Re: Rescission of Contract and Demand for Full Refund

Dear XXX:

I write to inform you of my decision to RESCIND our contract for my purchase of LOT
______, BLOCK ______ (“Unit”) of ______________________ City project and to DEMAND for
the full refund of my total payments for the purchase price of the Unit in the amount of
PHP____________.00.

I have made several follow ups with your office relative to my purchase of the Unit. I,
however, received not a single reply from your end.

First, there was no delivery of the Unit despite full payment of the purchase price,
notwithstanding the fact that this is a lot-only unit and the purchase price has already been
paid in full.

Second, instead of delivering the Unit, I was instead offered another lot in
_____________. For reasons only known to you, you have not delivered the Unit to me despite
full payment.

Third, I have repeatedly asked for permits and licenses from you, but you kept promising
thereon. To date, you have not shown me said permits and licenses until I was offered a
property swap.

Lastly, my investigation at the Department of Human Settlements and Urban


Development (DHSUD) revealed that your __________________ project HAS NO LICENSE TO
SELL (LTS).

Pursuant to the Contract to Sell which we executed on ______________, I purchased


the Unit and promptly paid in full the equity because I hoped that you could also comply your
end of the agreement straightaway and I could soon transfer and reside at the Unit. With all the
above inaction and lack of LTS of your _______ project, however, you completely failed in your
undertakings and obligations to me.

In view of the foregoing, I formally RESCIND our contract for the purchase of the Unit
and DEMAND for the full refund of our total payments in the amount of
PHP______________.00 WITHIN 30 DAYS from receipt hereof. Otherwise, I will file criminal,
civil, and administrative cases against you and other responsible officers of your company to
protect my interest without further notice. Your continued inaction to this notice and demand
further indicates bad faith and malice on your part. This exposes you to claim for damages and
other fees which I will claim should we resort to further legal action. Thus, give this matter your
preferential attention.

Please be guided accordingly.
