AFFIDAVIT OF ADVERSE CLAIM

I, ____________________, of legal age, widow, Filipino citizen and a resident of


___________________ after having been sworn to in accordance with law, do hereby depose
and state THAT:

1. I have an adverse claim on a registered parcel of land covered by


Transfer Certificate of Title (TCT) No. ________________of the Register of
Deeds of Tarlac City and registered in the name of ____________. A copy of
the said title is hereto attached and marked as “ANNEX A” and forms an
integral part of this Affidavit of Adverse Claim;

2. This adverse claim consists of my right of ownership over the said parcel
of land as per the Real Estate Mortgage executed by the registered owner.
___________________________. A copy of the said Real Estate Mortgage dated
January 25, 2022 is hereto attached and marked as “ANNEX B” and forms
an integral part of this Affidavit of Adverse Claim;

3. ------------------------subsequently handed to me the owner’s duplicate copy of


the said title and other pertinent documents pending their payments under
the Real Estate Mortgage. However, ______________________ reneged on their
obligations and failed to comply with our written agreement. Worst, they
went into hiding and never contacted me.

4. By reason of their non- compliance with our agreement, I went to the


Registry of Deeds and presented the copy of the TCT given to me by __________.
However, upon perusal, the title was found to be dubious and of spurious
origin. As such, the Registry of Deeds caused the confiscation of said TCT.
Attached hereto and marked as ANNEX “C” is the copy of Certification and/or
Acknowledgment from the Register of Deeds;

5. By reason thereof, I am executing this affidavit with the intent of requesting


the Register of Deeds of Tarlac to cause the registration/annotation of this
adverse claim on TCT No. _________________ in the manner provided for by law
to protect my interest over the parcel of land covered by the said title and to
prevent any fraud that may be committed by __________________;

6. Finally, I am executing this affidavit to attest to the truth of the foregoing


statements and for whatever legal intents and purposes this may serve.
