PRAYER :- Writ Petition, filed under Article 226 of the Constitution of


India, praying this court to issue a Writ of Mandamus directing the 2nd
respondent herein to issue Hindu ST Kattunayakkan Community

ORDER

(Order of the Court was made by [Link] BANU, J.)

The writ petition has been filed for a Mandamus directing the 2nd

respondent herein to issue Hindu ST Kattunayakkan Community

Certificate to the petitioner's school going children namely [Link]

and [Link] Baskaran on the basis of the community certificate issued

to the petitioner vide Certificate No.173193 dated 07.02.2011 within a

stipulated time by this Court.

2. By consent of both sides, the writ petition itself is taken up for

final disposal at the stage of admission itself.

3. The case of the petitioner is that he belongs to Kattu Nayakkan

community, which is coming under the category of Scheduled Tribe. The

petitioner and his sisters and brother were issued with Kattu Nayakkan

Community certificate. In the year 2023, he applied community

certificate to his children, who are pursuing their school studies. Though

the petitioner had applied for community certificate for his children, the

same was not issued. In the meanwhile, the 1st respondent has called the

petitioner for an enquiry and the petitioner has also attended on

13.11.2024. Not being satisfied with the documents submitted by the

petitioner, the 1st respondent again called the petitioner for an enquiry on

03.02.2025, vide proceedings dated 31.01.2025. Though the petitioner

has got the relevant community certificate, the respondents have not

issued the same to his children and hence, the petitioner is before this

Court with this writ petition.

5. The learned counsel for the petitioner would submit that since

the petitioner/father is having the certificate, there is no impediment for

the respondents to issue the community certificate to his children.

However, after conducting enquiry about the genuineness of the

certificate, the respondents have not issued the certificate so far. Hence,

prays for appropriate direction.

6. Heard the learned counsel for the petitioner and the learned

Additional Government Pleader for the official respondents.

7. Since the petitioner and his siblings belong to ST Kattu

Nayakkan community and the petitioner being the father is also having

the certificate, there is no impediment for the respondents in issuing the

community certificate to the children of the petitioner. Hence, the

respondents are directed to issue the community certificate to the

petitioner's children within a period of four weeks from the date of

receipt of a copy of this order.

8. With the above direction, the writ petition is disposed of. No

costs.
