By signing this form, I agree to comply with the gardening guidelines and rules established by the
Broadus Community Garden committee.
I understand that neither the Broadus Community Garden nor the Powder River Manor are responsible
for my actions. I THEREFORE AGREE TO HOLD HARMLESS THE BROADUS COMMUNITY GARDEN AND
POWDER RIVER MANOR FOR ANY LIABILITY, DAMAGE, LOSS OR CLAIM THAT OCCURS IN CONNECTION
WITH THE USE OF THE GARDEN BY ME OR ANY OF MY GUESTS.

RELEASE OF ALL CLAIMS
I, _____________________________________________, am a participant in the Broadus Community
Garden. As a condition of being allowed to participate in the Community Garden, I agree to the
following:
1. I am duly aware of the risks and hazards that may arise through participation in
the Community Garden and assume any expenses and liabilities I incur in the event of an accident,
illness or other incapacity. If I have had any questions about the community garden, its nature, risks or
hazards I have contacted the garden committee chairperson and discussed those questions with them to
my satisfaction.
2. In consideration of being granted the opportunity to participate in the Community
Garden, I, for myself, my executors, administrators, agents and assigns do hereby release and forever
discharge the garden committee, garden committee chairperson, volunteers, other gardeners and the
cooperating landowner from all claims of damages, demands, and any actions whatsoever, including
those based on negligence, in any manner arising out of my participation in this activity. I understand
that this RELEASE OF ALL CLAIMS means that among other things, I am giving up my right to sue for any
such losses, damages, injury or costs that may incur.
I represent and certify that my true age is either 18 years old or if I am under 18 years old on this date,
my parent or legal guardian has read and signed this form. I have read this entire RELEASE OF ALL
CLAIMS, fully understand it and agree to be legally bound by it.

Gardening Guidelines and Rules Agreement
GENERAL
1. I agree to pay a fee of $30.00 to reserve a full plot (16x8’) or a fee of $15.00 for a
half plot (8x8’) in the Community Garden.
2. I will not cause damage to another gardener’s plot and will only harvest from my
plot.
3. Family and friends are welcome to the garden! I will maintain control of any
guests, children or dogs (must be leashed) I bring to the garden, and I understand
that I am responsible for cleaning up after them or repairing/paying any damage
they may cause.
4. The garden area is open dawn until dusk, seven days a week but the gates
should always be closed.
5. I will pack out any trash I bring into the garden.
6. If I have any complaint about another plot or gardener, I will bring it to the garden
committee for resolution.
7. I will not grow marijuana or any illegal drugs in my plot.
8. I will dispose of weeds and plant materials in designated compost areas.
9. I will keep rocks out of the pathways and borders by putting them in the
designated spot.
10. If I must abandon my plot for any reason, I will notify the garden committee.
11. Garden plots are non-refundable.
PLANTING AND MAINTENANCE
1. If planting long-term crops (like trees, rhubarb, asparagus or raspberries), I will
work with the garden committee to confine these to an appropriate space.
2. I will be considerate of my neighbors by not planting sprawling crops or tall crops
that might interfere with others.
3. I will choose to mulch with leaves, grass clippings, or hay to reduce water
evaporation.
4. I will bring in and out my own gardening equipment.
5. I will keep weeds at a minimum and maintain my plot in the garden. If another
gardener files a complaint that my plot is unkempt, I understand I will be given 1 weeks’ notice to
clean it up. If it is not cleaned up at that time, it will be reassigned or tilled in.
6. I will volunteer my time for general maintenance to keep the garden site looking
good as the use of the site is contingent on the members’ ability to maintain it.
7. I will clean up my garden plot at the end of the season (vines, cornstalks, tomato
cages, etc.). Returning gardeners may reserve the same plots for the following year by notifying the
garden committee before plot assignment the next spring.
8. I will make sure all hydrants are off and hoses are neatly rolled up after use.
9. I understand that unattended watering is not allowed. Consequences will be
forfeiture of plot and only one warning will be given. Notify the garden committee of any leaks in the
water line.
FERTILIZER AND PESTICIDE USE
1. I agree to use fertilizers, insecticides or weed repellents according to their labels.
2. I will not use fertilizers, insecticides or weed repellents in a way that will affect other plots in the
garden. For the consideration of the other gardeners, I will not spray on a breezy day.
3. I will avoid the following persistent herbicides and pesticides: Malathion, Organophosphates,
Cyfluthrin, 2,4-D (dicholoro-phenoxyacetic acid), Chlopyralid (Confront), and Amenopyralids.
*Roundup and other glyphosate products may be used for early season weed control if applied
prior to annual seeding and planting.
