11. That according to the Punong Barangay of San Roque, Tabaco


City, the DEFENDANT, after numerous attempt of the Barangay
Police to look for her in her residence, was nowhere to be found;

12. That after several demands of payment against the DEFENDANT,


the latter failed to comply with her obligations;

13. That my lending business and relationship with my husband was


affected by the said loan of the DEFENDANT;

A copy of the new Contract of Loan dated 17 November 2019 as Annex “A”, the screenshots
of her Facebook posts as Annex “B”, our conversations in SMS and FB messenger, call
records as Annex “C”, and a certified true copy of the Barangay Blotter signed by the
Punong Barangay is hereunto attached and forms an integral part hereof as Annex “D”.

14. That having no other options left, I decided to file this Complaint-
Affidavit before the proper court in Legazpi City, in order to compel
the DEFENDANT to pay the amount of SIX HUNDRED
THOUSAND PESOS (Php600,000.00) plus legal interest thereon;
and

15. I am executing this Complaint-Affidavit to attest to the


truthfulness and veracity of the foregoing statements based on my
personal knowledge and/or based on authentic documents.

Rizal St. Legazpi City, Albay, on oath, state:

1. That I am the AFFIANT in the above-entitled case have caused this affidavit to be
prepared; that I read and understood its contents which are true and correct of my own
personal knowledge and/or based on true records;

2. That I have not commenced any action or proceeding involving the same issue or
subject matter, and specifically the same check/s in the Supreme Court, the Court of
Appeals or any other tribunal or agency, particularly before the Office of the City
Prosecutor of Legazpi City; that to the best of my knowledge, no such action or proceeding
is pending in the Supreme Court, the Court of Appeals or any other tribunal or agency,
and that, if I should learn thereafter that a similar action or proceeding has been filed or
is pending before these courts or tribunal or agency, I undertake to report that fact to the
Court within five (5) days therefrom.

3. That the filing of this case is not in violation of the rule against splitting a single cause
of action or multiplicity of suits.

4. That I knowingly and voluntarily waive and forego the institution of any action for
money claim against the defendant herein based on the same check/s subject matter of
this Small Claims Complaint.
