No.-3lM-3112023-2160/GAD-In exercise of the powers conferred under proviso to the
Article 309 of the Constitution oflndia, the Govemor ofBihar makes the following Rules to amend
the "Probation Period ofBihar Government Servlnts Rules,2024"-
l. Shorl li e, enenl and commencemcnL-
(l) These Rules may be called as the "Probation Period of Bihar Government
Servants (Amendment) Rules' 2025."
@ lt shall extend to the whole State of Bihar.
(3)It shall come into force at once.
2. Subslilutionof Rule-3 ol Probation Period of Bihat Govenmenl Servants Rules,
2024.- Rule-3 of the said rules shall be substituted as follows-
"3. Probalion Period.-
(l) (i) The govemment servants, aPpointed by direct recruitment on the
recommendation of the Cornmission, shall be on probation for 0l (one)
year. The probation period may be exiended for 01 (one) more year, if the
service is not satisfactory during the probation Period. If the service is not
satisfactory even in the extended period, the service may be terminated.

(ii) The government servants, appointed by provisions other than direct


recruitment (Compassionate/Meritorious Sportsperson etc.), shall be on
probation for 0l (one) year. The probation period may be extended for 0l
(one) more year, if the service is not satisfactory during the probation
period. lf thc servic€ is not satisfactory even in the extended p€rio4 the
service may be terminated.
(2) (i) The probation period of government servants, appointed by
direct
recruitment on the recommendation of the Commission, shall start on the
date on which they join the induction raining in Bipard.
(ii) The probation period ofgovemment servants, appointed by provisions other
thar direct recruitnent (Compassionate/Meritorious Sportsperson etc.), shall
start on the date on which they join the service. Provided that, the concemed
administrative department will ensure their joining in the next induction
training session of Bipard.
(3) The list of recommended candidates based on the results ofany competitive
examination shall be made available by the Commission to the concemed
administrative department. Thereafter, the date of induction training shall be
decided by the Ceneral Administ*ation Department in consultation with
Bipard and other administrative departments. Appointment letters of the
recommended candidates shall be issued by all concerned administsative
departnents before the above stipulated date after completing the necessary
formalities. All newly appointed goyerment servanls shall join the
induction training session on the date decided by Bipard.
(4) On the basis of the recommendations of the Commission, the relevant
administrative department shall complete the formalities related to
verification of certificates, verification of character and antecedents etc. of
directly recruited govemment servants during their induction training period
itselfl
(5) The joining in Form-202, of the government servants, appointed through
direct recruitment on the basis of the recommendation of the Commission,
shall be accepted by Bipard itself and the process of onboarding them on
HRMS and allotment of PRAN shall also be facilitated by Bipard. On this
basis, the Finance (Personal Claim Fixation Cell) Department shall issue
their payslip and the concemed administrative departsnent shall arraage for
payment of the salary of induction training period from the headquarters
itself.
(6) After the commencement of induction h'aining in BIPARD, the govemment
servants, appointed through direct recruifiient, shall have to take permission
from the concemed administrative deparbxent for lat€ joining in induction
training.
(7) A maximum of 15 days latejoining in induction haining shall be permited
by BIPARD after commencement ofhaining. In case of delay of more than
15 days, the concemed newly appointed govemment servant shall be given
an opportunity to attend the next induction training session organized by
BIPARD. Provided that in such situation" the probation period of the
concemed employee shall be extended by the concemed administrative
department.

X, Addition of Subrule-(7) alter Subrale (6) of Rale (1) ln hobalion Period of Bihar
Government Servanls Rules, 2024.-After Subrule{6) ofRule-4 of the said rules, Subrule-(7) shall
be added as follows-
"On the basis of specific requirements of a service/cadre, the State Govemment, on
the recommendation of the Departrnent and concurrence of General Administration
Department, may extend, by specific order, the induction training period of newly
appointed members ofthe said service/cadre.
Provided that, the probation period of such employees will remain one year even
after such extension ofinduction training period."
4. Substitation of Rule-s of Ptubalion Period of Bihu Government Senants Rules,
2021.- Rrsl*S of the said rules shall be substituted as follows-

(l) Se nice Co nlbrnalio n-
(i) The service of govemment servants, appointed tkough direct recruitment
on the recommendation of the Commission, shall be confirmed after
fulfilling the following criterion-
(a) Successful completion of all the phases of induaion training as
prescribed in Rule-4, which includes successful completion of the
examinations/ assignments as prescribed by the concerned tmining
institute;
(b) Passing all the papers ofthe departmental examination as prescribed
by the Cenfal Examination Committee, Board of Revenue;
(c) Fulfilling all other requirements as prescribed in the relevant
service/ cadre Rules.
(ii) The service of government servants, appointed on grounds other than
direct recruitment (Compassionate/ltleritorious Sportsperson etc.), shall
be confirmed after fulfilling the following criterion-
(a) Successful completion of the induction training as prescribed in
Rule4(6), which includes successful completion of the
examinationV assignments as prescribed by the concerned training
institute;
(b) Passing all the papers ofthe departmental examination as prescribed
by the Cenrral Examination Committee, Board ofRevenue;
(c) Fulfilling all other requirements as prescribed in the relevant
service/cadre Rules.
(iii) Govemment servants shall have to try to score maximum marks in all the
papers of the deparfnental examination as prescribd by the Central
Examination Committee, Board of Revenue as-well-as in the
examinationV assignments as prescribed by the concerned training
institute as their due weightage shall also be given in determining their
relatiYe seniofity.
Q\ Daerminnion of Seniotity-
(i) The relative seniority of govemment servants, recommended and recruited
directly on the basis ofCombined Competitive Examination conducted by
Bihar Public Service Commission, shall be determined in the descending
order of total marks (Z) obtained after giving due weightage to the marks
obtained by them in the competitive examination of the Commission,

examinationVassignments conducted by the conc€med training institute in


different phases as-well-as departmental examination conducted by
Central Examination Committee, Board of Revenue. Weighted total

Provided that the relative seniority of government servant, recommended and


recruited directly on the basis of other competitive examinatiors conducted by
Commission, shall be determined according to their descending merit number in the
recommendation of the Commission.
(ii) The inter-se seniority of govemment servants appointed in a particular
calendar year, on grounds other than direct recruitment
(Compassionate/Meritorious Sporlsperson etc.),shall be determined
according to their respective date ofjoining.
(iii) When total weighted marks (Z) obtained by different employees,
appointed through direct recruitment on the recommendation of the
Commission, becomes equal, or, the date of joining of different
employees, appointed on grounds other than direct recruitment
(Compassionate/lvleritorious Sportsperson etc.), becomes same; the older
employee according to his date of birth shall rank senior to the younger
employees, and, when their date of birth also becomes same, their relative
seniority shall be determined on th€ basis of the first letter of their name
in Hindi Alphabet.
(iv) Except when specifically ordered by Honourable Court, the relative
seniority of a government servant, joining within one year from the date
of issuance of the appointrnent letter, shall be determined in the year of
appointment. Provided, in case ofjoining after one year from the date of
issuance of the appointrnent letter, the relative seniority shall be
determined in thejoining calender year.
(v) In a calendar year, the employee appointed by promotion to the basic
grade of a service/cadre shall ran-k senior to the employees appointed by
direct recruitment, in the sarne calendar year. Provided employees

appointed by direct recruitment in a calendar year shall rank senior to the
employees appointed on other grounds (Compassionate/Meritorious
Sportsperson etc.), in that calendar year.
(vi) If an officer is absorbedfrom one service to another on his own request
the services rendered by him on the previous post shall not be counted for
determination of his seniority in new service.
Provided that ifsuch absorbtion is on a post ofsame or lower pay level, in the light
of a policy decision taken by the Government, the services rendered by him on the
previous post shall be counted for determination ofhis seniority in new service.

seniority of concerned employees, in consultation with General Administration
Department and Finance Dcpartment, shall be specifically incorporated in the policy
decision itself.
(vii) The relative seniority of officers promoted in any service/cadre shall
remain the same as their existing relative seniority before promotion.
(viii) The relative seniority of the employees in any service/cadre, determined
before the notification ofthese Rules, shall remain unchanged."
5. Inserlion in Rule-9 of Prubalion Periad of Bihar Govemmen Seryanls Rules, 2021.-
Sub Rule-l(a) in Rule-9 ofthe said rules shall be inserted as follows-
"( l)(a) The provisions contained in circular no. 15784 dated 26.0E.1972 and 2763 dated
23.02.2016 of General Administration Department shall be deemed to be
repealed."
