6 1. This action arises from Apple’s materially false and misleading statements relating
8 particular, promised AI enhancements to Siri, Apple’s software-based virtual assistant. The Siri AI
9 makeover was the centerpiece of the promised Apple Intelligence platform and was touted by the
10 Company in advertisements and other public statements in an effort to increase sales of the iPhone
11 16 and spur iPhone upgrades. Those promises were false and nearly a year after they were made,

1 purchasing the new device that the touted functionality was delayed, incomplete, impossibly buggy
2 and never implemented by Apple.4
3 11. Adding insult to injury, enraged consumers also complained that the limited AI
4 features that Apple eventually attempted to roll out in iOS updates, resulted in excessive battery
5 drain and device overheating.5
6 12. On March 7, 2025, Apple finally acknowledged that the touted Apple Intelligence
7 features, including the well-publicized Siri enhancements that were promoted to fuel media buzz
8 and consumer excitement, did not exist at the time of promotion and still do not exist today. Under
9 pressure from users demanding refunds and threatening to boycott Apple products, Apple admitted
10 to the delays and estimated that if these features were to materialize, it would not be until 2026 at
11 the earliest that the phones will achieve their promised functionality—two years after Apple’s
12 aggressive marketing campaign set this public relations charade in motion.
13 13. Plaintiffs are two of those customers and bring this lawsuit on behalf of themselves
14 and similarly situated Class Members, purchasers of Apple’s iPhone 16, 16 Plus, 16 Pro, 16 Pro Max
15 or 16e (collectively, the “Affected Devices”). Defendant advertised that these Affected Devices
16 would be equipped with Siri “In-App” and “On-Screen” functions among other Apple Intelligence
17 features, and they were not.
18 14. As discussed herein, Apple includes a California choice-of-law provision in the
19 Software License Agreement accompanying its iOS software. Plaintiffs accordingly allege claims
20 under California law.
21 II. THE PARTIES
22 A. PLAINTIFFS
23 15. Plaintiff COREY MARTIN is a business student who resides in Castaic, California.
24 Martin pre-ordered and purchased his iPhone16 Pro from his cellular phone carrier AT&T’s website
25 on or about September 13, 2024.

1 16. Martin decided to purchase a new iPhone16 Pro after watching the keynote of
2 Apple’s Worldwide Developers’ Conference and after hearing about the new iPhone 16 Apple
3 Intelligence AI-enabled capabilities. In particular, he heard that the functionality would include new
4 Siri voice assistant AI capabilities. Martin bought the phone specifically relying on these statements
5 and relying on industry blog posts and press coverage of Apple’s announcement, paying a premium
6 to enjoy the benefits of Siri AI-augmented personalization and new automated assistant
7 functionalities. Unbeknownst to Martin, Apple’s statements about the functionality of the AI
8 capabilities available on the iPhone 16 were materially false and misleading. But for Apple’s
9 materially false and misleading promotion of the iPhone 16 Apple Intelligence AI-enabled
10 capabilities, Martin never would have purchased or would not have paid as much for his iPhone16
11 Pro.
12 17. Plaintiff TYSHAUN BUTLER is an entrepreneur who resides in Pittsburg,
13 California. Butler preordered and purchased two iPhones from Apple, a 16 Pro Max and a 16 Plus
14 model on or about September 13, 2024.
15 18. Butler decided to purchase his iPhone16 Pro Max and 16 Plus after receiving several
16 marketing emails from Apple, seeing ads for Apple Intelligence equipped iPhone 16 models on
17 Instagram, and seeing advertisements for Apple Intelligence-enabled iPhone 16s at brick-and-mortar
18 Apple stores. In particular, he heard that the functionality included new Siri voice assistant AI
19 capabilities, including a new smart button feature. Butler bought the phone specifically relying on
20 these statements, paying a premium to enjoy the benefits of Siri AI-augmented personalization and
21 new automated assistant functionalities, such as advanced calendaring and messaging capabilities
22 that would be useful to him in his business as a private barber. Unbeknownst to Butler, Apple’s
23 statements about the functionality of the AI capabilities available on the iPhone 16 were materially
24 false and misleading. But for Apple’s materially false and misleading promotion of the iPhone 16
25 Apple Intelligence AI-enabled capabilities, Butler never would have purchased or would not have
26 paid as much for his iPhone16 Pro Max or iPhone 16 Plus model.
27 19. In addition to the absent Apple Intelligence functionalities, both of Butler’s iPhones
28 routinely experienced overheating in addition to having repetitive screen glitches or momentary

1 26. Venue is proper in this Court under 28 U.S.C. § 1391. Apple resides in, and has its
2 most significant contacts with, the Northern District of California. A substantial part of the events
3 or omissions giving rise to the claims alleged herein occurred in this judicial district.
4 IV. INTRADISTRICT ASSIGNMENT
5 27. Assignment to the San Jose Division is appropriate under Local Civil Rule 3-2(c)
6 and (e). A substantial part of the events or omissions which give rise to the claims alleged herein
7 occurred at Apple’s headquarters, which is located in Santa Clara County.
8 V. FACTUAL BACKGROUND
9 28. Leading up to the 2024 marketing campaign based on Apple Intelligence, Apple
10 knew that its customer base was increasingly interested in generative AI features.
11 29. On June 10, 2024, Apple announced at its annual Worldwide Developer Conference
12 (“WWDC”) a release of its artificial intelligence offering, “Apple Intelligence.” 6
13 A. APPLE INTRODUCES “APPLE INTELLIGENCE” FUNCTIONALITIES
14 30. At the WWDC, Apple touted Apple Intelligence as a new grouping of generative AI
15 tools on its upcoming lineup of not just phones but other Apple devices—including laptop and
16 desktop computers and tablets—suggesting that soon, all new Apple products would come natively
17 enabled with Apple Intelligence and improved AI capabilities for Siri that were associated with the
18 roll-out of that product suite.

4 35. Pre-reorders for the Apple Intelligence enhanced iPhone 16 models, including the
5 iPhone 16, iPhone 16 Plus, iPhone 16 Pro, and iPhone 16 Pro Max, opened on Friday, September
6 13, 2024 and these iPhones were available for in-store purchase one week later.

36. On October 28, 2024, Apple announced that Apple Intelligence was now available

1 37. After the October 28, 2024 announcement, the press again went abuzz with the
2 promise of Apple Intelligence landing on new iPhones, but cracks in Apple’s plan to conceal
3 information were also revealed. PCMag wrote, “Apple first unveiled Apple Intelligence at WWDC
4 in June, promising to roll it out on Pro versions of the iPhone 15 and the iPhone 16 lineup in the
5 fall. However, its AI tools were a no-show at September's ‘Glowtime’ event. Instead, Apple
6 promised the first Apple Intelligence features in October, with ‘more to come’ in the months
7 ahead. That begins today with the latest iOS software update in what's expected to be a months-
8 long rollout.”12

1 38. As reported in PCMag, Apple CEO Tim Cook promised: “Apple Intelligence
2 introduces a new era for iPhone, iPad, and Mac, delivering brand-new experiences and tools that
3 will transform what our users can accomplish” and “Apple Intelligence builds on years of
4 innovation in AI and machine learning to put Apple’s generative models at the core of our devices,
5 giving our users a personal intelligence system that is easy to use.”
6 39. Fueled by these and other promises made by Tim Cook and other Apple executives
7 well into the winter of 2024, the press continued to report and Apple purchasers continued to rely
8 on Apple’s promises regarding Apple Intelligence’s functionality, enticing consumers to purchase
9 new iPhones on the expectation that they would contain full Apple Intelligence functionality.

1 into a user’s personal information to answer queries and take actions, have more precise control
2 over apps, as well as capability to see what is currently on a device’s screen and use that context to
3 better serve users will now not be released until sometime in “the coming year.” 15
4 E. APPLE FAILED TO DELIVER THE PROMISED SIRI AI FUNCTIONS
5 42. When Apple demonstrated the features at WWDC using a video mock-up, it only
6 had a barely working prototype, and Siri senior director Robby Walker recently told Apple staff
7 that the delays were especially “ugly” because Apple had already showed off the features publicly,
8 notably in high profile advertisements featuring celebrities. 16 “This was not one of these situations
9 where we get to show people our plan after it’s done,” he said. “We showed people before.” 17
10 43. According to reporting by Bloomberg’s Mark Gurman, in the lead-up to the latest
11 delay, Apple executives voiced strong concerns internally that the features didn’t work properly—
12 or as advertised—in their personal testing, and according to Bloomberg, there continues to be
13 speculation among some within Apple’s AI division that work on AI features could be scrapped
14 altogether and that Apple may have to rebuild the functions from scratch. 18 The once-promised
15 capabilities would then be further delayed until a next-generation Siri that Apple hopes to roll out
16 in 2026.19
17 44. Walker and other executives also raised doubts about even meeting the current
18 release expectations. “To make matters worse,” Walker told Bloomberg, Apple’s marketing and
19 communications departments wanted to promote the enhancements, and despite not being ready,
20 the capabilities were included in a series of marketing campaigns and TV commercials starting last

1 year, including a now-removed YouTube advertising campaign featuring celebrity Bella Ramsey
2 touting the AI capabilities of Apple’s Siri voice assistant including “personal context” and “on-
3 screen awareness through App intents” to help one schedule messages and appointments. 20
4 45. In truth, the Affected Devices do not have the capabilities as depicted by Ramsey.
5 In addition to Defendant’s first announcing their “delay” of the next generation of Siri
6 functionality on March 7, 2025, Apple pulled this particular commercial from YouTube. With the
7 video now removed, Apple still has failed to retract the similarly false representations in the
8 market that began in the summer of 2024, and Defendant has not taken action that would
9 adequately remedy consumers harmed by the Company’s widespread, public deception.

Excluded from the Class are Apple, Apple’s successors or assigns, Apple’s officers, directors,

employees, and legal representatives, as well as any entity in which Apple has a controlling

interest. Also excluded are federal, state, and/or local governments, including, but not limited to,

their departments, agencies, divisions, bureaus, boards, sections, groups, counsels, and/or

subdivisions; and any judicial officer presiding over this matter. 26

51. Members of the Class are so numerous that joinder is impracticable. Apple sold
10
hundreds of thousands of Model 16, 16 Plus, 16 Pro, 16 Pro Max or 16e iPhones (“Affected
11
Devices”) in the United States, and Apple has records of these sales and the owners.

52. There are numerous questions of law or fact common to the Class including, but not
13
limited to, the following:

a. Whether Apple’s advertising and other public statements about Apple Intelligence
15
were false and misleading;
16
b. Whether Apple misrepresented and/or failed to adequately disclose that Apple
17
Intelligence features would not be available when promised on Affected Devices;
18
c. Whether the cost of Affected Devices was falsely inflated by the promised Apple
19
Intelligence functionality that either never materialized or was significantly
20
delayed;
21
d. Whether Apple engaged in unlawful, unfair or deceptive business practices by
22
advertising and selling the Affected Devices;
23
e. Whether Apple used deceptive representations in connection with the sale of the
24
Affected Devices in violation of Civil Code section 1750 et seq;
25
f. Whether Apple advertised the Affected Devices with intent not to sell them as
26
advertised in violation of Civil Code section 1750, et seq.;

1 g. Whether Apple’s advertising and marketing of the Affected Devices are misleading
2 in violation of Business and Professions Code section 17500, et seq.;
3 h. Whether Apple knew or by the exercise of reasonable care should have known its
4 advertising and marketing were and are misleading in violation of Business and
5 Professions Code section 17500, et seq.
6 i. Whether Apple’s conduct is an unlawful, unfair or fraudulent business practice
7 within the meaning of Business and Professions Code section 17200, et seq.;
8 j. Whether Apple was unjustly enriched by its unlawful conduct; and
9 k. Whether Plaintiffs and the Class are entitled to equitable relief, including an
10 injunction.
11 53. Plaintiffs’ claims are typical of the claims of the Class. Plaintiffs and all Class
12 Members were damaged by the same wrongful practices of Apple.
13 54. Plaintiffs will fairly and adequately represent the interests of the Class Members.
14 Plaintiffs are members of the proposed Class they seek to represent. Plaintiffs’ interests are aligned
15 with, and not antagonistic to, those of the Class. Plaintiffs have retained counsel competent and
16 experienced in complex class action litigation.
17 55. Proceeding as a class action is superior to other available methods for fairly and
18 efficiently adjudicating the controversy. Prosecuting separate actions by individual Class Members
19 would create a risk of inconsistent or varying adjudications with respect to individual Class
20 Members that would establish incompatible standards of conduct for Apple.
21 56. Moreover, Apple has acted or refused to act on grounds that apply generally to the
22 Class, so that final injunctive relief or corresponding declaratory relief is appropriate respecting the
23 Class as a whole. Additionally, questions of law or fact common to Class Members predominate
24 over any questions affecting only individual Class Members. Plaintiffs know of no special
25 difficulty maintaining this action that would preclude its maintenance as a class action.
26 VII. CHOICE OF LAW: DESIGNED BY APPLE IN CUPERTINO, CALIFORNIA
27 57. By using their Devices or downloading a software update, users of the Affected
28 Devices are presented with the iOS Software License Agreement. There are separate Software

1 License Agreements for each version of iOS software; however, the agreements do not differ in
2 material terms, and provide that California law governs. For example, the Software License
3 Agreement for iOS 18, used on the iPhone 16, provided: “This License will be governed by and
4 construed in accordance with the laws of the State of California, excluding its conflict of law
5 principles.”
6 58. To the extent they apply, the iOS Software Licensing Agreements are effective at
7 the point of sale—as soon as the customers turn on their Devices—and are thus part of the benefit
8 of the consumers’ bargain. Without the iOS, for which there is a purported licensing agreement,
9 the Devices simply do not work.
10 59. Apple elected to have California law govern all claims and disputes concerning the
11 common software required to operate all of the Devices at issue in this lawsuit. Accordingly, the
12 application of California law to all of the class members’ claims is fair, appropriate, and an
13 election affirmatively made by Apple consistent in its agreements.
14 60. By using their Devices, consumers are told that they agree to be bound by
15 California law as consumers must run Apple’s proprietary iOS to use their Devices.
16 61. Beyond Apple’s election of California law to govern the claims described herein,
17 the State of California has a significant interest in regulating the conduct of businesses operating
18 within its borders. California, which seeks to protect the rights and interests of California and all
19 residents and citizens of the United States against a company headquartered and doing business in
20 California, has a greater interest in the claims of Plaintiffs and class members than any other state
21 or country and is most intimately concerned with the claims and outcome of this litigation.
22 62. The principal place of business of Apple, located at 1 Apple Park Way (formerly 1
23 Infinite Loop) in Cupertino, California, is the “nerve center” of its business activities—the place
24 where its high-level officers direct, control, and coordinate the corporation’s activities, including
25 its marketing, software development, and major policy, financial, and legal decisions.
26 63. Apple’s response to the allegations herein, and corporate decisions surrounding
27 such response, were made from and in California.
28 64. Apple’s violations of law and breaches of duty to Plaintiffs and the Class emanated

1 from California, and the Devices at issue herein were designed, manufactured, and tested in
2 California.
3 65. Application of California law with respect to Plaintiffs’ and Class members’ claims
4 is neither arbitrary nor fundamentally unfair because California has a state interest in the claims of
5 the Plaintiffs and the Class based upon Apple’s significant and ongoing contacts with California.
6 66. Under California’s choice of law principles, which are applicable to this action, the
7 common law of California applies to the common law claims of all class members. Additionally,
8 given California’s significant interest in regulating the conduct of businesses operating within its
9 borders, California’s consumer protection laws may be applied to nonresident class members.

FIRST CLAIM FOR RELIEF
12 Violation of the California False Advertising Law
Cal. Bus. & Prof. Code § 17500, et seq.
13 (On Behalf of the Nationwide Class and the California Subclass)
14 67. Plaintiffs re-allege and incorporate by reference each and every allegation set forth
16 68. Defendant’s conduct alleged herein violates California’s False Advertising Law
17 (“FAL”), Cal. Bus. & Prof. Code § 17500, et seq., which makes it unlawful for a business to make,
19 personal property . . . which is untrue or misleading, and which is known, or which by the exercise
21 69. Apple’s acts and practices, as described herein, have deceived and/or are likely to
22 continue to deceive Plaintiffs, Class Members, and the public. As described throughout this
24 software roll=out, and misrepresented the purpose and extent of related iOS updates.
26 Intelligence based out of California and governed by California law. The advertising was, by its
27 nature, unfair, deceptive, untrue, and misleading within the meaning of Cal. Bus. & Prof. Code §
28 17500, et seq. Such advertisements were intended to and likely did deceive the consuming public

1 deceive the public at or near the time it was made or disseminated, and at all times thereafter.
2 79. Plaintiffs and Class Members based their purchasing decisions on Apple’s omitted
3 material facts. The revenues to Apple attributable to the product sold in those false and misleading
4 advertisements amount to tens or hundreds of millions of dollars. Plaintiffs and Class Members
5 were injured in fact and lost money and property as a result.
6 80. Unless Defendant are enjoined from engaging in the conduct alleged herein that
7 violates the FAL, members of the consuming public will be further harmed by that conduct.
8 81. As a result of Defendant’s FAL violations and the harm caused thereby, Plaintiffs
9 and Class Members lost money and are entitled to and seek (a) injunctive relief to protect the
10 consuming public by prohibiting Apple from engaging in its past and ongoing acts, omissions, and
11 conduct that violate the FAL; (b) restitution of the full value of all monies and other consideration
12 that Plaintiffs and Class Members paid Defendant for the purchase or lease of Apple Intelligence
13 software or Affected Devices, which Defendant continues to wrongfully retain, including any
14 diminished value of Plaintiffs’ and Class Members’ Affected Devices and disgorgement of the
15 profits Defendant derived from their wrongful conduct; (c) an award of reasonable attorneys’ fees
16 under Cal. Code Civ. Proc. § 1021.5 and any other applicable law; and (d) all other available relief
17 prayed for below.
SECOND CLAIM FOR RELIEF

Violation of the California Consumer Legal Remedies Act
19 Cal. Civ. Code § 1750, et seq.

82. Plaintiffs re-allege and incorporate by reference each and every allegation set forth
21
above, as though fully set forth in this Claim for Relief.
22
83. The California Consumer Legal Remedies Act (“CLRA”), Cal. Civ. Code § 1750,
23
et seq., makes unlawful certain “unfair methods of competition and unfair or deceptive acts or
24
practices . . . undertaken by any person in a transaction intended to result or that results in the sale
25
or lease of goods or service to any consumer.” Id. § 1770(a).
26
84. The CLRA is a comprehensive statutory scheme that is to be liberally construed to
27
protect consumers against unfair and deceptive business practices in connection with the conduct
28

1 of businesses providing goods, property, or services to consumers primarily for personal, family,
2 or household use.
3 85. In accordance with the liberal application and construction of the CLRA,
4 application of the CLRA to all class members is appropriate, given that Apple’s conduct as
5 described herein originated from California, the Devices and iOS code containing Apple
6 Intelligence functionality were designed and originated in California, and Apple’s uniform iOS
7 Software License Agreement provides that California law shall apply.
8 86. Apple’s uniform iOS software License Agreement governs the reach of the Class’s
9 claims because Apple’s violations of the CLRA were caused, in part, by the installation of certain
10 operating software containing Apple Intelligence features and functionality that degraded Affected
11 Devices’ device performance and negatively impacted users’ experiences.
12 87. Defendant is a “person” under the CLRA. See id. § 1761(c).
13 88. Plaintiffs and all Class Members are “consumers” under the CLRA because they are
14 all individuals who acquired, by purchase or lease, Affected Devices with Apple Intelligence
15 functionality for personal, family, or household purposes. See id. § 1761(d).
16 89. The purchase or lease of Apple Intelligence and/or Affected Devices is a
17 “transaction” under the CLRA. See id. § 1761(e).
18 90. Apple Intelligence and Affected Devices are “goods” under the CLRA. See id. §
19 1761(a).
20 91. In selling or leasing Apple Intelligence and Affected Devices to Plaintiffs and Class
21 Members, Defendant made an express or implied promise to provide future Apple Intelligence
22 software development, future Apple Intelligence software updates, and other work or labor that
23 constitutes “services” under the CLRA. See id. § 1761(b).
24 92. Apple’s acts and practices were intended to and did result in the sales of products
25 and services to Plaintiffs and the Class Members in violation of Civil Code § 1770, including:
26 a. Representing that goods or services have characteristics that they do not
27 have;
28 b. Representing that goods or services are of a particular standard, quality, or

1 99. California’s Unfair Competition Law (Cal. Bus. & Prof. Code § 17200, et seq.,
2 “UCL”) is designed to protect consumers from unlawful, unfair, or fraudulent business acts or
3 practices, including the use of any deception, fraud, false pretense, misrepresentation, or the
4 concealment, suppression, or omission of any material fact.
5 100. In accordance with the liberal application and construction of the UCL, application
6 of the UCL to all Class Members is appropriate, given that Apple’s conduct as described herein
7 originated from California, Affected Devices and Apple Intelligence, and related iOS software
8 were designed and originated in California, and Apple’s uniform iOS Software License Agreement
9 provides that California law shall apply.
10 101. Apple’s uniform iOS software License Agreement governs the reach of the Class’s
11 claims because Apple’s violations of the UCL, FAL, and CLRA were caused, in part, by the
12 installation of certain operating software containing Apple Intelligence features and functionality
13 that degraded Affected Devices’ device performance and negatively impacted users’ experiences.
14 102. Apple has engaged, and continues to engage, in unfair business practices with
15 regard to updates to its Apple Intelligence software. Apple designed Apple Intelligence in a
16 manner that materially diminishes the speed and performance of the Affected Devices in addition
17 to significantly diminishing users’ experiences with the Affected Phone.
18 103. Apple is a “person” as defined by Cal. Bus & Prof. Code § 17201.
19 104. Apple violated Cal. Bus & Prof. Code § 17200, et seq. by engaging in unlawful,
20 unfair, and deceptive acts and practices.
21 105. Apple’s “unfair” acts and practices include:
22 a. Knowingly designing, developing, manufacturing, advertising, and selling
23 Affected Devices with a significant defect, reduced Apple Intelligence
24 functionality, that resulted in the Affected Devices not operating as
25 intended, represented, or advertised under normal usage;
26 b. Developing software updates that merely hide the aforementioned defect,
27 and/or resulting in Affected Devices operating at slower speeds or degraded
28 performance levels that intended, represented, or advertised under normal

1 usage;
2 c. Concealing material information from consumers regarding the rollout of
3 Apple Intelligence functionalities and updates to operating software, so that
4 consumers would not nor could not know that Apple Intelligence was not
5 fully operational nor negatively impacted Affected Devices’ device
6 performance;
7 d. Using uniform, deceptive practices, requiring consumers to spend additional
8 money on replacement Affected Devices as a result of the defect.
9 106. Apple has engaged in “unlawful” business practices by violating multiple laws,
10 including the California False Advertising Law, Cal. Bus. & Prof. Code §§ 17500, et seq.,
11 (“FAL”), the California Legal Remedies Act (“CLRA”), Cal. Civ. Code §§ 1780, et seq., and
12 California common law.
13 107. Apple violated § 17200’s prohibition against unfair conduct by failing to inform its
14 customers about the defect in the Affected Devices; engaging in a pattern or practice of concealing
15 those facts and urging its customers to install regular updates to the iOS software to receive partial
16 Apple Intelligence updates, thereby depriving owners of Affected Devices performance of those
17 devices that existed at the time of purchase. This conduct is substantially injurious to consumers,
18 offends public policy is immoral, unethical, oppressive, and unscrupulous, as the gravity of the
19 conduct—diminishing and crippling expected—outweighs any alleged benefit. Specifically, the
20 utility gained by “upgrading” to software that included Apple Intelligence was outweighed by the
21 diminishment of the device functionality. Apple engaged in this conduct at the expense of its
22 customers’ rights (and customers lost money) when other lawful alternatives were available, such
23 as providing customers’ with full information about the Affected Devices, Apple Intelligence
24 functionality, iOS software updates, and/or offering replacements to customers.
25 108. Apple engaged in this conduct to gain an unfair commercial advantage over its
26 competitors, seeking to avoid public knowledge of the defect in its Apple Intelligence software
27 suite, to avoid damage to its sales or reputation. It withheld critical and material information from
28 Plaintiffs and Class Members, competitors, and the marketplace—all to its unfair competitive

1 advantage.
2 109. Apple violated § 17200’s prohibition against engaging in unlawful acts and
3 practices by engaging in false and misleading advertising and by omitting material facts from
4 purchasers of Affected Devices. As alleged more fully herein, Apple’s marketing and sale of
5 Affected Devices, and more specifically its failure to inform customers of the incomplete software
6 functionality rollout of Apple Intelligence and resulting diminished performance impact of
7 incomplete software updates would have on those Affected Devices, violated Cal. Civ. Code §
8 1750, et seq., common law, and other statutory violations as alleged herein. Plaintiffs reserve the
9 right to allege other violations of the law which constitute other unlawful business acts and
10 practices. Apple’s conduct is ongoing and continues to this date.
11 110. Apple violated § 17200’s prohibition against unfair conduct by failing to inform its
12 customers about the defect in the Affected Devices; engaging in a pattern or practice of concealing
13 those facts and urging its customers to install regular updates to the iOS software to receive partial
14 Apple Intelligence updates, thereby depriving owners of Affected Devices performance of those
15 devices that existed at the time of purchase. This conduct is substantially injurious to consumers,
16 offends public policy, is immoral, unethical, oppressive, and unscrupulous, as the gravity of the
17 conduct—diminishing and crippling expected device performance—outweighs any alleged
18 benefits. Specifically, the utility gained by “upgrading” to iPhones with Apple Intelligence
19 capabilities was outweighed by the diminishment of the device functionality. Apple engaged in
20 this conduct at the expense of its customers’ rights when other, lawful alternatives were available
21 (such as providing customers’ with full information about the Affected Devices and delayed Apple
22 Intelligence rollout).
23 111. Apple failed to inform consumers of the reasons for the intentionally implemented
24 delay in software rollout and sub-par performance and user experience. Apple also failed to inform
25 consumers that there would be delays in Apple Intelligence software functionality with material
26 impacts on Affected Devices or users’ experience(s) with the device(s). Apple’s conduct is unfair
27 because it was substantially injurious to consumers, and is immoral, unethical, oppressive, or
28 unscrupulous. Apple’s conduct is not outweighed by any countervailing benefits to consumers.

1 112. Apple’s conduct is fraudulent because Apple represented that the Apple Intelligence
2 software updates contained expansive generative AI improvements, material improvements to Siri
3 capabilities, and concealed that the roll-out of updates would slow down or be non-existent after
4 initial release.
5 113. Apple’s representations and omissions—all which emanated from California—were
6 material because they were likely to deceive reasonable consumers.
7 114. California law prohibits unauthorized computer access and fraud pursuant to Cal.
8 Penal Code § 502.
9 115. As a result of Apple’s installation of incomplete Apple Intelligence software
10 functionality on Plaintiff’s and Class Members’ Affected Devices, Apple knowingly accessed and
11 without permission altered, damaged, deleted, destroyed and otherwise used any data stored on
12 Plaintiff’s and Class Members’ devices.
13 116. Apple accessed and without permission altered and used data on Plaintiffs and
14 Class Members' devices to execute a scheme or artifice to defraud Plaintiffs and the Class
15 Members’ by, among other things, maintaining market share, convincing the Plaintiffs and Class
16 Members to purchase new devices, and to otherwise ensure that Plaintiffs and Class Members
17 would not discover Apple’s underlying fraud regarding its omissions and misrepresentations
18 regarding Affected Devices. As a result, Apple violated Cal. Penal Code § 502.
19 117. The sluggish rollout of Apple Intelligence functionality led to the deterioration of
20 Affected Devices, driving customers to purchase new devices. Customers would not have outlaid
21 the additional costs had they known the truth and had Apple not concealed the Apple Intelligence
22 deficiencies.
23 118. As a direct and proximate result of Apple’s unfair, unlawful, and fraudulent acts
24 and practices, Plaintiffs and Class Members were damaged and lost money or property, including
25 from not receiving the benefit of their bargain in purchasing the Affected Devices as well as
26 increased time and expense in dealing with device performance issues.
27 119. Apple’s conduct and the harm it caused, and continues to cause, is not reasonably
28 avoidable by Plaintiffs and the Class Members. Apple knew or had reason to know that Plaintiffs

1 and the Class Members could not have reasonably known or discovered the existence of software
2 development delays or the subsequent performance problems that a delayed roll-out of Apple
3 Intelligence functionality would cause.
4 120. Had Plaintiffs and the Class Members known that delayed Apple Intelligence would
5 substantially and negatively impact and delay the performance of the Affected Devices, they
6 would not have purchased phones promising that functionality.
7 121. Apple acted intentionally, knowingly, and maliciously to violate California Unfair
8 Competition Law, and recklessly disregarded Plaintiffs and Class Members’ rights, injuring
9 Plaintiffs and Class Members. Apple’s knowledge of the Apple Intelligence functionality
10 deficiencies, device performance issues, and release of software updates put Defendant on notice
11 that the Affected Devices were not as Apple advertised.
12 122. Pursuant to Cal. Bus. & Prof. Code § 17203, Plaintiffs and Class Members seek all
13 monetary and non-monetary relief allowed by law. In addition Plaintiffs and Class Members seek
14 an order: (a) requiring Apple to cease the deceptive and unfair business practices alleged herein;
15 (b) requiring Apple to restore to Plaintiffs and the Class Members any money acquired by means
16 of the deceptive and unfair business practices, including restitution of all profits stemming from
17 Apple’s unfair, unlawful, and fraudulent business practices; and (c) awarding reasonable costs and
18 attorneys’ fees pursuant to Cal. Civ. Code § 1021.5; and (d) any other appropriate injunctive or
19 equitable relief.
20 FOURTH CLAIM FOR RELIEF
Fraud and Deceit
21 (On Behalf of the Nationwide Class and the California Subclass)
22 123. Plaintiffs re-allege and incorporate by reference each and every allegation set forth
23 above, as though fully set forth in this Claim for Relief.
24 124. Apple affirmatively misrepresented and made false and materially misleading
25 statements regarding the capabilities of the Affected Devices when selling and marketing them.
26 125. Apple knew that its representations were false and misleading at the time they were
27 made.
28 126. Apple also knew that its representations regarding the functionality of Apple

1 Intelligence on the Affected Devices were material, and that a reasonable consumer would rely
2 upon Apple’s misrepresentations in deciding whether to purchase Affected Devices.
3 127. Plaintiffs and members of the Class did not and could not have known about the
4 falsity of Apple’s statements.
5 128. Plaintiffs and members of the Class relied upon Apple’s false and misleading
6 statements as alleged herein, and Plaintiffs’ and Class members’ reliance on Apple’s materially
7 false and misleading statements was reasonable and justified.
8 129. Plaintiffs and the Class Members relied on the representation that the Affected
9 Devices would contain the full suite of Apple Intelligence functionalities, including personalized
10 AI-enabled Siri functionalities. Apple concealed that Apple Intelligence was behind schedule and
11 incomplete and was incomplete when released and failed to disclose that such an incomplete
12 release may throttle processors speeds and alter battery conditions.
13 130. Plaintiffs and the Class Members reasonably relied on the representations and
14 omissions made in the software update descriptions and notifications provided by Apple. Prior to
15 purchasing Affected Devices, Plaintiffs and the Class Members did not have access to material
16 facts informing them of the delayed Apple Intelligence roll-out.
17 131. Had the truth been known, Plaintiffs and the Class Members would not have
18 purchased or upgraded to the iPhone 16 line of phones because the functioning of the Affected
19 Devices was not as advertised.
20 132. As a direct result of Apple’s deception, Plaintiffs and the Class Members were
21 harmed. By purchasing Affected Devices, Plaintiffs and Class Members sustained actual losses
22 and damages caused by Apple’s false representations regarding Apple Intelligence and the
23 Affected Devices.
24 133. Apple’s wrongful acts were done maliciously, oppressively, deliberately, and with
25 intent to defraud Plaintiffs and the Class Members. As a result, Plaintiffs and the Class Members
26 seek punitive damages.

6 135. Apple had a duty to Plaintiff and the Class to exercise care in the developing,
8 136. Apple breached its duties through its false advertising and promotion of Apple
9 Intelligence and the functionalities they would have on the Affected Devices.
10 137. Apple knew or should have known that the qualities and characteristics of the
11 touted products were not as advertised and represented by Apple and its agents.
12 138. As a direct result of Apple’s conduct, Plaintiffs and the Class Members were
13 harmed. By purchasing Affected Devices, Plaintiffs and Class Members sustained actual losses
14 and damages caused by Apple’s false representations regarding Apple Intelligence and the
15 Affected Devices.
19 139. Plaintiffs re-allege and incorporate by reference each and every allegation set forth
21 140. Defendant expressly warranted that the Affected Devices would perform as
22 advertised. Defendant’s claims regarding the Affected Devices constituted an affirmation of fact,
23 promise, and/or description of the goods that became part of the basis of the bargain and created an
24 express warranty that the goods would conform to the stated promise. Plaintiffs and the Class
26 141. All conditions precedent to Defendant’s liability under this contract have been

3 143. As a result of Defendant’s breach of contract, Plaintiffs and the Class Members
4 have been damaged in the amount to be determined at trial.
5 SEVENTH CLAIM FOR RELIEF
Breach of Implied Warranty of Merchantability

(On Behalf of the Nationwide Class and the California Subclass)

8 144. Plaintiffs re-allege and incorporate by reference each and every allegation set forth
9 above, as though fully set forth in this Claim for Relief.
10 145. Unless excluded or modified, a warranty that a good shall be merchantable is
11 implied in a contract for their sale, if the seller is a merchant with respect to goods of that kind.
12 146. Defendant is a merchant with respect to products such as the Affected Devices at
13 issue.
14 147. In order to be merchantable, goods must conform to the promises or affirmations of
15 fact made in the advertising of the product.
16 148. Defendant breached the implied warranty of merchantability to Plaintiffs and Class
17 Members in its representations that the Affected Devices contained the Apple Intelligence and Siri
18 capabilities advertised, when those representations were actually false.
19 149. As a result of Defendant’s misleading conduct, Plaintiffs and Class Members did
20 not receive merchantable goods as impliedly warranted by Defendant.
21 150. Defendant did not exclude or modify the Product’s implied warranty of
22 merchantability.
23 151. As a proximate result of Defendant’s breach of its implied warranty, Plaintiff and
24 Class Members incurred damages.
25 152. Plaintiffs and Class Members were damaged as a result of Defendant’s failure to
26 comply with its obligations under the implied warranty, since Plaintiffs and the Class paid for the
27 product, the Affected Devices, that did not have the promised quality and nature, paid a premium
28 for the Affected Devices, when they could have instead purchased other less expensive

1 smartphones or other products, and Plaintiffs and Class Members lost the opportunity to purchase
2 similar products that provided the capabilities advertised.
3 153. As a result of Defendant’s breach of contract, Plaintiff and the Class Members have
4 been damaged in an amount to be determined at trial.
5 EIGHTH CLAIM FOR RELIEF
Unjust Enrichment

8 154. Plaintiffs re-allege and incorporate by reference each and every allegation set forth
9 above, as though fully set forth in this Claim for Relief.
10 155. To the extent required by law, this cause of action is alleged in the alternative to
11 legal claims, as permitted under Fed. R. Civ. P. 8.
12 156. Plaintiffs and Class Members paid Defendant the value of Apple Intelligence and
13 Affected Devices that would make their phones fully functional with AI technology at the time of
14 purchase or lease, or within a reasonably short period thereafter.
15 157. In exchange, Defendant provided Plaintiffs and Class Members with Affected
16 Devices and Apple Intelligence functionality that could not meet Plaintiff’s and Class Members’
17 reasonable expectations created by Defendant’s marketing, labelling, and other representations.
18 158. Defendant knew or should have known that the Apple Intelligence and Affected
19 Devices could not meet Plaintiffs’ and Class Members’ reasonable expectations created by
20 Defendant’s marketing, labelling, and/or other representations.
21 159. As such, Plaintiffs and Class Members conferred value upon Defendant which
22 would be unjust for Defendant to retain.
23 160. As a direct and proximate result of Defendant’s unjust enrichment, Plaintiffs and
24 Class Members have suffered and continue to suffer economic and other harms.

WHEREFORE, Plaintiff, individually and on behalf of the Class, respectfully requests that

1 A. Determine that this action may be maintained as a class action pursuant to Federal
2 Rule of Civil Procedure 23(a), (b)(2) and (b)(3);

5 C. Appoint Plaintiffs as the Class Representatives;

13 H. Award restitution, including the disgorgement of all money or other financial benefit
14 realized by Apple as a result of its wrongful conduct, payable to Plaintiffs and the

16 I. Award punitive damages, including treble and/or exemplary damages, in an
17 appropriate amount;
18 J. Enter an injunction permanently barring continuation of the conduct complained of
19 herein;
20 K. Award Plaintiffs and the Class the costs incurred in this action together with
21 reasonable attorneys’ fees and expenses, including any necessary expert fees as well as
22 pre-judgment and post-judgment interest; and
23 L. Grant such other and further relief as is necessary to correct for the effects of
24 Defendant’s unlawful conduct and as the Court deems just and proper.
