UPON hearing the counsel, the Court made the following


O R D E R

These are statutory Appeals filed against the common

judgment and order dated 10th April, 2025 in C.C. No.57/2012,

G.A. No.4/2024 and G.A. No.6 of 2024 passed by the Calcutta

High Court.

Issue notice.

Mr. D. Abhinav Rao, Advocate-on-Record, accepts and

waives formal notice on behalf of the first respondent in

Diary Nos. 19227/2025 and 19260/2025.

Mr. Abhishek Kumar Singh, Advocate-on-Record, accepts and

waives formal notice on behalf of the second to fourth

respondents in Diary No.19227/2025.

Mr. Deshpande Chinmay Arvind, Advocate-on-Record, accepts

and waives formal notice on behalf of the second respondent

in Diary No.19260/2025.

Counter affidavit to be filed within two weeks and

rejoinder affidavit to be filed within two weeks thereafter.

List on 19th May, 2025.

In the meanwhile, there shall be stay of the impugned

judgment and order dated 10th April, 2025, only to the extent

of directing imprisonment to the appellants. We direct that

the appellants shall be released forthwith on bail on

personal bonds.

The Registry is directed to communicate this order to the

concerned Authorities including the Presidency Correctional

Home (Presidency Central Jail), Alipore, Kolkata-700027, West

Bengal.

We make it clear that this order is only as regards the

imprisonment of the appellants and for their release. We

have not touched any other aspect or stayed any other

direction of the High Court in its judgment and order dated

10th April, 2025.

In the meanwhile, the appellants are directed to cure the

defects pointed out by the Registry.
