PETITION
COMES NOW, the Petitioner, assisted by the
Department of Agrarian Reform (DAR) - Bureau of
Agrarian Legal Assistance (BALA) and unto this
Honorable Board, most respectfully alleges the following,
to wit:
1. That petitioner, Department of Agrarian Reform of
Tarlac Provincial Office represented by its OIC -
Provincial Agrarian Reform Program Officer II, EnP.
Rogelio B. Marzan Filipino with postal address at, 2nd
Floor Pinnacles Bldg., Tarlac-Sta. Rosa Road,
Matatalaib, Tarlac City, where it may be served with
processes of the Honorable Office through the
undersigned counsel's address herein below stated,
where they may be served with Summons, and other
processes of the Honorable Board;
2. That public petitioner the DAR Province of Tarlac
through its instrumentality is task with parcelization
of Collective Certificate of Land Ownership Award
(CCLOA) in the names of Agrarian Reform
Beneficiaries (ARB’s) pursuant to Section 5 of R.A.
No. 6577 as amended by Section 10 of R.A. No. 9700;
3. That the subject land of the instant petition is covered
by CCLOA No. 17634 registered in the names of
Dindo Capit, Nardo L. Capit, Rolando M. Caputol,
Jose D. Sibal, Rosila V. Samson, Marie C.
Montemayor, Liezel C. Montemayor and Adelaida
C. Montemayor, in equal share pro indiviso situated
in Barangay O’Donnell, Capas, Tarlac, containing an

area of One Hundred Nine Thousand Nine Hundred
Sixty-Two (109,962) square meters;
4. That sometime in March 8, 2022, the above name
ARB’s have agreed to the subdivision survey and
committed among themselves as a ARB’s of their
respective lots and area allocated and on the
corresponding C- Titles to be generated, registered
and issued therefrom by the Registry of Deeds (ROD),
to wit:

Attached herewith is a copy of Lot Allocation
Agreement on Lands Covered by a Collective
Certificate of Land Ownership Award and Carper Lad
Form No. 70-E as Annex- “A”
5. That the above stated agreement will be the basis for
the issuance of Order of parcelization upon approval
of this Petition by the Honorable Provincial
Adjudicator.

WHEREFORE, premises considered, it is
respectfully prayed that after due consideration of this
petition, judgment be rendered:
ORDERING the Confirmation of the Lot Allocation
Agreement on Lands Covered by a Collective Certificate
of Land Ownership Award in the names of Dindo Capit
in an area of 900 square meters, Nardo L. Capit for
906 square meters, Rolando M. Caputol for 17,932
square meters, Jose D. Sibal for 14,051 square
meters, Rosila V. Samson for 4,204 square meters,
Marie C. Montemayor in an area of 18,884 square
meters, Liezel C. Montemayor in an area of 23,089
square meters and Adelaida C. Montemayor with an
area of 29,996 square meters.
Other just and equitable remedies available under
the premises are likewise prayed for.
