Definitionof Pension
Pension is the monthly payment of a sum of money
admissible to a Government servant after his reti rement
from active services and becomes payable throughout
his life time as a measure of socio economic security which
is the only source of livelihood after reti rement

1. SuperannuationPension(Rule – 42):
Means on attaining the age of reti rement ie: 61 years
As per T.S. PublicEmployment(Regulationof Age

If date of bi rth is 1st of the month, the employee on
completion of 61 / 61 years has to reti re on the last day of
previous month. ([Link].289,Fin.&

reti re on last day of that month
2. Family pension:
According to Rule 50 of APRPR 1980 “ Fami ly pension is
payable to the survivors of the Government servant in the
event of death of the [Link] whi le in service and also
after reti rement from service.

For the pur poseof PensionFamilymeans
As per sub-rule (12)clause (b)
1. Wife in the case of a male Government servant, or
husband in the case of a female Government servant

Wife and husband shall include respectively judicially
separated wife and husband

Where the appointing authori ty decides that for reasons to be
recorded in wri ting a chi ld or chi ldren from a judicially
separated deceased female Government servant should receive
the fami ly pension in preference to judicially separated
husband of the deceased Government servant such husband
shall not be regardedas covered by the expr ession ‘family ’.

The eligible beneficiaries of fami ly pension are divided into
two categories as shown below; namely
Category-I
1. Widow or widower, upto the date of death or
remarriage whichever is earlier
2. Son / daughter (including widowed daughter)
upto the date of his/her marriage / remarriage
or ti ll the date he/ she starts earning or ti ll the
age of 25 years, whichever is the earliest

3. Sons/daugh ters who are physically/mentally
disabled throughout thei r life.
Category-II
1. Unmarried/ widowed/ divorced daughter, not covered
by Category-I above, upto the date of marriage/
remarriage or ti ll the date she starts earning or upto the
date of death whichever is the earliest.
2. Parents, who were wholly dependent on the Government
servant when he / she was alive, provided the deceased
employee has left behind nei ther a widow nor a chi ld. Fami ly
pension to dependent parents wi llcontinue ti ll the date of
death

3. Fami ly Pension to unmarried/widowed/divorced
daughters referred to, in Category-II and dependent
parents referred to in category-II shall be payable only
after the other eligible fami ly members in the Category-I
have ceased to be eligible to receive fami ly pension and
there is no physically/mentally disabled chi ld to receive
the fami ly pension.
4. Grant of fami ly pension to chi ldren in respective
categories shall be payable in order of thei r date of bi rth
and younge r of them wi ll not be eligible for fami ly
pension unless the next above him/her has become
ineligible for grant of fami ly pension in that category

The income criteria for dependency wi ll be the minimum
fami ly pension along wi th dearness relief thereon
The Childless widow of a deceased Govt. employee shall
continue to be paid fami ly pension even after her
remarriage subject to the condition that the fami ly
pension shall cease once her independent income from
all other sources becomes equal to or higher than the
minimum fami ly pension prescribed from time to time.
The Fami ly pensioner i.e. the chi ldless widow, in such
cases would be required to give a declaration regarding
her income from other sources to the pension disbursing
authori ty once in every six months.

In the case of a son or daughter of a Government
servant who is suffering from any disorder or disabi lity of
mind or is physically crippled or disabled so as to render
him or her unable to earn a living even after attaining
the ages of 25, If such son or daughter is one among
two or more chi ldren of the Government servant,
[Link] fami ly pension shall be ini tially payable to the
chi ldren in the order set out in clause (ii ) of sub rule (7)
of this rule, unti l the last chi ld attains the age of 25 ,and
thereafter the fami ly pension shall be resumed in favour
of the son or daughter suffering from disorder or
disabi lity of mind or who is physically crippled or
disabled and shall be payable to him/her for life ;

2. If there are more than one such chi ld suffering from
disorder or disabi lity of mind, or who are physically
crippled or disabled, the fami ly pension shall be paid in
the order of thei r bi rths and younge r of them wi ll get the
fami ly pension only after the elder next above him/her
ceases to be eligible.
3. Where the fami ly pension is payable to such twin
chi ldren, it shall be paid to such twin chi ldren in equal

3. RetiringPension(Rule – 43 & 44)
As per Rule – 43, a Govt. Servant may reti re voluntari ly
from service after completion of 20 years of qualifying
service and he may submit notice for reti rement before 3
months of the reti rement.
As per Rule – 44, Govt. Servants who have
completed 33 years of qualifying service, may be permi tted
to reti re voluntari ly. For these two pensioners Date of
Retirement is the Date of permission to reti re voluntari ly
4. InvalidPension(Rule – 37)
As per Rule – 37, if the Competent Medical Authority
incapaci tates a [Link] for further service, the date of
issue of M.C. is date of Retirement.

If a Govt. Servant is on leave, which was already granted and
invalidated by the Competent Medical Authority, he has to
reti re on last day of expi ry of leave
5. CompensationPension(Rule – 38)
If a Govt. Servant was discharged from service due to
abolition of his permanent post, then he has to be appointed to
simi lar post wi th equal pay (OR) if not possible, he has to be
reti red from service. The date of issue of order is the date of
reti rement

If a Govt. Servant is imposed wi th the penalty of compulsory
reti rement from service under CCA Rule 9(viii) , then he has to be paid
compulsory reti rement pension. The day of discharge is the date of
Reti rement

7. CompassionateAllowance(Rule – 40)
If a Govt. Servant was Removed [CCA Rule-9(ix)] (OR)
Dismissed [CCA Rule-9(x)] from service, no pension is payable
to him. In deserving cases, the sanctioning authori ty may
sanction Compassi onate Allowance
8. Pr ovisionalPension
It wi ll be paid to the employees where departmental or
judicial proceedings are pending
The minimum provisional pension is 75% and it shall not
exceed maximum pension which would have been admissible
on the basis of qualifying service
Payment of provisional pension shall be adjusted against the
final reti rement benefi ts sanctioned upon conclusi on of such
proceedings

But no recovery shall be made where the pension finally
sanctioned is less than provisional pension or pension is
reduced or wi thheld permanently or for a specified period
9. Anticipator yPension
As per Rule 51-A, in respect of reti red employees,
where the payment of pension has not commenced on the due
date after reti rement, the Head of Office concerned,
irrespective of the fact whether the pension papers have been
sent to Accountant- General or not] shall draw and disburse
anticipatory pension not exceeding 90% of the Pension

10. Pr o-rataPension(Rule – 35 & 36)
A Government servant who has been permi tted to be
absorbed in a service or post in or under a corporation
or company wholly or substantially owned or controlled by
the Government , if such absorption is declared by the
Government to be in the public interest ,be deemed to have
reti red from the service from the date of such absorption and
shall be eligible to receive reti rement benefi ts from such date
as may be determined in accordance wi th the orders of the
Government applicable to him.

An account(PRAN-16 digi t) no is allotted to each employee
and pay+DA=total*1/10 wi ll be deducted and credi ted to
head concerned and managed by Govt and Govt contribute
certain amount to the employees contribution. And certain
amount of payment as pension wi ll be paid the employees
after reti rement

employees coming under the C P S (Contributory Pension Scheme) have
to apply for PRAN (Permanent Reti rement Account Number)allotted &
maintained by NSDL, Bombay.

DISCIPLI NARYCASES AND ITS I MPACTON PENSION
Under Rule 9 of APRPRs the disciplinary proceedings
pending under CCA Rules on the date of reti rement are
deemed to have continued after reti rement . Such employees is
not enti tled for pensionery benefi ts ti ll the conclusi on of such
disciplinary proceedings . However, provisional pension under
rule 52 is admissible.
DATE OF RETI RE MENT:-
The last Date of Calendar Month wi ll betaken as Date of
Retirement, If the Date of Bi rth is 5th or any Date of the
Month, last day of that month wi ll be the reti rement.

EOL granted on the request of the individual for regularization of
the dismissal/deemed suspension/ suspension period after exhausting

Anticipatory Gratui ty
As per Rule 51-C where there is likely to be delay in releasing the
pensionary benefits due to the pensioner,anticipatory gratuity to the
extent of 80% of the amount worked out by the departmental
authorities wi th reference to the records available and the qualifying
service verified, pending verification and authorisation of the full
gratuity by the Accountant-General/Director of Local Fund Audit,
shall be sanctioned and the same shall be drawn and disbursed after
adjusting all the dues known to the department up to the date of
sanction of the Anticipatory Gratuity
No anticipatory gratuity shall be sanctioned andreleased
to the pensioner where departmentalor judicial proceedings
are pending or arecontemplated against the pensioner unti l

I. Submissionof formalapplicationfor pension
Every Government servant shall submit, the forms duly fi lled
in,18 months in advance to the date of his actual or anticipated
reti rement.
In cases where the date of reti rement cannot be foreseen 18
months in advance, the forms shall be submitted immediate ly
after the date of reti rement
