WHEREAS the Settlor is desirous of creating a Trust solely for earning Charitable aims and objects
which are more particularly set out hereinafter and wide enough for the extension of the benefits to all
human beings irrespective of class, creed or religion and including relief of the poor, education, medical
relief and the advancement of any other object of general public utility and so that such benefits may be
given directly by the trust or through other charitable institutions;
AND WHEREAS with that end in view the SETTLOR proposes to initially settle upon the Trust a sum of
Rs. 1,001/- (Rs. One Thousand One Only) in cash;
AND WHEREAS the Trustee have agreed to become the first Trustee of these presents and take upon
themselves duties and obligations of this Trust as is witnessed by their executing this Deed. NOW,
THEREFORE, THIS INDENTURE WITNESSETH as follows1) For effectuating the said desire and in consideration of the premises the Settlor doth hereby
declare that she has prior to the execution of these presents handed over to the Trustees the sum
of Rs. L00Y/- (Rs. One Thousand and One only) and all the estate , right , title, interest,
Property, claim and demand whatsoever at law and equity of the Settlor into and upon the said
money and every part thereof TO HAVE HOLD, RECEIVE AND TAKE the same unto the
‘Trustees upon the trust and with and subject to the powers, provisions, agreements and
declarations hereinafter appearing and contained of and concerning the same.
2) The Trustees do hereby declare that. they the Trustees shall hold and stand possessed of Rs.
1,001/- (Rs. One Thousand and One only) (hereinafter for brevity's sake referred to as "THE
TRUST FUND") which expression shall unless repugnant to the subject or context also include
any other property and investments of any kind whatsoever into which the same or any part
thereof may be converted, invested or varied from time to time and such as may be acquired by
the Trustees or come to their hands by virtue of these presents or by operation of law or
otherwise, however, in relation to these presents including all contributions , additions,
accumulations, accretions and donations either in cash or kind or other properties movable or
immovable or otherwise, howsoever, which may hereafter be received by the Trustees or made to
the same from time to time for the purposes of these presents and or conversion or conversions
thereof and/or any other investment or investments in which the same may from time to time be
invested upon the Trusts and which are subject to the powers, provisions, agreements and
declarations hereinafter declared and contained of and concerning the same.
3) The name of the trust shall be “No Barrier Foundation”
4) The Registered Office of the Trust shall be situated at BO002, , Ambiance Caitriona, , Ambiance
= 122001, Harys at such other place or places as the Trustees may from
time to time determine.
5) The objects and purposes of the Trust are as follows
1. RELIEF OF POVERTY OR DISTRESS:
a) Distribution of free food and clothing to the poor and needy;
b) _ Setting up or helping by endowments or otherwise orphanage or poor houses for
the benefit of orphans and / or other deserving persons;
©) Setting up or helping by endowments or otherwise institutions or funds for the
benefit of poor widows;
4) Establishing or rendering help to any institutions or funds for the alleviation of
human suffering
©) The Trust shall render help for relieving distress, improving health and advancing
the economic, social and general welfare of the people and more particularly of
women, children, villagers, illiterates and backward and oppressed people
f) The Trust shall render advice and assistance to the handicapped, the invalid,
widows, orphans and similar other persons suffering from any disabilities ;
8) The Trust shall render assistance for relief of distress caused by famines,
pestilence, fires, floods, earthquakes and other natural calamities.
1. EDUCATION.
a) To establish, control, direct, takeover, conduct, supervise, develop and manage
and I or assist or join in the establishment, control, direction, taking over conduct,
supervision, development and management of schools, colleges, institutions and
bodies for giving or imparting any kind of description of education and training
including, without prejudice to the generality and in particular primary, secondary
and higher academical scientific, commercial, industrial, agricultural in all. its

Sanskrit, Gujarati etc.
To encourage and propagate education in educationally backward communities
To help and propagate education of poor boys and girls in schools, colleges and
other institutions in all possible ways by means of scholarships and prizes, or
payment of fees or providing books or defraying other expenses howsoever.
For the advancement and propagation of education and learning in different
faculties including the establishment, maintenance and support of Colleges,
Universities, Technical Institutions, Schools Work Classes, Laboratories, Museums,
Vidyapiths, Libraries, Balmandirs, Pathashalas, Study Centres or other educational
institution, professorships, lecturerships, scholarships, prizes for research work in
connection with medical, scientific or industrial problems, giving travelling,
fellowships in any branch of science or art or learning assisting students to study
abroad either by payment of a lumpsum or by payment of periodical sums
To publish and / or to aid in publishing books, magazines, reports, periodicals ,
annuals to impart education promote literature and culture.
Establish and maintain and / or support hostels and / or boarding houses and
grant of free boarding and lodging to the poor and deserving students upon such
terms and for such period as the Trustees may deem fit
Grant of endowments to Unversities, research institutions (whatever now existing
or hereafter established) for spread of education and knowledge in all or any
branches of knowledge
Grant of monetary or other assistance including scholarships and / or loans to
deserving and needy students of any community without discrimination on
ground of caste, class, colour, creed, religion or sex to enable them to receive such
education, training and qualification in such lines or courses for such periods and
upon such terms as Trustees may in their absolute discretion form time to time
deem fit
Establishment and for maintenance and for support of and / or grant of monetary
or other assistance to any hostels and / or boarding houses and / or grants of free
boarderships for the lodging and boarding of any students whether male or
female studying in any school, colleges or institutions upon such terms as the
Trustees may in their absolute discretion from time to time deem fit.
To conduct, establish, equip , maintain and I or manage laboratories . workshops
and to undertake, conduct, carry on or help to carry on scientific research and
other scientific works and provide funds for such works or for payment to any
person or persons engaged in research work whether in such laboratories or
elsewhere in the fields of natural or applied science including agricultural, animal
husbandry or fisheries
To award prizes, gold and / or silver medals or cash payment to meritorious
students in the examination held by school, college, university or such other
educational institutions.
To conduct, manage, guide, look after or supervise other educational institutions
having objects similar in part or in whole to the objects of the Trusts for the
advancement and propagation of education and learning
To undertake, carryout, promote and sponsor any publication of any books,

in order to implement any of the above mentioned objects or purposes transfer

To undertake research in any field to make payment to any University, College,
Associations or Institutions to be used for research in any field.
The Trust shall afford to its beneficiaries opportunity to keep themselves
intellectually vibrant and abreast of current events.
The Trust shall organise and hold lectures, debates, seminars, reading of papers
and group studies on diverse topics and subjects.
The Trust shall publish lectures of social, political scientific, cultural and
sociological importance on a non-commercial basis with a view to enlightening the
beneficiaries.
The Trust shall organise and undertake such cultural and social activities and
functions as well afford opportunities for contacts among the members and the
people.
‘The Trust shall build a library of its own.
The Trust shall establish a cultural wing for Art and Music and towards this end
build a research and reference library.
The Trust shall establish and maintain laboratories, workshops and schools and
colleges and encourage experiments therein.
The Trust shall conduct investigations and undertake studies in India or abroad on
constitutional, administrative, economic, social, medical, cultural, philosophical
and scientific problems.
‘The Trust shall assist the research work of any institute or institutions and other
bodies, incorporated or not, having similar objects in such a manner as may be
considered expedient and to co-operate with such institutions in these activities,
The Trust shall establish, maintain and control institutions in India and elsewhere
for the above object and to have them registered or recognised in any part of India
or in any foreign country.
The Trust shall establish and support professorships, lecturerships, scholarships
and prizes at any university, college, school or any other educational institutions.
The Trust shall do all such other lawful things as may be incidental to or
conducive to the attainment of its objects in India or abroad.

Grant of subscriptions and donations to Hospitals, Dispensaries, convalescent
homes, Asylums, nursing houses and other public institutions administering,
medical relief upon such terms and conditions and for such terms and conditions
and/or for such period as the Trustees may think fit;
Establishment, acquisition and maintenance and support to hospitals,
dispensaries, maternity homes, sanatoriums, research centres, laboratories,
medical colleges and schools or institutions imparting medical knowledge or
affording medical relief;
Grant of medical help to the poor and to deserving persons during epidemic,
famine, flood, earthquake or any unforeseen calamity or war or warlike
operations, riots, civil commotions and similar occurrences;
To understand the programme for rehabilitation of the mentally retarded persons,
female members and others affected by natural calamities such as flood, famine,
earthquake, etc. , and to provide such type of training to establish them on their
own;
The Trust shall render medical relief and aid to any person or persons of public in
general and distribute medicines, appliances and other requisites for that purpose
‘The Trust shall establish, found, construct, open, promote, takeover, equip,
conduct, maintain, support, subsidise, grant aid and make donations to hospitals ,
dispensaries, colleges ;
First- aid in medical and surgical emergencies ;
Diagnosis and out-patient treatment of common diseases, minor surgery in
sub-centres ;
Referral to the primary health centre of emergencies and cases requiring
hospitalisation ;
To carry out all functions required of the public health services and family
planning and maternity child welfare services ;
Immediate initiation of epidemic control measures ;
Initiation and supervision of vaccination and preventive measures for
communicable diseases ;
Health education and related activities including nutrition diabetics, dental and
health education;
To train a cadre of licentiate basic doctors and other paramedical personnel in the
very heart of the rural tribal areas ;
To start medical schools for training licentiate L.M.P. (Rural-Tribal) basic doctors
and paramedical auxiliaries, medical social workers, family welfare workers,
health visitors and so on and health assistants ;
To promote and encourage acceptance and use of Ayurvedic medicines for
treatment of ailing persons by giving grants, aids or assistance to hospitals ,
clinics, surgery etc. by employing doctors qualified in and practising Ayurvedic
medicines,
To make available the basic health services ( including nutrition , health education,
family welfare and child care etc. ) treatment of all common diseases with hospital
facilities, training of rural doctors and paramedical personnel who will not
migrate to the urban areas and the creation of a National Referral Services
Complex by the development of proper link between the primary health centres
and other ‘hospitals for specialised treatment ;
Establishment of a Rural Medical School ;
Encouragement of domiciliary treatment thus providing extra clinical material and
exposure of the student to patients social environment and living conditions and

who have need of such facilities by reason of their youth, age, infirmity or

And also to provide for the maintenance of grounds and buildings to be used for
purpose of recreation and leisure time occupation,
Creation, maintenance, supply or support of Gardens, Gymnasiums, Physical
Culture Centres, and other means of public recreation or the other leisure time
occupation and advance of health and hygiene.
To provide facilities, assistance and aid financial or otherwise for development
and promotion of fine arts such as the dramas, plays, musical concerts and other
activities pertaining to theaters.

or Welfare which the Trust can lawfully carry out either directly or through the
agency of any person or persons or in any other manner, and to incur expenditure

inspired the life with a view to inculcating among the people a sense of patriotism
and social responsibility ;
In conformity with the ideals to stimulate thinking on current problems and to
encourage understanding and tolerance among the people with the intention of
fostering a feeling of oneness;
To undertake a constructive and nation building work among all sections of
society regardless of caste or community and to render charitable service to the
needy ;
To promote and encourage Khadi and Village Industries sponsored Schemes and
activities ;
To undertake rural development activities , create an awareness for such
development and establish a Rural Research Centre and Consultancy Services ;

of skilled professionals and the utilization of advanced audio processing
techniques, softwares and tools, ensuring accurate and immersive descriptions for

d) To develop and distribute user-friendly software and systems that enable
content creators, production houses, and other stakeholders to easily create and
incorporate audio description, closed captioning, and other accessible features into
their content offerings,

In order to bring about closer understanding between the people of India
on the one hand and the people of United States of America in particular
and the other countries in general on the other hand, it shall be lawful for
the trust to organise, hold and to participate in symposiums, conferences
and seminars in India or abroad.
To apply to the the Government, Public Bodies, Urban Local Municipal
District and other bodies, Corporation, Companies and persons for and to
accept grants of money and of land, donations, gifts, subscriptions and
other assistance with a view to promotion of the object of the Society and
to discuss and negotiate with the Govt. Departments, Public and other
Bodies, Corporations, Companies or persons, schemes of research and
other work and matters within the objects of the Society and to conform to
any proper conditions upon which such grants and other payments may be
made.
To take over or amalgamate with any other charitable Society, Trust,
Association or Institution with similar objects.
In furtherance of medical research, to procure the service of Doctors,
Surgeons or Medical Practitioners including, Vaidyas, Hakims, Nurses9
Assistants, Lay-Workers, Attendants and Servants either for remuneration,
gratuitously or in any honorary capacity.
xix. To raise finance through gifts, loans, grants, donations, subscriptions,
contributions in cash or kind, incentives, realisation through disposal of
any assets and membership fees and generally to obtain money for the
“objects of the Society in any lawful manner.
xx. To subscribe to, to become a member of and to cooperate with or
collaborate with any other Society, Association, similar organisations or
body corporate whose objects are altogether or in part similar to those of
the Society, Organisation, Association or body corporate su‘
as may be likely to promote the objects of the Society.

All incomes and assets of the institutions shall be solely utilised and applied towards the
promotion of its aim and objectives.
Notwithstanding anything contained in these presents it is intended and directed that if at any
time it is held that any of the objects or purposes to which the said income or any part thereof or
corpus or any part thereof is directed to applied or extended is not a public charitable object or
purpose the Trustees shall apply and expend the income or corpus towards the execution and
Carrying out of only such public charitable purposes as are recognised as public charitable
purposes as the Trustees may think fit.
Without prejudice to the generality of the foregoing objects or purposes, both primary objects and
incidental objects, but subject as aforesaid, it is clarified that

hereby established and its income as eligible for exemption from taxation under the
Indome-tax Act, 1961 or any replacement, or re-enactment thereof or modification thereof
or under any other Act governing taxation for the time being in force in India;
Il. notwithstanding anything
the Trust hereby established shall be one to which the provisions of section 80-G of the
Income-tax Act, 1961 replacement, re-enactment or modification thereof for the time being
in force shall apply so that any donation thereto be recognised eligible for exemption or
relief from tax as regards to the donor ;

PROVIDED that every contribution by the Trustees to any other Trust, Society or
Institution, Fund, Scheme, or Object, having as its object all or any of the aforesaid public
charitable Trusts and objects shall be treated and deemed to be a furtherance and
achievement of the objects of its Trust.
PROVIDED FURTHER that notwithstanding anything contained hereinabove the Settler
shall have an absolute power by deed intervives or such other documents as may be
any of the objects or provisions or any part of the aforesaid Trusts

8) The charitable purposes for which the said ‘Trust has been created shall be for one or more of the
foregoing purposes TO THE INTENT that the same shall relate to any thing, done or to be done
within the territory of India which is regarded for the time being as taxable territories within the
meaning of the Income-tax Act, 1961 or any statutory modifications thereof for the time being, in
force ( which part of India is hereafter for brevity's sake referred to as India ) as well as outside
India without reference to cast, creed or religion and in such shares and proportions and in such
manner in all respects as Trustees shall in their absolute discretion think fit and so that the
income as well as the corpus of the Trust Fund shal be applicable or accumulated for application
to such charitable purposes as aforesaid.
49) The Trustees shall collect, recover, realise and receive the rents, interest, income and profits
which shall accrue due and be payable of and from the Trust Funds and out of the said rent
income and profits in the first instance pay and discharge or reimburse all rates, rents, {2%=%
insurance premix and all other expenses incurred for the purposes ofthe Trust and in respect of
any immovable property, if and when acquired and comprised in the Trust Funds, and other
outgoings of the Trust Fund and the costs charges and expenses of keeping the immovable
property acquired and comprised in the Trust Fund in fit and proper state of repair and also all
costs charges and expenses which may form time to time be incurred by the Trustees oF ny of
them in the discharge of their duties under these presents and the execution of the Trusts and
powers of these presents or incidental thereto including the expenses of realising collecting and
recovering the income, profits, rents, and interest of the Trust Fund and conversion and
reinvestment of the Trust Fund, and all such other expenses for keeping proper accounts and
other purposes as the Trustees may approve and be conducive to the purpose herein expressed
the Trustees having power to engage servants and agents for the purpose of protection and
administration of the Trust Fund for recovering and realising the rents income and profits
thereof and for keeping proper accounts or otherwise for securing proper management and
administration of the Trust Fund.
10) SURPLUS AND ACCUMULATION ;
Subject to the provisions of the Income Tax Act, 1961 or any Statutory Modification oF
reenactment thereof from time to time the surplus and unapplied portion (if any) of the Trust
Fund arising in any one or more year or years shall be accumulated and invested and the
resulting income thereof shall also be accumulated and invested from time to time in any of the
investments in which the Trust Funds are hereby directed or authorised to be invested and the
‘Trustees shall have power in any subsequent year to expend and apply the same in the same
manner and to the same extent as if such accumulation or parts thereof had been part of the
income of the year or years in which the same is sought to be expended and applied as aforesaid

The Trust shall keep and maintain regular accounts of its receipts and expenditure and get the
same audited. The accounting year of the Trust will be the financial year (i.e. year ending on 3tst
Match) or such year as may be decided by the Trustees

of investment in India with power to them from time to time at their discretion to vary any
investments held by the Trustees for other of the character hereby authorised viz.
Inor upon any investments in India for the time being authorised by law for the
‘investment of Trust Fund of a Charitable Trust.
‘Any securities or bonds issued by or the interest of which has been guaranteed by the
Cantal ot State Governenent or any Municipal corporation or Port Trust or other local
body or authority in India.
Shares of any limited company or Government or Semi-Government Company of
Corporation or Cooperative Society in India (which arc either ‘cumulative preference
shares or equity shares) and debentures and bonds of any limited company or
aaa ott or bemi-Government Company or Corporation or Cooperative Society in
India.
Unit issued by the Unit Trust of India. -
Inthe purchase of any immovable property or any part thereof anywhere in India
{including leasehold for any period and in developing the same.
Deposit of moneys in open, current or other accounts or account with any Bank or Banks
ooo vecament or Semi-Government Company or Corporation or any Government oF
Semi-Government Bodies or authorities in India.
In the purchase or acquisition in India of any immovable property:
13) It shall be lawful for the Trustees to build, pull down, renovate, rebuild, alter, adapt, improve,
gto develop or repair any immovable properties, comprised in the Trust Fund and to spend
and to aevSh moneys out of the Trust Fund or the income thereof as they may think fit, Phe
Thastees shall also be entitled to enter into any agreements or covenants with the owner of or
person interested in any other properties and whether restrictive or otherwise as they may from
vere to time in their absolute discretion think fit. The Trustees shall also have the power fo insti,
any premises comprised in the Trust Fund against loss or damages by fire, lightning OF civil
any Potion or to the risks to or losses as the Trustees may from time to time in their absolute
common think fit but no liabilities shall attach to the Trustee or any of them by reason of
property remaining uninsured in any way.
‘The Trustees shall also have the power after paying all rents taxes and other outgoings and
expenses out of the rents and profits of any immovable properties to set aside out of the balance
caret from time to time sums of moneys as the Trustees may consider proper to meet the
expenses of heavy repairs or by way of depreciation or sinking fund and to utilise the sare and
the income thereof for heavy repairs or for rebuilding or reinstating immovable properties or
erecting new buildings and in the meantime to invest the same in securitis authorised by these
presents. It shal also be lawful for the Trustees to permit any immovable property forming part of
the Trust Fund to be held and enjoyed for the purpose of any scheme of charity or other purposes
of these presents. The Trustees may also allow the same or any part thereof to be occupied By any
employee of any such scheme free from payment of rent or on such terms and conditions as the
Trustees may think fit for the furtherance of the objects of the charity
14) APPOINTMENT/CESSATION OF TRUSTEESIf the Trustees hereby appointed or any of them or any further ‘Trustee or Trustees hereof shall die
or permanently go to reside outside India or desire to be discharged or refuse or become unfit of
incapable to act as the Trustees of these presents or become insolvent or become of unsound mind
or convicted for an offence involving moral turpitude or if the ‘Trustees shall be desirous of
appointing Trustees or Trustee (which they are hereby authorised to do), then it shall be lawful
for the surviving or continuing Trustees as they act as Trustees of these presen s and if there be no
surviving or continuing Trustee then for the retiring or refusing Trustee or Trustees and failing
them for their heirs, executors and administrators of the last surviving Trustee to appoin, “Ty

15) CHAIRMAN AND MANAGING TRUSTEE:
