AFFIDAVIT
I, MR. SHIRISHCHANDRA DEEPCHAND CHITTE (Aadhar
Card No.6706 7012 6532), aged 49 years, an adult, Indian
Inhabitant, residing at 403, Narmada, Vijay Baug, Murbad Road,
Opp. Roshan Petrol Pump, Kalyan - 421301, the applicant /
accused named above do hereby state and declare on solemn
affirmation as under: -
1. I state and declare that my true, correct and complete name is
SHIRISHCHANDRA DEEPCHAND CHITTE but due to
inadvertence of complainant in cause title of this case my name has
recorded as SHIRISH CHITTE, while both the above names
SHIRISH CHITTE and SHIRISHCHANDRA DEEPCHAND
CHITTE are belongs to one and same person i.e. myself.
2. I state that I had prosecuted by the complainant named above for
the offence u/s 138 of Negotiable Instrument Act, 1881 and I had
granted bail by this Hon’ble Court and accordingly I had been
released on furnishing Cash Bail Amount of Rs.15,000/- (Rupees
fifteen thousand only) under cash bail receipt No.______________
dated ___________.
3. I state that the above said case / matter has been disposed-off as
withdrawn on 10/12/2018 by this Hon’ble Court.
4. I state that the Hon’ble Court has directed by order dated
10/12/2018 to refund the amount of cash bail to the accused after
passing appeal period.
5. I state that the appeal period has been over and the complainant
has not filled any appeal but the above said amount of cash bail of
Rs.15,000/- (Rupees fifteen thousand only) under cash bail receipt
No.______________ dated ___________ is lying with this
Hon’ble Court.
6. I state that I want to withdraw the above said amount of cash bail
of Rs.15,000/- (Rupees fifteen thousand only) but the said original
cash bail receipt issued by this Hon’ble court has been lost or
misplaced from my possession my house/office and same is not
traceable from my diligent search.
I am making this affidavit in order to submit the same
before this Hon’ble Court to show the above said facts regarding
loss or misplace of original cash bail receipt.
Whatever stated here in above is true and correct to the best
of my personal knowledge and belief. If any contents of this
affidavit shall prove to be false then I shall be liable for the
prosecution u/s 236, 237 of B.N.S.
