1. The Floods of 2014: Crisis Governance,

State Capacities and Political Regimes in
Bosnia and Herzegovina, Serbia and Croatia

This introductory chapter considers the different political systems in Bosnia and Her-
zegovina (BiH), Serbia and Croatia and tries to capture theoretically the relationship
between crisis management, the art of leadership and governance. It also seeks to
draw conclusions about state capacity through the lenses of crisis governance. Finally,
it looks at the relationship between the specific response to the crisis and the process
of learning at individual and institutional levels in democratic and nondemocratic
regimes. We argue in this chapter and throughout the whole volume that the ways
in which countries deal with major crises reveal much about their state capacity and
about the fundamental character of their regimes.

Introduction

The floods in May 2014 in Croatia, Serbia and Bosnia and Herzegovina
have been termed the most devastating event since the wars. Despite this
landmark occurrence, the causes of the disproportionate damage, the
apparent lack of preparedness or efficiency of the main institutions and
individuals in charge have not attracted much academic attention. This
volume attempts to fill in this gap and explore central tenets of crisis
governance in the three countries under study.1
1 This book is the final result of a 2-year research project, Governing the Floods in
the Western Balkans, financed by the Regional Research Promotion Programme
(RRPP) at the University of Fribourg in Switzerland. The project brought together
eight research teams from Bosnia and Herzegovina, Serbia and Croatia. The scholars
represented different disciplines and were therefore interested in different aspects of
crisis governance during the floods in May 2014. Their research evolved gradually

in the former Yugoslavia and the fact that they were severely affected by
the wars of the 1990s. The point of departure for the transition towards
democracy for all three countries was marked by the end of the war in
Bosnia in 1995 but, more fundamentally, by the death of Franjo Tuđman
in Croatia in 1999 and the so-called “Serbian October revolution” in 2000,
when Slobodan Milošević was overthrown. The sudden changes in Croatia
and Serbia were accompanied by the emerging perspective of EU integra-
tion for the Western Balkans in 1999 and 2000.
Following the years from 2000 until the financial crisis of 2007–2012,
which hit the Balkans particularly hard, democratization efforts translated
into reform programs and agendas aiming to strengthen democratic insti-
tutions, the rule of law and the economy in the region. There were also
signs of democratic convergence and of the rather linear transitional path
previously traced in the majority of countries in Central and Northeastern
Europe that entered the EU in 2004. However, the economic crisis revealed
the weaknesses of institutions and democratic governance in the region. In
Bosnia the new economic and social downturn in the late 2000s had a very
negative impact on the political climate in the country. Already strong
ethnonationalism became even more pronounced, leading to a situation
where major political parties and their leaders in the country emphasized
symbolic politics rather than reforms and incremental societal changes.
Serbia was also hit hard by the economic crisis, leading to an increase in
unemployment, reduced economic growth and rising public debt and trade
deficit. Parallel to the economic crisis, Serbia at that time found itself in
a very painful process of dealing with the Kosovo issue (Kosovo became
independent in February 2008), so the economic downturn went hand in
hand with very emotional public discourse on Kosovo, which resulted in
democratic reforms slowing down.

Stimulated by the negative impact of the economic crisis but primar-

ily due to internal political circumstances (the weakness of the rule of
law, strong nationalism in both countries and a deeply dysfunctional state
administration), both Bosnia and Serbia slipped back towards the process
of “dedemocratization” (Tilly, 2007) and, to an extent, democratic regres-
sion. As some authors argue, both countries entered a phase of “democ-
racy fatigue” in which democracy was not the only game in town (Ćurak,
2016).
In 2012, the Freedom House report detected a new “fragile frontier”
for democracy on the European periphery. Its 2013 report concluded that
countries in the Balkans entered a phase of “authoritarian regression”
and experienced “the pressures of austerity” (Freedom House, 2012 and
2013). The evaluation of political developments at that time, particularly
in Southeastern Europe, reads very negatively:
Stagnation and decline have … become apparent in the parts of Southeastern Europe
that lie outside the EU. Albania, Bosnia and Herzegovina, Croatia, Kosovo, and Mac-
edonia have all suffered decline in national democratic governance over the past five
years, driven in part by the overlap between business and political interests and the
nagging problem of organized crime. (Freedom House, 2012, pp. 2–3)

Croatia, despite all its problems, managed to stay on a pragmatic EU

course by sticking to reforms and asking for help and support from the EU
and countries like Italy, Austria or Germany. It was mainly due to its con-
sistent efforts to professionalize public administration and to stay firmly
on the “reform path” even in difficult times (in the late 2000s Slovenia
blocked Croatia’s negotiations with the EU due to bilateral disputes) that
Croatia managed to fulfil all the requirements for the membership. Despite
weaknesses in the judicial system, corruption and economic development
that was problematic overall, there was a clear political will on the side
of the EU to accept Croatia as the 28th member state. This EU internal
“window of opportunity” was used and Croatia joined in 2013, whereas
Serbia and even more Bosnia are still in the process of EU integration –
and the outcome of the process remains uncertain.
When it comes to the assessment of democratic development or the
quality of democratic reforms in these three countries, Bosnia, in the last
few years, has significantly lagged behind Croatia and Serbia. According
to the Economist Intelligence Unit, with a score of 4.87 (on a scale ranging
from 0 to 10, 10 being the best score) in 2016, Bosnia belongs to the group

of hybrid regimes. Croatia and Serbia score better (Serbia’s score is 6.57;
Croatia scores 6.75). The weak performance of Bosnia can be explained
by specific aspects of its postwar development (a dysfunctional state struc-
ture based on the Dayton Peace Agreement from 1995 and the Dayton
constitution) and the permanent political impasse in the country caused
by predominantly ethnic political parties for Croats, Serbs and Bosniaks.
On the other hand, the rather ethnically homogenous Croatia and Serbia,
which were involved in wars but were not as badly affected as Bosnia by
far and thus have different and more functional state structures, as well as
political institutions and administrations with a higher level of functioning.
Even though the scores differ between Bosnia, Croatia and Serbia,
there are also common trends in all three countries, where the democratic
order (or democratization process) is constantly challenged. The main
obstacles are arbitrary decision making by strong leaders beyond insti-
tutions (as in Serbia), political control of public administration and the
judiciary (partly in all three countries), dominance of executive power (in
Serbia but also partly in Croatia) and, finally, huge political polarization
between more liberal and nationalist parties (strongly visible in Bosnia
and Croatia). It is the latter that has been preventing Croatia from further
consolidation of its institutions and state capacity. In Bosnia and Serbia
we observe an increasing trend towards the reduction of media freedom,
concentration of power in the hands of political elites and their clientalis-
tic networks and a very high degree of corruption. Combined with sym-
bolic politics and nationalist mobilization, these regimes are able to stay in
power (Balkans in Europe Policy Advisory Group, 2017).
It is against this background that we analyse crisis governance in Cro-
atia, Serbia and Bosnia during and after the floods in May 2014. We ask
primarily if democratic regimes react to and deal with crisis differently
from transitional or “greyzone” regimes. Boin, McConnell and ‘t Hart
argue that “It is time for crisis management research to come out of its
academic ghetto and blend in with the mainstay of research on governance
and democracy” (Boin et al., 2008, p. 313) and formulate with this quest
one of the core elements and motivations for our volume.
The general assumption is that more democratic regimes are better
capable of providing coordinated and functional responses to a major
crisis, while transitional regimes – both due to limited capacities, weak
institutions and a very personalized and partly authoritarian approach to
leadership – react differently. We argue that the way in which countries

deal with major crises reveals much about their state capacity and about
the fundamental character of their regimes. Finally, the question arises
whether the flood crisis has been salutary in any way regarding the
democratization of governance and the increased transparency of the deci-
sion-making process.
This chapter aims, firstly, to capture the relationship between crisis
management, the art of leadership and governance. Secondly, through the
lenses of crisis governance, it seeks to draw conclusions about state capac-
ity. Finally, it looks at the relationship between the specific response to the
crisis and the process of learning at the individual and institutional level in
democratic and nondemocratic regimes. Combining work on crisis man-
agement, leadership, governance and state capacity allows the exploration
of the political dimension of the flood crisis, such as existing crisis pro-
tection mechanisms, the actual emergency response and communication
activities, accountability processes and organizational learning; however,
it also provides an insight into its societal dimension through the prism of
social capital theory and ethnopolitics.

Theoretical Considerations

The crisis management research focused primarily on organizational and

societal responses to disaster as well as on postcrisis recovery efforts
(Smith and Elliot, 2006; Kuipers and ‘t Hart, 2014, p. 589). More specif-
ically, it evolved around the debate on crisis conceptualization (see Smith
and Elliot, 2006), organizational systems and their failure potential. The
bulk of the research was devoted to the way one makes sense of crisis
in the acute response phase and how one deals with its aftermath (Boin,
2005; Boin et al., 2008). Later on, the focus turned to decision-making
processes against the backdrop of international relations. More recently,
the multidisciplinary approach to crisis management has come to the fore,
including cognitive studies and exploration of long-term effects of natural
disasters on individuals and collectivities.
This growing literature on crisis and crisis management constitutes a
good reference point for the investigation of the flood crisis in the Balkans.
However, given that Serbia and Bosnia and Herzegovina are not consolidated

democracies and can rather be described as transitional regimes with weakly

consolidated institutions, crisis management merits a more holistic approach
complemented by the concepts of leadership and governance.

Conceptualizing Crisis and Crisis Management

Crisis situations are novel, unstructured threats, outside of an organiza-

tion’s or individual’s usual operating framework (Reilly, 1993, pp. 116–
120). They interrupt routine procedures and demand nonprogrammed
decisions. Crises can therefore be described as unexpected, uncertain
situations that constitute threats to major values, both organizational and
personal; crises are harmful and disruptive. The crisis situations are char-
acterized by time pressure and an inflow of often insufficient and ambig-
uous, if not conflicting, information; they trigger a sense of human and
institutional insufficiency.
In the literature the terms “crisis” and “disaster” are often used inter-
changeably (Smith, 2006, p. 1). “Disaster” is defined as a crisis with “bad
ending”. Some disasters are referred to as “catastrophes”, marked by
“unprecedented damage, a prolonged breakdown of life sustaining func-
tions in a social system” (Boin, 2010, p. 131). The floods in May 2014
presented such a catastrophe or even more precisely, a “megacrisis” in its
own right. The concept of megacrisis is increasingly used to stress “the
continuous development of increasing frequency and severity of natural
disasters stimulated by climate change and growing numbers of metropol-
itan agglomerations” (Engel et al., 2012, p. 320). A megacrisis is a crisis
that greatly surpasses others of its kind (Engel et al., 2012, pp. 320–321).
Given the unprecedented magnitude of the May floods in the Balkans, the
use of the notion of megacrisis appears justified.
Crisis or megacrisis management, therefore, involves several stages
(Reilly, 1993, p. 120; see also Chapter 8 in this volume): problem sens-
ing (accurate perception, recognition and diagnosis); decisional response;
resource mobilization and implementation; internal information flow and
external information flow. The cognitive processes of perceiving, col-
lecting, selecting and processing information appear critical to effective
crisis management but the management capacity of any organization also
depends on active communication among the employees and respon-
sible managers. External communication, moreover, involves the key

“interpreters” of the crisis, the media, as well as other central external

stakeholders or major customers. Failed communication, in any case, may
have long-term consequences on public confidence in an affected organi-
zation (Reilly, 1993, p. 120).

(Bad) Leadership, Crisis Management and Governance

The outcome of crisis management is determined by the nature of the

crisis and by the crisis management activities actually implemented by the
persons in charge. Needless to say, decision making in crisis takes place
in the atmosphere of ambiguity, uncertainty and time pressure, and can
be investigated from an individual perspective and by considering “per-
sonality structure”, i.e. crisis-induced stress and its impact on individual
decision makers (Post, 1993, pp. 104–105). According to Post, there are
several characteristics of the “impaired decision making” (as opposed to
“vigilant”, sound, decision-making patterns):

• with a truncated timespan, more attention is paid to the immediate

consequences of action than to its long-range consequences;
• a tendency to “decisional closure” – rushed decisions and resulting
premature actions;
• a tendency to “defensive avoidance”, waiting for the “optimal
moment” and procrastinating;
• “cognitive rigidity” – a tendency to maintain a fixed mind set; dimin-
ished creativity;
• a tendency to reduce “cognitive complexity”, oversimplifying options
and taking the first good option;
• a tendency to “bolster” – to upgrade factors that support the favoured
actions;
• a tendency to seek familiar patterns, including patterns from history;
• a tendency towards “fundamental attribution bias” (my adversary’s
actions aim to destroy us).

The volume pays particular attention to the political aspects of the deci-
sion-making process and their consequences, especially for the state
capacities and development of the political regime. It does not only handle
the elites’ behaviour and their leadership but also the institutions and other
societal actors. The main question is, therefore, not only how efficiently

the crisis was managed but also what was going on politically during the
crisis management and how the floods were instrumentalized and politi-
cized during and in the aftermath of the crisis.
In all three countries studied in the volume, we observe a trend towards
a personalized way of ruling with strong men heading the executive. This
raises the question of the consequences that such leadership might have
on crisis management and governance. Is there a difference between what
can reasonably be expected from leaders during natural crises in demo-
cratic regimes and transitional regimes? Which kind of leadership can we
observe in times of crisis and how it is related to crisis governance and
existing state capacities?
Taking a closer look at the relationship between leadership and crisis
governance, and the way in which leadership was performed during the
crisis, the crucial aspect is the relationship between the institutional setup
of the country on the one hand and the form of governance and leader-
ship on the other. The main problem seems to be that the personalized
kind of power widespread in nondemocratic systems tends to act beyond
institutions, which ultimately puts a strong leader in a position where, in
order to exercise power, he relies either on his charisma or on informal
or clientelistic party networks. Both charisma as well as informality are
directly contrary to the principles of democratic institutions, the rule of
law and checks and balances, which obviously creates a completely differ-
ent framework for acting in times of megacrisis and opens up a huge space
for arbitrary decisions related to the crisis situation. Arbitrary decision
making more frequently ends up in bad governance, understood as bad
policies (Helms, 2012, 2014). Thus we can assume that negative effects of
bad leadership on governance in countries with weak and inefficient insti-
tutions are much larger than in functioning democracies. This goes even
more for the situation of megacrisis, where quick but also transparent and
institutionally embodied reaction and acting is very much needed.
Lipman-Blumen (2004) adds yet another important dimension to the
protracted relationship between leadership and governance by defining
toxic leadership as “mixed” forms of bad leadership combined with bad
and inefficient governance, morally bad leadership and a certain amount
of destructive leadership. Toxic leadership can harm even the most stable
democracies, not to mention countries with weak institutions and huge
informal sectors (Lipman-Blumen, 2004).

A final reflection relevant for thinking about leadership, crisis and

governance is the one referring to bad leadership and its occurrence in
specific political contexts, in our case in the context of transitional coun-
tries. An important tool for understanding the relationship between the
(state) structure and leadership is provided by Michael Foley’s concept
of disjunctures (Foley, 2013). Democratic disjuncture according to Foley
would be one where “a leader can be depicted as acting in accordance with
a purely functional and formal remit in which the leadership is valued as a
device operating within a network of institutional, legal, and constitutional
constraints” (Foley, 2013, p. 345). On the other hand, a disjuncture leaning
towards a nondemocratic pattern goes in the opposite direction. “Instead
of being seen as subsumed within a controlling structure, leaders are com-
monly recognized as possessing intrinsic and idiosyncratic responsibilities
that allow for a more activist role to be taken within government” (Foley,
2013, p. 346). It is precisely in times of crisis that leaders tend to develop
a very activist agenda accompanied by special powers for the leader. As
Foley puts it
special de facto powers that either stretch the de jure frameworks of due process
or transcend them altogether through reference to extraordinary responsibilities and
executive authority … Where the contexts are designated as national emergencies,
existential threats, or international crises, many political leaders consider it to be part
of their responsibilities to claim the license to circumvent, ignore, and even suspend
normal legal and institutional arrangements. (Foley, 2013, pp. 345–346)

We could easily find examples of this kind of disjuncture and strong-man

leadership in our case studies, probably in a most visible way in the behav-
iour of Serbian former Prime Minister and now President, Aleksandar
Vučić (see Chapter 3 in this volume, but see also Chapters 4 and 5).
Based on these general conceptual thoughts on leadership and more
concretely on ideas put forward by Boin, Kuipers and Overdijk (Boin
et al., 2013), Sanneke Kuipers, in Chapter 8, embarks on the challenging
task of applying the evaluation framework for an efficient and timely crisis
leadership, developed initially for democratic context, to the case studies
of Bosnia and Herzegovina, Croatia and Serbia.

Crisis Governance and State Capacity

Given that Serbia and Bosnia and Herzegovina can still be described as
transitional regimes and the final goal of EU-style democracy has become
more distant over the course of the last few years, political structure and
the art of crisis leadership appeared crucial for dealing with the crisis.
Because the floods exposed major weaknesses in the governance of the
countries under study, in the following we focus on the broader concept of
crisis governance rather than on the term “managing the crisis”. Accord-
ing to Kjær, the governance realm entails four characteristics: authority
referring to the legitimate power based on consensus; reciprocity – con-
tinuous social interaction leading to new forms of consensus about basic
rules of politics; trust within families and kinship groups but also towards
public authority; and accountability – responsiveness of public authori-
ties towards citizens; and the extent to which citizens can hold authorities
to account (Kjær, 2004, p. 164). The concept is hence focused not only
on elites but also on intermediary institutions and highlights the value
of social capital and civil society in legitimizing the public realm (Kjær,
2004, p. 165).
If we regard the crisis as a transitory situation of a high magnitude
that touches on the core of an existing regime, the governance perspective
can help us understand the management of those of the regime’s structures
that are aimed at enhancing the legitimacy of the decisions taken during
the crisis. It is where the role of crisis leadership and (non)democratic
disjuncture must again be emphasized. Leadership highlights how power,
authority and influence are exercised, so the crisis may lead to democra-
tization of the governance structures or may result in quite an opposite
development. When institutions are, by definition, not yet consolidated,
crisis decision makers or the crisis leaders (who do not have to have any
concrete position within the response mechanism) may potentially exercise
much influence on them. While governance denotes the “setting, applica-
tion and enforcement of regime rules” (see Kjær, 2004, p. 10), the focus
must be on “setting” because the crisis and the postcrisis phase may trigger
institutional changes and bring about new rules. In nondemocracies these
might even be restrictive rules related to the functioning of opposition, or
critical media and similar.
In sum, crisis governance, rather than crisis management, combined
with a leadership perspective, is therefore better placed to capture the way

leaders create reciprocity – new consensus about basic rules in politics;

the way they manage accountability processes going on in the (post)crisis
situation, as well as the way they renew trust, especially in uncertain situ-
ations such as floods.
Adopting the governance perspective means that particular attention is
given to the state-society divide. This divide lies at the core of the concept
of state. It can be assumed that the state still remains the only player in the
governance process that can rightfully claim to have a legitimate political
mandate (Pierre and Peters, 2000, p. 197), and is, at least in theory, the
key vehicle for the pursuit of the collective interest in society – that is the
common good or general will. The state provides a framework of peace
and social order and this is why its capacities are best visible during the
crisis, which constitutes a massive social disorder.
State capacities refer to state strength or weakness. Kjær et al (2002)
point out the state’s functional capacities, such as administration and rule of
law. The authors also enumerate the mechanisms supporting state capacity
such as state–society interrelations, corporatist ties, the leadership capa-
bilities of elites and, finally, factors strengthening state capacities like
legitimacy, trust and social capital. Governance thus belongs to mecha-
nisms and factors underpinning state capacities. Moreover, the governance
perspective sees state strength as a result of its adaptability to changing
society and new governance structures (Pierre and Peters, 2000, p. 172).
It is from this dynamic perspective that we can explore crisis governance
and the learning process thereafter. Lack of adaptability to crisis-induced
changes and challenges would thus point to state weakness.
In the transition scholarship it is “state weakness” that has been fre-
quently heralded as critical to stalled transitions (Ekiert, 2001). In gen-
eral, three understandings of state weakness2 can be identified (Kostovi-
cova and Bojičić-Dželilović, 2009, p. 3). The “capabilities approach” to
state weakness stresses the state’s ability (or lack thereof) to perform its
functions, i.e. “to penetrate society, regulate social relationships, extract
resources, and appropriate or use resources in determined ways” (Migdal,

1988, p. 4). The “public goods approach” shifts the focus on what the
state can provide to its citizens. Rotberg (2003, pp. 3–4) highlights the
effective delivery of pivotal political goods starting with security, mecha-
nisms for dispute resolution and regulation, essential freedoms, education
and healthcare. Finally, the “legitimacy approach” differentiates between
horizontal legitimacy, which refers to the nature of ruled communities,
including restrictions on membership, and vertical legitimacy denoting
entitlement to rule, the connection between the society and political insti-
tutions and the regime.
Investigation of crisis governance can reveal the weakness of the state
while highlighting its poor extraction of resources during the crisis, prev-
alent lack of security and a great gap between state and society. The weak-
ness of the state is also expressed by the appearance of nondemocratic
disjuncture, while the crisis leadership tries to extend its power, breaches
the existing legal order and thus undermines the rule of law. Finally, a
lack of adaptability to crisis-induced challenges, meaning the lack of indi-
vidual/societal and institutional learning, may also imply very weak state
capacity.

Learning In and From the Crisis

When looking at reactions of regimes to any kind of major crisis, it is

important to distinguish between two aspects of crisis management related
to the time factor. The first phase is the acute response phase. Here the
questions on how decisions are made, how efficient the immediate crisis
management is, or how the communication around the crisis is organized,
merit special attention. In the second phase, described as the postcrisis
phase, usually marked by intense politicization (Rosenthal/t’Hart, 1999;
Boin et al., 2008), we observe the so-called “drama of accountability”
and the subsequent blaming leads in most cases to the “crisis after the
crisis” phenomenon. The focus in this phase is on the management of
accountability and the avoidance of blame game (blame management).
In any case, the question of learning during the crisis (both institutional
learning as well as learning of actors/stakeholders) belongs inherently to
the postcrisis phase.
The question of learning in and from the crisis has recently become
prominent in the academic debate. Scholars agree that much more research

is needed in order to understand better the complex processes of learn-

ing after crisis (Egner and Schorch, 2015, p. 300). Yet, there seems to be
an agreement in terms of which questions have to be asked to concep-
tualize learning but also to organize processes of learning after crisis in
rather practical terms. According to Egner and Schorch (2015, p. 300) it is
important to distinguish
(1) what it is that should be learned from or for adverse events, (2) what the learning
should aim at, (3) which methods are appropriate to reach the selected goals, and
(4) which aspects of a disaster or catastrophe should be remembered for which pur-
pose in the learning process.

Moreover, all these questions have to take account of the political and
societal context in which the crisis has occurred and the processes of
learning have to take place. This brings us again to the question of how to
think about learning after crisis in regimes that do not belong to the group
of stable (European) democracies. Here again, the fundamental distinction
between individual and collective/societal learning in crisis comes to the
forefront.
Individual learning is understood as a self-organized and self-refer-
ential process that unfolds when there is an intrinsic motivation to learn.
Here the questions would be whether bad leaders (see below) have an
intrinsic motivation to learn or not. Societal and collective learning is
far more complicated. Egner and Schorch pose the important question
of how learning can be conceptualized in collective entities like societies
that obviously lack a collective and homogenous consciousness, or in our
case in societies that lack a “democratic consciousness”. That means that
when we discuss the reactions to the crisis and learning in transitional
regimes, the question has to go much further and ask how societies that are
still shaped by strong men and dominant political parties, with unstable
institutions and strong ideological concepts (of exclusive nationalism for
example) can learn from a crisis. The evidence presented in the chapters
in this volume suggests a rather low and rather erratic process of societal
learning, partly due to limited financial and administrative resources and
capacities but also partly due to the ways in which power in the states is
formed and performed.
One very important limitation for learning in all three countries is
informality. If we follow the argument by Giordano and Hayoz (2013)
about informality and clientelism as a very important tool or “technique of

governing” for securing power in transitional countries, than we can argue

that the informal character of decision-making processes and widespread
clientelism runs against the principle of institutions and thus also institu-
tional learning in a democratic way.
The question of how learning is possible and which preconditions
are needed at both the collective and individual levels point to rather pol-
icy-relevant institutional learning. Here we can distinguish between three
further possible layers of learning (see Boin et al., 2008, pp. 16–17).
The first one refers to “fine tuning”, which equals the “quickest fix” and
stands for an approach usually taken during a crisis. Here the chapters in
the volume offer important insights into the question of how transitional
democratic regimes with a strongly personalized type of rule tend to find
“quick fixes” by diverting responsibility and engaging in blame games by
simultaneously being engaged in symbolic politics and media self-promo-
tion based on the “problem-solver” image.
The second layer of learning refers to the aftermath of the crisis and
the idea that policy reforms should be implemented in order to prevent
the next big crisis from causing a similar negative impact to the original
crisis. A substantial policy change would in any case include key reforms
within the governance and a set of relevant changes in key policy sectors
able to impact a future crisis. Finally – and this is something that refers to
the long-term perspective – a paradigm shift understood as a comprehen-
sive change of societal paradigms could be framed as an ultimate effect of
learning from the crisis.
An important problem in the context of learning is how to democra-
tize governance in order to avert, manage and resolve crises in the future
– or, in others words, to democratize the very process of learning, to be
better equipped for another natural megacrisis. If the democratic govern-
ance response to the crisis of any kind is performed in a just and legitimate
manner then we can draw conclusions about the character of the regime by
exploring and describing its specific response to the crisis. In some cases
the “‘disclocation’ of hitherto dominant social, political or administrative
discourses” (Boin et al., 2008, p. 285) in the wake of the crisis can delegit-
imize its power. In other cases we see no fundamental change in the way
in which governance and polities function following the crisis. In any case,
crisis creates a whole spectrum of possible reactions on the political level.
As the authors notice, it opens up “semantic and political space for actors
to redefine issues, propose new policies, foster public reflection” (Boin

et al., 2008, p. 285), or simply to gain popularity, strengthen and expand

their current rule, strike at opponents, engage in blame games and so forth.
Against this background, a litmus test for democratic governance is
the inclusion of citizens in decision-making processes following the acute
crisis phase. Marginalization of the citizens in decision-making processes
usually exposes the art of governing as a game for the elites that sidelines
the majority and uses governance as a mechanism for advancing the inter-
ests of a selected few. Thinking about citizens differently we can argue
that, in times of crisis, civil society and social movements can play a cru-
cial role in managing the crisis and even trigger learning processes. How-
ever, the question arises whether civil society can compensate for a weak
state and dysfunctional state capacity.
A possible lesson that can be learned in the aftermath of the crisis
would definitely be the need to include strengthening of participatory and
deliberative aspects of democracy as a way to enhance the accountabil-
ity of authorities and governance itself. As the crisis usually presents an
opportunity to apply fresh thinking and innovative action, the authors of
the volume ask whether the crisis was an opportunity for anything new
and, if yes, in which segments and dimensions.

Contributions

Drawing on the theoretical considerations above and the main goals of

this volume, all contributions discuss core arguments of this book related
to the crisis response, accountability processes, learning possibilities and
regime characteristics. These arguments reflect the difference in crisis
governance in democratic (Croatia) and transitional systems (Bosnia and
Herzegovina, Serbia).
Besides, two descriprive overview texts have been placed in the appen-
dix to this book. The first one gives a better understanding of the sequence
of events during the floods in May 2014 in each country (Appnedix 1:
“Mapping an Unfolding Crisis: Key Developments during the Floods in
Bosnia and Herzegovina, Croatia and Serbia”). The second one illustrates
the specificity and institutional complexity of each crisis protection system

(Appendix 2: “Flood Protection Systems in the Precrisis Phase: The Cases

of Serbia, Croatia, Bosnia and Herzegovina”).
The volume covers thus three quite different case studies in terms of
political order, state structure and existing crisis-protection systems. Given
the nondemocratic regime and the hierarchical power structure in Serbia,
and the highly decentralized and ethnically polarized state in Bosnia, the
crisis response is bound to be strongly “personalized” there. An efficient
crisis response is likely to be hindered by an obscure chain of command,
personal/political animosities, bad leadership and clientelistic dependen-
cies, or simply by weak institutions. In a democratic order with its subsys-
tems and independent agencies, the crisis response is likely to be based on
more formalized and coordinated action (see Chapters 2, 3 and 5).
Furthermore, in nondemocratic systems and weak states, the gov-
ernment/crisis leaders and decision makers try to undermine the exposed
weaknesses and deficiencies of the crisis response and suppress criticism.
They resort to populist measures such as blaming internal opposition or
external foes for plotting against the government and for trying to gain
power – thus destabilizing the country. The media are used to depicting
the government as “protector”, which frequently hinders other voices in
their controlling and critical functions. Censorship of critical web sites
and blogs is also used. Thus, the natural crisis might constitute an oppor-
tunity for the political elites to extend their power and to develop in a more
authoritarian direction (see Chapters 3 and 4).
In this crisis situation, political and ethnic divisions may vanish within
the affected societies when faced with a common natural catastrophe. The
resulting social capital, solidarity and neighbourly help might trigger
social activism and demands for change (see Chapters 5 and 6). However,
only ongoing protests and demands from civil society organizations may
induce more accountability and substantial reforms and, as a result, the
democratization of the given political regime. Such reforms, nonetheless,
hinge on the consensus among political elites.
This is why the learning process might be minimal within elites or
institutions. In a nondemocratic regime, given the weakness of opposi-
tion and passive society, only changes that consist of “fine tuning”, or
some improvements to legislation, are expected to be introduced by the
ruling elites to “save face” (see Chapters 2 and 7). No “paradigm shifts” in
the sense of democratization of existing governance structures can appear

without the will of political elites and more systematic and resurgent civil
society.
Finally, state weakness exposed by the deficiencies of the whole cri-
sis-protection system might be self-reproducing, due to the elite’s con-
trol over media, weak opposition and possibly passive society. The same
applies to leaders responsible for the crisis management failure, who will
use their positions of power to minimize the negative repercussions of
their failed crisis response.

2. Crisis Response in Bosnia and Herzegovina,

Serbia and Croatia

The institutional design of crisis management in Bosnia and Herzegovina, Croatia

and Serbia determined those countries’ responses to the 2014 floods. In all three
cases a weak institutional framework and deficient communication, coordination and
cooperation severely limited the efficiency of crisis response. Even though the floods
affected the broader region, there was no coordinated response between the countries.
This was aggravated by the scale of the floods, the rareness of such an event – best
described as a black swan event – and the lack of adequate measures to prepare for
such an occurrence. The resulting patchwork of institutional responses had its own
deficiencies and faults. We identify three common issues: a prevalent lack of effective
communication between response actors and institutions through formal channels,
a lack of substantial investment in water management and civil protection systems
and the absence of responsibility after flooding. There were also differences between
cases, especially regarding institutional learning and adaptation. Yet, the floods pro-
duced some insights at the strategic level of political officeholders, confirming bad
governance in Southeast Europe.

Introduction

Rivers often determine administrative boundaries but floods and natu-

ral disasters show no respect for different governance systems. The 2014
floods severely affected three countries that share many institutional simi-
larities due to their common history and legacies. At the same time Bosnia
and Herzegovina (BiH), Serbia and Croatia faced very different challenges
related to the institutional design of crisis management. Institutional issues
prevalent in each case study shaped the response to the floods.

Although it is possible to speak of a transboundary crisis, there was

no coordinated response among countries. Crossborder communication
and cooperation were very limited. This pattern of deficient communi-
cation was also evident within each country as different institutions and
administrative levels communicated poorly in their crisis response. Yet,
the importance of communication, coordination and collaboration for effi-
cient crisis response is stressed in the literature (Boin and ’t Hart, 2010).
We argue that a weak institutional framework in all three cases
severely limited the crisis response. The institutional response to flooding
happened within mostly isolated administrative areas, on a transnational,
national and local level. Communication, coordination and cooperation
between institutions and responders was deficient or nonexistent, leading
to critical delays in crisis response. Moreover, regionally relevant patterns
of institutional neglect, political infighting and patronage limited the effi-
ciency of crisis response.
A second part of our argument concerns institutional and individ-
ual responses when faced with a black swan event. According to Taleb
(2007), a black swan event is an unpredictable and unexpected event that
can create significant damage. Its unpredictability is rooted in the belief
that it is so rare that it will not occur during one’s lifetime. The typical rea-
soning of public officials is that it will not happen on their watch or during
their mandate. Therefore, institutions do not take precautionary measures
against extreme events. Because it is viewed as an anomaly, a black swan
event limits postcrisis learning and, instead, often results in a blame game
or purposeful disregard for institutional change.
The black swan event in the form of massive floods in the three coun-
tries was caused by the cyclone Tamara between 13–18 May 2014. It
brought the heaviest rain ever recorded in BiH and Serbia, by far surpass-
ing all measurements of the previous 120 years and any modelled predic-
tions.1 In Croatia the extraordinary amount of rain that fell between 2–19
May was, according to the official data, equivalent to precipitation for the
whole spring (Perčec and Tadić, 2014; Renko, 2014). Rivers like the Una,
Vrbas, Bosna, Drina and Kolubara swelled rapidly, while the quantity of
water kept the crest of the flood at a high level for longer than usual.
