ORDER:
In the Government Order first read above, orders were issued introducing a
new Rules viz., FR 22-B, which contemplates fixation of pay of a Government
employee when promoted or appointed to a higher post. Those orders were effective
from 23rd August, 1983.
2. In the government order second read above, orders were issued extending the
benefit envisaged in the Government Order first read above, from retrospective date
that is from 25-12-1982, with monetary benefit from 23-08-1983.
3. In the Government order 3rd read above, orders were issued removing the pay
limit and allowed the benefit of FR 22-B to all the employees when promoted or
appointed to a higher post carrying duties and responsibilities of greater importance
than those attached to the post held by them in the previous post.
4. In the Government order fourth read above, orders were issued, governing the
Revised Automatic Advancement Scheme with effect from 01-08-1993, with a
stipulation that the fixation of pay of an employee who is holding Special Grade /
Special Promotion Post when he is promoted to the post as per service rules, shall be
made under FR 22(a)(i) only.
5. In the Government Order fifth read above, orders were issued withdrawing the
benefit or fixation of pay under FR 22-B on promotion on or after 01-08-1993 to
government servants who are enjoying the benefit under the Automatic Advancement
Scheme. In the Government order sixth read above, an amendment was issued to the
government order fifth cited, effecting the date from 01-07-1992.
6. The Pay Revision Commissioner, 2005, in his report among other things,
recommended for the continuance of the Automatic Advancement Scheme with some
modifications. Basing on the said recommendations, in the Government Orders
seventh read above, orders were issued, for fixation of pay of an employee who is
holding Special Grade / Special Promotion Post Scale – I under FR 22-B when he is
promoted regularly, on or after 01-07-2003.
7. Consequent on the issue of the above orders, it has become necessary to
amend rule 22-B of the Fundamental Rules so as to be in conformity with the orders
issued in G.O.(P).No.241 Finance ([Link]) Department Dt.28-09-2005.
8. Accordingly, the following Notification shall be published in the extraordinary
issue of A.P. Gazette, Dt.18-11-2005.
NOTIFICATION
In exercise of the powers conferred by the proviso to Articles 309 of the
constitution of India and of all other powers hereunto enabling, the Governor of
Andhra Pradesh hereby makes the following amendment to the Fundamental Rules.
The amendment hereby made shall be deemed to have come into force with
effect on and from 01-07-2003 and the monetary benefit shall accure from
01-04-2005.
AMENDMENT
In the said rules, in rule 22-B, after the existing provisos, the
following proviso shall be added namely:-
Provided also that where a Government employee who is
holding Special Grade / Special Promotion Post Scale – I when he /
she is promoted regularly on or after 01-07-2003 to next higher post,
his / her pay in the time scale of higher post shall be fixed in terms of
FR 22-B.
