This is related to enhancement of the fees for various services rendered
under the Legal Metrology Act, 2009 to the traders, businesses and other
concerned government/semi-government establishment as prescribed under the
Andaman and Nicobar Islands Legal Metrology (Enforcement) Rules, 2011
framed under the Legal Metrology Act, 2009.
The department of Legal Metrology ensures in measurement used in trade
and commerce, protecting both consumers and businesses. It enforces
standards for weights and measures, regulate pre-packaged commodities and
conduct inspections to prevent fraud. This includes, verifying and stamping of
measuring instruments, as well as ensuring proper labeling and net quantity
declaration on packaged goods.
Since the last revision, Andaman and Nicobar extraordinary gazette issue
56/2016/F.No: DCS/LM/69/Revenue/2015 dated 12 th August 2016, a considerable
amount of time has passed and several factors necessitate an update to the fee
structure. There has been several fold increase in merchants, shops and
businesses. There is a need to revise the fees in view of inflation and rising
costs. Further, the fee hike might be used to improve the services provided.
It is to mention herein that Section 53(1) & (2) of the Legal Metrology Act,
2009 empowers the State Government to make rules. The same is reiterated
below:
Section 53: Power of State Government to make rules
(1) The State Government may, by notification and after consultation with the
Central Government, make rules to carry out the provisions of this Act.
(2) In particular and without prejudice to the generality of the foregoing power,
such rules may provide for all or any of the following matters, namely:
(a) the time within which the weight or measure may be got verified under
proviso to sub-section (1) of section l6:
(b) registers and records to be maintained by persons referred to under sub-
section (1) of section l7;
(c) the form, manner, conditions, period, area of jurisdiction and fees for
issuance of licence under sub-section (2) of section 23;
(d) fee for verification and stamping of any weight or measure under sub-
section (24)
(e) manner of notifying Government Approved Test Centre, terms and
conditions and fee to be paid under sub-section (3) of section 24:
(f) fee for compounding of offences under sub-section (1) of section 48:
In the first instance, the file may be forwarded to the Law Department of the
Administration for vetting of the proposal.
