In this context, the undersigned scrutinized the drawings/plan

provided by the HPPWD Authorities and discussed the entire matter with Junior
Engineer (Civil) of the bank, on 28.08.2024, the outcome of the discussion are as
under:-

1. 1. Total carpet area rented out to HP State 4015 Sq. ft.

dated30.09.2020 excluding canteen and 373.20 m2 (Drawing)
premises under occupation of Police
Department.

2 As per drawing floor wise carpet area

occupied by the bank.

Total 358.09 m2

As is evident from 2(iii) above the carpet area measured is 136.26

m2 which also includes area of canteen and kitchen i.e. 54.28 m2 (Drawing ‘B’)
but it has not been physically handed over to the bank Authorities.

In this context, it is apprised that There is a proposal for

construction of Bus Stand at Nohradhar. The land of Jal Shakti Vibhag was
proposed for construction of this bus stand. The total land is 3.10 Bigha on
which building of JSV is located covering area of 1.18 Bigha. the matter was
taken up with the Executive Engineer Jal Shakti Division Nohradahr for
issuance of NOC in respect of the balance land i.e. 1-12 Bhigha comprised in
Khasra No-4859/4586/4514/ 2926/ 2855/ 479/ 1 situated in Mauza Nohra Tehsil
Nohradhar District Sirmaur (H.P), who in turn informed that they have no
objection for transfer of the above said land to the Authority in case their higher
Authorities agrees for the same.
A committee was constituted for inspection of land for
construction of Bus Stand, Nauradhar, Distt. Sirmour, Himachal Pradesh.
BSM&DA has taken up the matter with the principal Secretary (tpt.) during
November 2022 to take up the matter with Secretary JSV at Govt. level.
You are, therefore, requested to raise the issue with the Principal
Secretary (Tpt.) for No Objection Certificate from the Secretary (Jal Shakti
Vibhag) please.

It is submitted here that the next Board meeting of the Authority is
scheduled to be held on 26.11.2024. A decision was taken during 69 th Board
meeting held on 28.06.2024 to constitute a committee under the chairmanship of
Executive Director and it was also decided to nominate two non-official members
by Hon’ble Chairman to be members of this committee. A request in this regard
was made to your good self on 22.07.2024 (Copy attached) to nominate two non
official members for this committee but no response has yet been received in this
regard.
It is therefore, once again requested to kindly nominate two non-
official members in the committee to be constituted regarding construction of

submitted that the matter regarding construction of commercial complex / Car

Parking / Multipurpose shopping complex at Theog Old Bus Stand was placed
before Board of Directors in its 63 rd meeting vide item No. 63.21, wherein it was
decided to develop the vacant space as commercial complex/parking place/
Multipurpose shopping complex at old bus stand Theog on PPP mode. Later on,
it was decided in a meeting held on 27.06.2022 under the Chairmanship of the
then CEO that DM, Shimla and Executive Engineer, BSM&DA will jointly inspect
the site and plan construction accordingly. In compliance to this, the site was
jointly inspected by DM, Shimla and EE, HPBSM&DA. As per the inspection the
empanelled Architect was instructed to prepare the concept drawings of
proposed commercial complex. The Architect submitted, the concept drawing
which is yet to be finalized.

Recently, the matter came up for discussion in the 69th meeting of

BOD held on 28.06.2024 wherein the Board directed to constitute a committee
under the chairmanship of the Executive Director, HRTC and having officers of
HRTC/BSM&DA as members. Further, it was also decided by the BOD that two

land measuring 0.3534 hectares has been selected. Being a forest land,
there is a requirement to obtain approval under Forest Conservation Act,
1980 for this a proposal to divert this forest land (Proposal No.
FP/HP//others/148085/2021) was submitted online on 05.10.2021. The
Deputy Conservator of Forests, Rampur Forest Division, forwarded the
proposal to the Nodal Officer, HP on dated 20.05.2023. A query with

Sub: Regarding relaxation in payment of advance rent and

security amount in respect of shops & accommodation
allotted to Government Departments in bus stands.
Sir,

It is submitted that HPBSM&DA has recently notified revised rent

policy on 20.11.2023 for allotment of shops in bus stands. This rent policy
provides that the shops are to be provided by following the procedure of tender-
cum-open auction. As per the provisions of this rent policy the rent of the shop is
to be deposited every month in advance on or before 7 th of each month. Further,
there is also a provision of furnishing security deposit based on category of bus
stands as indicated below:-

As per the decision of BOD, shops/stalls or open space is being

provided to government agencies like HPMC, Milkfed etc in various bus stands
after getting the rent assessment through HPPWD. Apart from it, accommodation
is also provided to other government agencies such as police Deptt, HPSEB,
HIMURJA, HP Co-operative Bank, ARTRAC etc. in bus stands. These
government agencies were asked to deposit the security amount as per the
requirement of rent policy, but they have submitted request seeking exemption of
this condition. After examination of the issue, it is resolved that being government
department/entities of Himachal Pradesh, the request for giving relaxation in
deposit of security amount and advance amount of rent can be considered.

The matter is accordingly, placed before your good-self to consider

providing relaxation to government agencies of HP in the aforementioned
conditions of rent policy i.e advance payment of rent and submission of security
amount as per detailed proposal at Annexure-“A”. A clause concerning this
relaxation shall be incorporated in the rent policy accordingly and the same shall
also be placed before the Board of Directors of Authority for ratification.

feasible for constructing bus stand.

In this context, it is informed that the bus stand at Lakkar Bazar is

re-constructed under Shimla Smart City project through RTDC and all the shop
keepers have been shifted temporarily to Ice Skating Rink. On completion of
construction work the shop keepers shall be allotted shops in bus stand Lakkar
Bazaar.

Further, the applicant also submitted similar applications to under

signed directly on many occasions but his request was denied due to non-
availability of shop/space in old bus stand. It is also added that Sh. Yashpal
Singh has not deposited license fee since April, 2022 and since then rent amount
is outstanding against the above licensee. The matter for recovery of outstanding
rent is being contested by this organization under amount Public Premises and
(Land Eviction & Rent Recovery) Act 1971 before the Hon’ble Court of Ld.
Collector-cum-Magistrate Shimla Urban.

Car Parking / Multipurpose shopping complex at Theog Old Bus Stand was
placed before Board of Directors in its 63 rd meeting vide item No. 63.21, wherein
it was decided to develop the vacant space as commercial complex/parking
place/ Multipurpose shopping complex at old bus stand Theog on PPP mod.

The issue was further discussed in its 65 th meeting held on

25.11.2020 and the BOD directed to submit the fresh demarcation report with
exact detail of land available after encroachment and also the detail of land
encroached. Accordingly, Unit Officer was asked to furnish the fresh demarcation
report and also mentioning the detail of encroachment. In response to this the
Unit officer has forwarded the demarcation report as well as revenue papers. The
perusal of this demarcation report revealed that Sh. Mohinder Singh has
constructed path from the land of HRTC who has assured to remove the same
when HRTC will start the construction work of this project. This Demarcation also
reveals that the quarters of Police department are also existing on 652-48 sqm.

stand Tikkar forest land measuring 0-21-26 hectare comprising in Khasra
No. 76/2 has been selected. Being a forest land, FCA case has been
moved for diversion of this forest land for construction of Bus Stand which
is under process and FCA approval is awaited. There is no provision of
funds in the budget for this bus stand. Since FCA case is in process and
the proposed land has not yet transferred, as such no budget provision
can be made for construction of this bus stand for now. However, it will
taken under RNS in next Financial year.

Khasra No. 1267/1 measuring 00-21-90 hectare situated at Up-Muhal Chhitkul
for construction of bus stand Chhitkul. This land is a forest land and requires
approval under FCA, 1980 for diversion of land for construction of bus stand.

It is further submitted that till now there is no decision taken to

construct bus stand at Chhitkul and the land has to be finalized by a Technical
Committee before processing the case further by looking into the feasibility of
constructing bus stand.

The status is accordingly placed for decision whether Bus stand at

Chhitkul is to be constructed and in case this demand is considered it shall
require provision of funds from the state government and selection of suitable

It is informed that during 2014 the Hon’ble Chief Minister, HP
announced to construct bus stand Jalog. Accordingly, the process of land
selection was started. The joint committee selected a forest land bearing Khasra
No. 181, 201 measuring 0.2880 hec. For diversion of this land clearance under
Forest Conservation Act, 1980 was required for which online FCA case was filed
with DFO, Shimla. An amount of Rs. 10,16,026/- on account of NPV and
compensatory afforestation was also deposited.

. the Additional Chief Secretary (Forest) to the Government of HP

conveyed approval vide letter No FFE-BF(2)-3/2021 dated 1.6.2021 for
diversion of 0.2880 hectare land. While carrying out the process of land transfer,
it was observed by Revenue Authorities that the land is measuring 0.20.65
hectare instead of 0.2880 hectare as shown in the approval letter. Due to this
variation, the land could not be transferred in the name of Transport Department
for now. The issue is being resolved.

It is further submitted that the construction work of this Bus Stand

has been allotted to HPPWD as deposit work who has submitted an estimate
amounting to Rs. 121.72 lakh. The State Government has kept a budget
provision of Rs. 27.51 lakh for this bus stand till financial year 2023-24. Your
good self is therefore, requested to kindly consider the demand raised by
Hon’ble Minister of HPPWD to make budgetary provision for construction of this
bus stand so that construction activities of this bus stand are started..

 The government land comprising in khasra No. 299,300,302,
303,304,305,306,110/103,274,275/1,109/102,114/106,301,281,282,
284,285,286,289,290, total measuring 15 Bigha 9 Biswa situated in Chack
Rohroo( Janog Ghat) Theog had been transferred in the name of
Transport Department for the construction of Bus Stand at Theog and
Commercial Complex.
 The Authority has released a sum of Rs.855.00 lakh to HP PWD
Authorities w.e.f 24.03.2015 to 16.02.2021. The provision of Rs.150.00
lakh has been made in the budget for the financial year 2021-2022 which
is yet to be released by the State Govt. Thus total budget up to 2021-2022
is Rs.1005.00 lakh. Authority has released amounting to Rs. 855.00 lakh
to HP PWD authorities till date.
 The PWD Authorities vide letter 19.07.2021 conveyed that 70% work has
been completed against AA/ES of Rs. 1459.22 lakh and also informed that
deposited funds of Rs.855.00 lakh have been utilized up to July,2022 and
demanded further amount to ensure early completion of the work. The
Authority has lastly of Rs.200.00 lakh on 14.09.2022.

 BOD decided to develop the vacant space as commercial complex/parking

place/multi-purpose shopping complex at old bus stand Theog in PPP
mote. DM BSMDA will process the codal formalities for the demarcation of
land and submit the RFP at the earliest to CEO.

Sub: Regarding extension of period of agreement in respect of

canteen run under “Rajiv Thali Yojna”.
On 15th April, 2016, the then Hon’ble Transport Minister announced
that HPCT&BSM&DA will provide meal to passengers @ ₹ 25/-. Accordingly in
54th meeting of BOD it was decided that, “BSM&DA along-with Civil Supply
Corporation will start ‘Rajiv Thali Yojna’ for providing hygienic food @ ₹ 25/- per
Thali at bus stands containing Two Roti, One Bowl rice, One Bowl Daal, one
Bowl Sabji or Kadi for which capital investment will be provided by the Civil
supplies under its CSR scheme and utensils are also to be provided by the Civil
Supplies Corporation.
After the approval, canteens were allotted to the persons on the
bus stand to run the Rajiv Thalli Yojna :-

It is also submitted that initially the Canteens were allotted to

licensee for 11 months. Thereafter, the matter was again placed before BOD vide
item 61.02 to extend the agreement period of Rajiv Thali Yojna and it was
approved that the same may be provided for 5 years for existing as well as for
new licensees in view of the fact that licensees have invested high amount in
renovation of the shops / canteens and its recovery may not be possible within
11 months. Accordingly, the agreement with licensee of canteen at ISBT,
Tutikandi and Mandi were extended for five years and for other bus stand the
decision was kept pending till the next BOD meeting.
This scheme was again placed before the BOD in it its 63 rd
meeting held on 12.07.2019 for review and the BOD decided not to extend the
agreements of the licensee for further period. Accordingly, this office issued order
dated 29.7.2019 directing unit concerned not to extend the agreement for further
period. In furtherance to this, RM HRTC Una issued a letter to licensee of Rajiv
Thalli Canteen at bus Stand Una. In pursuance of aforesaid decision the
canteens were got vacated from all licensees except at Bus Stand Mandi &
Shimla. On the issue of these orders the licensees filed cases in Hon’ble High
Court of HP and Hon`ble Court stayed the operation of the order issued by RM
concerned. Thereafter, on 09-01-2020 the Hon’ble Court directed the then CEO,
BSM&DA to appear in person before court on 10.01.2020. Accordingly,
undersigned attended the Hon’ble High Court in person and the court was
appraised that this matter shall be placed before the Board of Directors for
review. The Hon’ble court also directed that till further orders respondents are

restrained from acting upon communication dated 30.07.2019. Accordingly this
office issued direction to concerned Unit officers vide communication dated
30.01.2020 to hand over the possession to the licensee of Rajiv Thalli Canteen
after completing all codal formalities.

Thereafter, The direction was issued to all the unit officers on

24.02.2020 to continue with the earlier decision taken by the BOD in its 61 st
meeting to fix the agreement period for five years of Rajiv Thalli Yogna for five
years from the date of the agreement only in respect of the existing Rajiv Thalli
Canteens which is approved by the Hon’ble Chairman.
The case was listed on 28.02.2020 the hon’ble High Court past the
following order:
In compliance to the order dated 09.01.2020 the then CEO
BSM&DA present in person and has assured the cout that he would be
taking up the matter in special Board of Directors meeting which is likely to
be called surtly. His statement is taken on record.
In view of the assurance given by the CEO, list the case for
further proceedings on 28.02.2020. the personal presence of the CEO is
dispensed with.”
In compliance to the aforesaid order, learned standing counsel
for the respondent has placed on record communication dated 24.02.2020,
which is taken on record.
The communication reveals that the matter was placed before
the chairmen of the HPCTBSM&DA and a decision was taken to continue
with the earlier decision taken by the BOD in its 61 st meeting to fix the
agreement period for five years.
Now, that the grievance of the petitioner stands redressed,
therefore, the instant petition is rendered in fructuous in view of trhe
decision taken by the respondents and is disposed of as such, so also the
pending application if any.
It is submitted that now the period of five years of Rajiv Thali Yojna
of Bus Stand Solan, Bilaspur and Una stands completed on 31.01.2022.
Accordingly, the issue is placed before the Hon’ble chairman to issue orders
whether the allotment under Rajiv Thalli Yojna now named as Annapurna is to be
continued or to be dispensed with as it has completed five years period as per
the orders of Hon’ble High Court.
