OFFICE OF THE SANGGUNIANG BAYAN

EXPLANATORY NOTE
WHEREAS, Article II, Section 13 of our Constitution of 1987 mandates the State
recognition of the vital role of the youth in nation-building and promotion and protection of
their physical, moral, spiritual, intellectual and social well- being and states further its role
to inculcate in the youth patriotism and nationalism, and encourage their involvement in
public and civic affairs;
WHEREAS, Presidential Decree 603 or The Child and Youth Welfare Code expresses
that · the child and youth are one of the important assets of the nation, thus, every effort
should be exerted to promote their welfare and enhance opportunities for a useful and
happy life;
WHEREAS, Republic Act 8044 otherwise known as the "Youth in Nation Building
Act of 1995" creates the structures to implement a comprehensive and coordinated
program for the youth and gives recognition to the youth's
Responsibility in fulfilling their vital role in nation-building;
WHEREAS, Republic Act No 10742 also known as the Sangguniang Kabataan Reform
Act of 2015 has introduced innovations such as the institutionalization of a local youth
development council, creation of a youth affairs office, establishing mandatory trainings
and providing an anti-political dynasty provision among others;
WHEREAS, the development and welfare of the youth sector in the Municipality of
Bobon in terms of promotion of their well-being and total development, and their
protection from exploitation, abuse, hazards, and other circumstances prejudicial to
their physical, mental, intellectual, emotional, social and moral development are utmost
priorities;
WHEREAS, in the Municipal pursuit for progress and development, the youth
sector must be fully assimilated in the mainstream so as to ensure an improved
quality of life and a youth-friendly environment where there are guarantees for
educational opportunities, economic privileges, civil and political rights;
WHEREAS, to further realize these development approaches for the
municipality youth constituents an ordinance shall be enacted by the Sangguniang Bayan
for this purpose.

MUNICIPAL ORDINANCE 2025-__

AN ORDINANCE PROVIDING FOR A COMPREHENSIVE YOUTH WELFARE AND


DEVELOPMENT CODE IN THE MUNICIPALITY OF BOBON, INSTITUTIONALIZING
FUNDS THEREOF AND FOR OTHER PURPOSES.

ARTICLE I
Title, Policy, and Definition of Terms

SECTION 1. Title. This ordinance shall be known as the "Municipal Youth Welfare and
Development Code."

SECTION 2. Declaration of Policy.


a) The Municipal Government recognizes the vital role of the youth in nation-
building and shall promote and protect their physical, moral, spiritual,
intellectual, a n d mental. emotional and social well-being and shall inculcate in
the youth patriotism and nationalism, and encourage their involvement in public
and civic affairs;
b) The Municipal Government shall establish adequate, effective, responsive and enabling
mechanism and support systems that will ensure the meaningful
participation of the youth in local governance and nation building;
c) The City Government recognizes the vitality of youth involvement in the
decision making process on various issues affecting them and towards this end,
shall ensure adequate and meaningful participation be afforded to them in both
executive and legislative functions; and
d) The City Government recognizes the important role of the private youth
organizations composed of various sectors and shall ensure that a rights based
and economic based approach in development be integrated in the various
processes and regulations of the city.

SECTION 3. Definition of Terms. When used in this ordinance, the following words shall mean: /
a) Adult Youth - shall include all youth whose ages range from 25-30 years;
b) Child Youth - shall include all youth whose ages range from 15-1 7 years;
c) Commission - shall refer to the National Youth Commission or NYC whose
main responsibility is to formulate policies, plan, implement, and oversee a
national integrated youth promotion and development program;
d) Community-based Youth organization - refers to non-profit organizations that
service a local community needs through volunteers, sponsorships, and
donations;
e) Core Youth - shall include all youth whose ages range from 18-24 years;
f) Council- shall refer to Local Youth Development Council or
LYDC;
g) DILG - shall refer to the Department of Interior and Local Government;
h) Faith-based Youth Organization - shall refer to a youth organization or youth-
serving organization whose membership belongs to a certain religion or sect or
religious belief;
i) GIP - shall refer to Government Internship Program;
j) In - School Youth - refers to all youth of school age, whether organized or not,
presently enrolled with any educational, vocational institution which include but
not limited to the following school organizations (academic or non-academic),
student government, fraternities and sororities;
k) Out-of-School Youth - refers to all youth of school age, whether organized or not,
who are unable to avail formal school system or who have dropped out from all
levels of formal and informal education;
I) Political Rights - are those rights which provide the youth the freedom to express
themselves on matters affecting their lives;
m) School - Based Organization - refers to a youth or youth - serving organization
whose membership are students belonging to schools, universities or colleges
legally recognized by the state;
n) AYLA- shall refer to Agta Youth Leadership Awards;
o) LYDC - shall refer to Local Youth Development Council;
p) LYDO - shall refer to Local Youth Development Office;
q) LYDP - shall refer to Local Youth Development Plan;
r) Working Youth - shall refer to all youth whose ages range from 18-30 years who
are employed either on a regular or temporary basis;
s) YORP - shall refer to Youth Organization Registration Program;
t) Youth - as defined in Republic Act 8044 otherwise known as The Youth in Nation
Building Act of 1995, and for the purpose of this Code, it shall refer to those persons
whose ages range from fifteen (15) to thirty (30) years old;
u) Youth Advisory Council - refers to the body who shall oversee and monitor all
programs of LYDC;
v) Youth Development Officer - refers to the person duly appointed or designated by
the local chief executive to serve as its agent in the city with the task provided for
in this ordinance or as may deemed necessary;
w) Youth - Serving Organization - refers to registered, recognized, and accredited
organizations whose primary objectives, programs and projects are youth-related
and youth-oriented, and whose composition are not limited to the youth;
x) Youth Organization - refers to any organization whose members are youth aged
15 to 30 years old; and
y) Youth with Special Needs - refers to those youth who are suffering from restriction
or different abilities as a result of a mental, physical, or sensory impairment to
perform an activity in the manner or within the range considered normal for a
human being.

ARTICLE II
Guiding Principles and Duties of the Youth

SECTION 4. Guiding Principles. Every Bobonanon Youth shall be entitled to the rights herein
set forth without distinction as to gender, social status, religion, political antecedents, and
other factors:
a) Every youth has the right to be informed of his inherent rights as stipulated in the
Constitution and other related laws:
b) Every youth has the right to bodily integrity and to the means necessary for the
proper development of life, particularly food, clothing, shelter, medical care, rest,
and the necessary social services;
c) Every youth has the right not to be discriminated, intimidated, abused, bullied or
humiliated despite of race, gender, ethnicity, belief, religion, and social standing;

d) Every youth has the right to quality and responsive education from nursery to
tertiary level, incorporating therein multicultural and multilingual curricula;
e) Every youth has the right to freely and fully participate in the political processes
and affairs of his/her community and country;
f) Every youth has the right to economic development based on the precepts of
justice and equity;
g) Every youth right is coupled with a moral and legal obligation that must be fulfilled;
h) Every youth has the right to exercise freedom of religion and be respected in
his/her own set of beliefs;
i) Every youth has the right to a decent job at a livable wage and provided with
other additional compensations and benefits provided by laws; and Every youth
is entitled to a mentally and emotionally healthy environment
SECTION 5. Duties of the Youth. Every Bobonanon Youth regardless of the circumstances
of his/her birth, sex, religion, social status, political antecedents, and other factors shall:
a) strive to lead an upright and virtuous life in accordance with the tenets of his/her
religion, the teachings of the elders and mentors, and the biddings of a clean
conscience;
b) love, respect and obey his/her parents, and cooperate with them in the
strengthening of the family;
c) if by reason of his/her studies or for other causes he/she does not live with his
parents, the latter shall communicate with him/her regularly and visit them as
often as possible;
d) extend to his/her brothers and sisters his/her love, thoughtfulness, and
helpfulness, and endeavor with them to keep the family harmonious and united;
e) exert his/her utmost effort to develop his/her potentialities for service, particularly by
undergoing a formal education suited to his/her abilities, in order that he/she may
• become an asset to himself and to society;
f) respect not only his/her elders but also the customs and traditions of our people, the
memory of our heroes, the duly constituted authorities, the laws of our country,
and the principles and institutions of democracy,
g) participate actively in c1v1c affairs and in the promotion of the general welfare,
always bearing in mind that it is the youth who will eventually be called upon to
discharge the responsibility of leadership in shaping the nation's future; and
h) help in the observance of individual human rights, the strengthening of freedom
everywhere, the fostering of cooperation among nations in the pursuit of their
common aspirations for programs and prosperity, and the furtherance of
world peace.

ARTICLE III
LOCAL YOUTH DEVELOPMENT COUNCIL

SECTION 6. Creation. To ensure wide and multi-sectoral youth participation in local


governance, there shall be a creation of Bobon Local Youth Development
Council (BLYDC) which shall be headed by the concerned SK Federation President,
co-chaired by the SK Federation Vice President and is composed of at least ten (10)
but not more than nineteen (19) youth and youth-serving organizations. The BLYDC
shall assist in the planning and execution of projects and programs of its member
organizations, the SK, and the Pederasyon;

A. Composition of the LYDC. The LYDC shall be composed of 21 members including


the 2 core members from the SK. The two (2) core members shall be composed of the
president and the vice-president of the Pederasyon and shall be supported by 19
other representatives from the various youth sectors - two (2) from Education; two (2)
from Environment; two (2) from Health; two (2) from Peace Building and Security;
two(2) from Governance; two (2) from Global Mobility; two (2) from Social Inclusion and
Equity; two (2) from Economic Empowerment; and three (3) from Active Citizenship

Chairperson : SK Federation President


Vice-Chairperson : SK Federation Vice-president
Members: : Eighteen (18) elected youth organizations and youth-
serving organization
Secretariat: : Municipal Local Youth Development Officer

B. Functions. The LYDC Officers and Members shall perform the following functions:
The Council Chairperson shall:

1. Serve as the primary spokesperson of the BLYDC;


2. Bear primary responsibility for the execution of all BLYDC directives;
3. Determine the agenda of the meetings;
4. Preside the meetings of the BLYDC;
5. Vote only in the event of a tie;
6. Keep the Council Officers apprised of all current business; and
7. Keep the Council members updated on all relevant issues.

The Council Vice-chairperson shall:

1. Assist the Council Chairperson in the fulfilment of his or her duties;


2. Assume the role of Council Chairperson in the event of the resignation,
Impeachment, removal or ineligibility;
3. Have explicit knowledge of all youth-related laws, resolutions, and
ordinances;
4. Represent the BLYDC and council members at relevant committee
meetings that are not attended by the Council Chairperson; and
5. Attend any committee meetings that the President is required to attend but
is unable to.

The Council Secretariat shall:


1. Handle the administrative and technical activities of the council;
2. Supervise, direct, and monitor the council implementation of
approved policies, plans, and programs; and
3. Perform other functions as may be provided by RA 10742

C. General Duties and Functions of the LYDC. The LYDC shall discharge the following duties
and functions:

1. Serve as the core of the advocacy on the nine (9) centers of youth participation in
nation-building and youth empowerment;
2. Finalize the five (3) Local Youth Development Plan that is anchored in the PYDP and
the development plans in the City of Tagum;

The Local Youth Development Plan shall be initially drafted by the respective SK
Pederasyon and shall be finalized by the LYDC. This shall be submitted to the Local Chief
Executive for inclusion in the Local Development Plan and Annual Investment Plan (AIP)
subsequently endorsed to the Sangguniang Bayan. These plans shall give priority to
programs projects and activities that will promote and ensure meaningful youth
participation in nation building, sustainable youth development and empowerment,
equitable access to quality education, environmental protection, climate change
adaptation, disaster risk reduction and resiliency, youth employment and livelihood, health
and anti-drug abuse, gender sensitivity, social protection, capability building and sports
development;

3. Monitor and evaluate the implementation of the Municipal Local Youth Development
Plan;
4. To formulate, adopt, and prescribe policies, guidelines, and rules and regulations that
will guide the Municipal Planning and Development Office and City Budget Office for
the smooth operation of the LYDO and LYDC;
5. To formulate and approve the internal rules and regulations of the Council including
policies addressing representation, substitution, absence and delinquency of council
members; and
6. Perform such other functions as may be provided by law or ordinances.

D. Qualifications of the Members of the LYDC. A member of the LYDC must be a


citizen of the Philippines, a resident of Tagum City for not less than one year
immediately preceding the day of her/his election to the TCLYDC. She/he should be
at least 15 years, but not more than thirty (30) years of age on the day of his/her
election to the council, able to read and write, Filipino, English, or the local dialect and
must not have been convicted by final judgment of any crime involving moral
turpitude:

1. Manner of Election. The LYDO shall notify all the presidents or


authorized representatives of the registered and accredited youth
organizations and youth-serving organizations in the city, assemble them
in a public venue, and by consensus or secret balloting per youth sector.
These representatives shall serve for a term of three (3) years as
members of the LYDC;

2. Convening of the LYDC. The Vice-Chairperson may call a meeting.


The SK Pederasyon President, or in his/her absence, the Vice-
Chairpersons shall initially convene the council and shall be given
preference to preside over the meeting;

3. Meetings and Quorums. The LYDC shall schedule a meeting every


quarter, or as often as needed. However, if the President, and the Vice
President of the SK Pederasyon fails to convene the LYDC as
scheduled, at least one third of the total membership of the TCLYDC
may call for a meeting. In both instances, a written notice shall be sent
either through traditional or non-traditional means, to all members setting
the date, time, place, and agenda of the meeting which must be received
at least two (2) days in advance; and the presence of the majority
(50% + 1) of all members of the LYDC shall constitute a quorum.

SECTION 7. Suspension and Removal from Office. Any elected LYDC


members may, after due process, be suspended for not more six (6) months
or removed for any of the following grounds:
a. Three (3) consecutive absences of quarterly meetings without justifiable cause;
b. Non-participation in 50% of all TCLYDC programs and activities;
c. Failure to comply accreditation requirements and accomplishment
reports set by the Tagum City Local Youth Development Office;
d. Failure to perform official duties and functions as a council member;
e. Commission of any offense involving moral turpitude or any offense
punishable by law; and
f. Commission of any violation cited in the Internal Rules and Procedures.

In the case of suspension and removal of the Council Chairperson


and External Vice Chairperson, the DILG-COMELEC-NYC Joint Memorandum
Circular No. 2017-01 shall apply.
SECTION 8. Forms of FIiing Complaints. Any complaint against any
council members shall b initiated only by any member of the council and
shall be filed before the grievance committee.

a. Grievance Committee. There shall be a grievance committee


that shall establish an orderly method for handling complaints and
disputes within the TCLYDC members.

I) Composition. The grievance committee shall have the following


compositions;

Chairperson - Local Chief Executive

Vice-chairperson -SB Committee Chairperson on Good Government.


Public Ethics, and Investigation

Members: - DILG DIRECTOR


- LEGAL OFFICER
- SPIRITUAL, AND VALUES EDUCATION
SECTION HEAD

Secretariat - LOCAL YOUTH DEVELOPMENT OFFICER

II) Duties. Members of the grievance committee shall have the following duties:
III) The Grievance Committee shall meet at the direction of the chair,
most usually when the chair has been notified of a grievance that
should be heard;
IV) The chair of the Grievance Committee shall communicate the
results of its decisions in writing to the members of the Tagum City
Youth Development Council;
V) The Internal Rules and Procedure (IRP) of the Local Youth
Development Council which shall be the basis of the Grievance
Committee must be approved by the LYDC on the first meeting of
every term; and
VI) The decision of the grievance committee shall be in accordance with
existing laws, policies and regulations.

SECTION 9. lnstitutionalization of Barangay Youth Development


Council. In every barangay, there shall be a youth development council
which shall be headed by the respective Sangguniang Kabataan
Chairperson to ensure multi-sectoral youth participation in every
barangay.

SECTION 10. Bobon Local Youth Development Plan. - A


comprehensive plan for the youth formulated by the Local Youth
Development Council in consultation with the Sangguniang Kabataan,
youth groups, other government agencies, private sectors, and non-
government organizations. Incorporated herein are the following, among
others:
a) Formulation, approval and implementation of the Local Youth
Development Plan for the Bobonanon youth for a period of three
(3) years and shall be reviewed and formulated a year before
the end of its duration; and
b) Programs and interventions on youth participation in sports;
culture and the arts; leadership programs, locally, nationally and
internationally; youth engagement in productive employment,
education, livelihood services, cultural exchange, benchmarking
and in gender development by laying down the necessary
mechanisms and frameworks for policy direction, innovation and
convergence.

SECTION 11. Local Youth Congress. The Council shall convene a local youth
congress or conduct consultations with the youth at least once a year to gather
information and data that shall serve as inputs in the formulation of the youth
development plan locality. The Council shall submit a copy of all resolutions,
declarations and proceedings of the local youth congress/consultations to the
Sangguniang Bayan for appropriate action.

Section 12. Youth Center. – The Council may establish a Youth Center which
shall be located in the Poblacion proper. The Youth Center shall operate as
multi-purpose center or a one-stop shop facility.

SECTION 13. Local Youth Assessment Study. A local study on the


"Progressive Monitoring and Situation of Youth in Tag um City,"
which identifies priority needs, prevailing attitudes and values of youth,
existing services and gaps in the delivery of services of basic youth needs,
which shall be done every five (5) Years thereafter;

SECTION 12. Funding. The TCLYDC programs, projects and activities shall
be funded by the City Government of Tagum subjected to Commission on
Audit (COA) rules, policies and regulations.

ARTICLE IV
Municipal Local Youth
Advisory Council
SECTION 13. Creation. An Advisory Council shall be created to supervise
and monitor the operation of the LYDC.

SECTION 14. Composition. The following shall be the members of the


Municipal Youth Advisory Council which shall shed light and advise the
body on pertinent issues affecting the youth:

LYDC Vice Chairperson

Head Secretariat: City Local Youth Development Officer;

Upon the approval of this ordinance, the local chief executive shall issue an
executive order stating specific names, and functions thereof.

SECTION 15. Roles and Responsibilities. The Tagum City Local Youth
Advisory Council shall\/ perform the following, to wit:
1. Review the operation plans and budget of the Council;
2. Provide reports and updates on all youth-related affairs and
activities, including but not limited to plans, programs and projects
intended for the youth sector of the city;
3. Coordinate with and recommend to the City Local Youth
Development Council strategies of implementation for a short,
medium, and long-term youth development programs and activities
of the city; and
4. Recommend to the City Local Youth Development Council the
programs, projects, and activities (PPAs) for the youth based on the
consolidated felt needs as discussed in the advisory council.

SECTION 16. Meetings. The Council shall meet once in every three (3)
months or as often as maybe necessary, upon the call of its Chairperson or
majority of its members, on important matters relating to youth affairs,
welfare and development. The Tagum City Local Youth Development
Office shall serve as the Secretariat and shall provide technical support to
the council.

ARTICLE V
Bobon Youth Development Office

SECTION 17. Creation. There shall be a Local Youth Development Office


in the Municipality of Bobon.
a) Qualifications of the Local Youth Development Officer. In addition
to the requirements prescribed by the Civil Service Commission and
reasonable standards set by the Human Resource Office, the Youth
Development Officer and other staff of the office must meet the
following qualifications:
1. be a Filipino citizen;
2. be of legal age at the time of the appointment;
3. be preferably not more than thirty years of age at the time of
his/her appointment;
4. be of good moral character;
5. have acquired experience in youth development affairs or
involvement in youth or youth-serving organizations for at least
three (3) years; and
6. shall be appointed by the Local Chief Executive, but in no case
is he or she be within the fourth civil degree of consanguinity
or affinity of the appointing authority.

b) Functions of the Local Youth Development Officer. The functions


of the LYDO shall include the following:

a. In accordance with Section 24 (d) of the Rules and Regulations


Implementing R.A. No. 10742, otherwise known as the Sangguniang
Kabataan Reform Act of 2015, register and verify youth organizations
and youth-serving organizations (Subject to the Revitalized Youth
Organizations' Registration Program (YORP) guidelines);
b. Provide technical assistance to the DCYDC in the formulation of the
Davao City Youth Development Plan;
c. Facilitate the election of the DCYDC representatives;
d. Serve as Secretariat to the DCYDC;
e. Conduct the mandatory and continuing training of SK Officials and
DCYDC members in accordance with the programs jointly designed and
implemented by the National Youth Commission (NYC) and the DILG.
The DCYDO and/or his or her staff shall apply for accreditation from the
NYC in order for them to conduct the mandatory and continuing training
programs of SK officials and DCYDC members;
f. Provide technical, logistical and other support in the conduct of the
mandatory and continuing training programs, and such other programs of
the NYC and DILG;
g. Coordinate with the NYC with regard to youth programs within their
jurisdiction; and,
h. Perform such other functions as may be prescribed by law, ordinance,
or as the Local Chief Executive, the DILG, or the NYC may require.

SECTION 18. Accreditation/Registration. Only those youth and youth-serving


organizations which exist in the City of Tagum shall be accredited by the
accreditation committee.

a. Local Registration of Youth Organization and Youth - Serving


Organization. All youth organization and youth - serving
organizations, with a minimum of active ten (10) members in good
standing and which are operating in Tagum City shall be registered
in the Tagum City Local Youth Development Office;

b. Local Verification of Youth Organization and Youth - Serving


Organization. The Tagum City Local Youth Development Officer shall
verify the registration information provided by these organizations. The
officer shall then send a list of registered and verified youth
organizations and youth - serving organizations to the National Youth
Commission or NYC;

c. Requirements for Registration and


Accreditation. The requirements for
accreditation/registration to the Council are as follows;
1. Letter of application;
2. Duly accomplished application form for accreditation;
3. Resolution signifying intention for accreditation;
4. Recommendation letter from the Local Chief Executive
and/or head from the attached national, regional,
provincial or local line agencies or organization;
5. Notarized Constitution and By-Laws;
6. List of current officers and members with their residential mailing
addresses:
7. Annual accomplishment report for the immediately preceding year;
8. Financial statement for the previous year prior to the
application of accreditation; and
9. Latest minutes of the general assembly.

To assist the youth organizations in their accreditation, the TCLYDO


shall provide accreditation forms to interested applicants for the first
year of implementation of this
accreditation/registration. All documents should be forwarded to and
received by
the Accreditation Committee.

d. Renewal, Verification and Continuing Local Registration.


Registered youth and youth serving - organizations shall renew their
local registration and verification every three years. The TCLYDO
shall conduct a continuing registration procedure taking into
consideration the budgetary and manpower requirements and the
presence of youth and youth-serving organizations;

e. Condition Precedent. Local registration and verification of youth


organization and youth - serving organization is a condition

precedent for participation in the TCLYDC elections. However, if a


youth organization or youth-serving organization is denied local
registration and verification, such organization can apply for special
registration and verification to the National Youth Commission as
provided for by law. Such special registration and verification entitle
the organization to participate in the TCLYDC elections;
