APPLICATION UNDER SECTION 478 OF THE BHARATIYA


NAGARIK SURAKSHA SANHITA 2023

The accused begs to submit as follows:-

1. The accused submit that the complainant police have registered a


case against the accused for the alleged offences punishable
under sections 115(2), 126(2), 351(2), 352 of Bharatiya Nyaya
Sanhita 2023.

2. The accused state that they are innocent about the charges
levelled against them by the complainant police and that they
have been falsely implicated.

3. The accused states that the alleged offences are bailable in nature
and does not warrant any extreme penalties like life imprisonment
or death sentence and they have valid and tenable defense.
4. The accused state that the complainant police are frequently
visiting the house of the accused and threatening the inmates.

5. The accused state that they hail from a respectable family and
have strong and deep roots in the society.

6. It is stated that the accused shall furnish valid and solvent surety
to the utmost satisfaction of the Hon’ble court in the event of their
enlargement on regular court bail in the above matter.

7. The accused under take to cooperate with the investigating officer


and also undertake to be regular and punctual in attending the
court as and when directed to do so by this Hon’ble court.

8. The accused under take not to flee from justice.

9. The accused under take to abide by any conditions that may be


imposed by this Hon’ble court in the event of their release on
regular court bail in the above matter.

WHEREFORE the accused most humbly pray that this Hon’ble


court may be pleased to grant regular court bail to the accused
persons in the above case in the interest of justice.

No: 24/5, measuring 0.15.00.00 guntas, situated at Ammane
Bellendur Kane village, Varthur Hobli, Bangalore east taluk I submit
that the value of the said property is Rs. 50,00,000/- (rupees fifty
lakhs only) and I am solvent.

3. That I have not stood as a surety to any person in any other case
so far.

4. That I am ready and willing to stand as a surety for the accused in


the present matter and the particulars furnished in this surety
affidavit are all true and correct to the best of my knowledge,
information, and belief.

5. That I undertake to produce the accused before the court as and


when required and fulfil all the obligations as a surety.
