Petition for dissolution of marriage on mutual consent


under section 13(B) of Hindu Marriage Act 1955.

The humble petition of the above name petitioners Most


Respectfully SHEWETH:
1. That the petitioners are Hindu by faith and religion.

2. That the marriage in between the petitioners was


solemnized on 19/05/2010 according to Hindu Rites and
Customs performing all ceremonies for a valid Hindu

marriage at the house of 2nd petitioner’s father, within
the jurisdiction of this court.

3. That after their marriage the second petitioner went her


matrimonial house i.e. Vill.- GADIGHAT, P.O.- DASPUR,
P.S.- DASPUR, DIST.- PASCHIM MEDINIPUR, and used to
live there as husband and wife and the marriage was duly
consummated.

4. That out of their wedlock one female child namely-


Chaitali Laru who was born on 12/04/2012 and is under
care and custody of petitioner no. 2 / mother in that
matter the petitioner no. 1 has no objection and if the
petitioner no. 1 desires to see his daughter, he can do so
and the petitioner no. 2 shall arrange the same.

5. That the matrimonial dispute arises in between the


petitioners due to different temperament, nature, taste
and they could not adjust to each other and have been
living separately at her father’s house at above
mentioned house.

6. That the parties have not been able to live together due
to estrangement to between the parties despite our best
efforts to the parties to adjust to each other.

7. That the matrimonial ties in between the petitioners are


irretrievably broken and petitioners are unable to live
under the same roof and finally decided to leave
separately on mutual consent.

8. That on 20/04/2023, petitioner no- 2 went to her father’s


house on mutual consent and the parties have been living
separately from each other and there has been no
cohabitation between them and since 20/04/2023 the
Petitioner no- 2 has been living in her father's house at
above mentioned address.

9. That well-wisher of the both of the family tried to solve


the matter amicably but all attempts are in vain.

10. That there is no chance to reconciliation between the
parties in future.

11. That since 20/04/2023 the petitioners have been living


separately for more than 01 (one) year and the parties
have agreed that their marriage should be dissolved by a
decree of divorce on mutual consent.

12. That the petitioner for dissolution of marriage is bona-


fide.

13. That the petition for dissolution of marriage is not file in


Collusion between the parties and is not a result of any
fraud, force, and threat, or under influence.

14. That cause of action arose on and from and 20/04/2023


when the petitioner decided to leave separately on
mutual consent.

15. That the parties to the marriage last resided together


with the total limits of the jurisdiction of this court.

16. That fixed court fee of rupees 100 is being paid.

17. That the application is made bonafide and for end of


Justice.

In the above facts and circumstances, it is humbly prayed


that your Honour may graciously be pleased to pass a
decree of divorce on mutual consent under section 13(B)
of Hindu Marriage Act 1955.
And for which act of kindness the first petitioner and
second petitioner as in duty bound shall ever pray.

that the statements made above are true to the best of my

follows.-

1. That I am the 1st Petitioner of this suit and I am well


conversant with the facts and circumstances of this case
