3. That the dimensions as per site/valuation report mentioned above are true and correct if any
consequences arise due to above changes I shall be liable for the same and bank can take possession
over the property in question under SARFAESI ACT, 2020.
4. That in case of I failed to adhere the financial discipline and norms of the bank, the bank shall be at
liberty to recover its dues by selling the captioned property under section 13(2) of the securitization &
reconstruction of financial assets and enforcement of security interest act, 2002.
5. That I shall abide by all the terms & conditions of the bank.
6. That the documents supplied by me before the advocate regarding my title in Above mentioned
property are genuine documents and in case any defect or tempering is found in the Title/Sale,
Jamabandies. I shall be fully responsible for the same and if anything found is incorrect, wrong of
forget in my above said property document then Bank/Advocate may get the registration of FIR U/s
463/464/467/468 IPC against me or my Associate found then the bank would I have every right to
initiate criminal proceedings against me.
7. That I deponent undertakes to indemnity the bank for any loss/harm or injury caused to bank due to
miss match of areas of land, boundaries & dimensions.
8. That now I intend to deposit the title deed of above said property with ICICI Bank ltd ………..., with
an intention to create an equitable mortgage on the same as security for the limit granted to me.
9.That the property mentioned above is outside Muncipal Corporation limits but the said property is a
non- agriculture property . All the condition regarding regularization have been compiled with by the
deponent and further deponent undertakes to pay any charged levied by the Government from time to
time regarding the property in question.
10. That all the documents pertaining to the above said property are genuine and valid documents.
11. The property is neither been acquired nor is the subject matter of any acquisition proceedings. No
notice or notification has been issued by any Government / Semi Government Authority or Department
or Corporation for the purpose of acquiring the above said land or any such notice or notification has
ever been received ever been received by the deponent till date.
12. If the deponent make any default in the payment of the dues to Company, then the company will be
at liberty to take action against the deponent and the property under the securitization and
reconstruction of financial assests and enforcement of Security Interest Act. 2002 including taking of
the possesion and selling of the above said property.
13.Further, I/We declare that I/We will not transfer/sell any part/ portion of the said property without
taking written consent of the lender.
