Schedule 2 - Provisions relating to the emoluments, allowances, and privileges of constitutional authorities

Articles Covered: Article 59, 65, 75, 97, 125, 148, 158, 164, 186, and 221

Schedule 2 is divided into 8 Parts:

Part A - President and Governors (Art. 59, 158)

- Covers emoluments, allowances, and privileges of the President and Governors.

- Cannot draw salary from any other source.

- Salary cannot be reduced during term.

- Charged on Consolidated Fund of India (President) and State (Governor).

Part B - Speaker, Deputy Speaker of Lok Sabha, Chairman, Deputy Chairman of Rajya Sabha, Speakers of

State Assemblies (Art. 97, 186)

- Salaries and allowances of Presiding Officers of Parliament and State Legislatures.

- Determined by Parliament or respective State Legislatures.

Part C - Judges of Supreme Court and High Courts (Art. 125, 221)

- Covers salary, leave, pension, and conditions of service.

- Cannot be altered to their disadvantage after appointment.

Part D - Comptroller and Auditor-General of India (CAG) (Art. 148)

- Salary, service conditions, and pension.

- Salary charged on Consolidated Fund of India.

Part E - Union Ministers (Art. 75)

- Salaries of Prime Minister and Union Ministers.

- Decided by Parliament and charged on Consolidated Fund of India.

Part F - State Ministers (Art. 164)

- Salaries of Chief Minister and State Ministers.

- Decided by State Legislature and charged on Consolidated Fund of State.

Part G - Members of Parliament (MPs) (Art. 106)

- Salaries and allowances of MPs.

- Decided by Parliament.

Part H - Members of State Legislatures (MLAs & MLCs) (Art. 195)

- Salaries and allowances of MLAs and MLCs.

- Decided by State Legislatures.

Important Points:

- Salaries of President, SC Judges, and CAG cannot be reduced during their term.

- Salaries of MPs and MLAs are decided by respective legislatures.

- Consolidated Funds: President, PM, MPs (India); Governor, CM, MLAs (State).

Purpose of Schedule 2:

- Ensures independence of constitutional functionaries.

- Maintains separation of powers.
