RENTAL
AGREEMENT
THIS AGREEMENT OF RENT IS MADE AND EXECUTED on this the 05th day of
December 2024 (05/12/2024), at Bangalore.
BY AND BETWEEN
SRI. SHANKAR A, residing at No.8, Vanya Nilaya, 1 st Cross, Phase 1, Subramanya
BCD Layout, Margondanahalli, Bangalore - 560036; hereafter referred to as the
"OWNER" which term shall where the context to admits, be deemed to include his legal
heirs, legal representatives, administrators, executors and assigns of the ONE PART.
AND
SMT. MAHESHWARI RAJ MUKUNTHARAJ , D/o. Mukuntha Raj K,
Residing at: #166, 7th Cross, Kadirappa Road, Cox Town, Doddigunta, Bangalore –
560005. Hereafter referred as the "TENANT" which term shall where the context
so admits, be deemed to include their respective legal heirs, legal representatives,
administrators, executors and assigns of the OTHER PART
WHERE AS the landlord is the sole and absolute owner of the FLAT bearing First
Floor, No.8, Vanya Nilaya, 1st Cross, Phase 1, Subramanya BCD Layout,
Margondanahalli, Bangalore - 560036, consisting of ONE (1) hall, TWO (2)
Bedroom , ONE (1) Kitchen, ONE (1) Common Bathroom & Toilet, more
particularly mentioned and described in the Schedule hereunder and hereafter also
referred to as the "Scheduled Property"
AND WHEREAS the Tenant negotiated with the Owner for the rent of the
Scheduled Property for the residential purposes for a period of 11 months on a
monthly rent of Rs. 15,000/- (Rupees Fifteen Thousand Only) Excluding Electricity
and water charges and advance of Rs.1,50,000/- (Rupees One Lakh Fifty Thousand
only) condition as here under.
NOW THIS AGREEMENT WITNESSETH BETWEEN THE PARTIES AS
FOLLOWS:
1. The lease is for a period of 11 months commencing from 5 th December 2024
To 31st October 2025, which may be executed for a further period of 11
months on terms and conditions mutually agreed upon by the OWNER and the
TENANT.
2. The LESSEE shall pay rent of Rs. 15,000/- (Rupees Fifteen thousand only) per
month on or before the 5th day of each succeeding month to the OWNER.
3. The TENANT shall pay the rents regularly and without default. In the event of
default on the part of the TENANT to pay the rents consecutively for a period
of 1 (ONE) month, the OWNER is entitled to recover the arrears of the rent
from the security deposit.
4. The TENANT today deposited with OWNER an interest free refundable
deposit of the Rs. 1,50,000/- (Rupees One Lakh Fifty Thousand only) by way
of cash, the receipt of which the owner hereby acknowledges.
5. The TENANT shall regularly pay all the outgoings in the nature of electricity
bills, water bills attributable to his usage of the scheduled property. The
TENANT's liability shall commence from this day or from the date of
occupation of the scheduled property, whichever is earlier and TENANT shall
not be liable for the dues in respect of the above or any other statutory dues to
be payable for any period before the date of this agreement, which shall be the
sole responsibility of the OWNER.
6. That the OWNER & TENANT shall be entitled to terminate the lease upon
giving 30 (Thirty) days prior notice in writing, In case of termination by the
TENANT, the OWNER agrees to refund to the TENANT the security deposit
in full against vacant possession of the demised premises.
7. The TENANT shall use the Scheduled property exclusively for residential
purpose and shall not sublease or sublet the building premises and they should
not allow third parties to occupy and stay in the scheduled premises.
8. The TENANT should not cause any nuisance to the other tenants.
9. The OWNER shall bear and pay all property taxes and rates and case payable
to the appropriate authorities and shall keep the premises free from all
interferences in this behalf.
[Link] TENANT shall not make any structural alterations or additions or
modification either temporary or permanent and keep the building premises
without causing damage and shall not use the premises for any objectionable
or offensive trade or business.
12. The TENANT shall pay an increment of 5% of the rent in case both TENANT
and OWNER agrees to continue the Rental period after 11 months from the day
of this agreement.
13. The TENANT shall permit the OWNER to inspect the schedule premises at
reasonable hours and reasonable intervals of time upon 48 hours prior notice
given.
14. The TENANT shall pay the rent regularly and without default, in the event of
default on the part of the TENANT , to pay the rents consecutively for a period
of TWO (2) months The OWNER shall be entitled to terminate the TENANT
and adjust the dues from the security deposit and in that case the TENANT will
be liable to vacate the scheduled premises.
15. Upon termination of this agreement the OWNER shall refund to the TENANT
the interest free refundable deposit of Rs. 1,50,000/- (Rupees One Lakh Fifty
Thousand only) there on before taking back vacant physical possession of the
scheduled property. The OWNER shall be entitled to adjust from the security
deposit, any amount such as unpaid rent. dues towards electricity. painting
charges or damages of the scheduled property.
16. The TENANT violates any of the terms and conditions of this agreement the
OWNER will be entitled to terminate this agreement, and TENANT will be
liable to vacate the premises forthwith.
SCHEDULED PROPERTY
All the piece and parcel of the FLAT bearing No.8, Vanya Nilaya, 3 rd Floor, 1st
Cross, Phase 1, Subramanya BCD Layout, Margondanahalli, Bangalore -
560036with electricity and water connections.
IN WITNESS WHEREOF the lessor and lessee have hereby said their hands. on the
day. month and year first herein above written.
