SEEKING CANCELLATION/RECALLING OF NON _ BAILABLE
WARRANTS ISSUED VIDE ORDER DATED 03.08.2023

Most respectfully submitted as under:

1. That the above noted case is pending adjudication before this Hon'ble Court and

the same is pending for further proceeding. It is submitted that this Hon'ble

Court was pleased to pass an order for issuance of non bailable warrants vide

order dated 03.08.2023 against the applicant herein.

2. That the applicant/accused i.e. proprietor was served with the summons of this
Hon'ble Court and in compliance thereto the applicant/accused appeared before

this Hon'ble Court on earlier dates and the matter was sent for mediation. That

the Applicant was represented by the undersigned counsel.

3. That because of the mistake/ error in the name of the Petitioner “VINI” on the

e-court site, the Counsel missed to find the date in this matter as it was recorded

as “VINNI” and the respondent was also mentioned as SK Electric in place of


“S K Electric” and the matter was missed by the Advocate Clerk of the Counsel

and could not inform the client to appear on 03.08.2023.

It is humbly submitted that the non-appearance of the applicant is neither

intentional nor deliberate but due to reasons stated above. That because of the

inadvertent error of the advocate clerk of the counsel, the accused was not

informed although the accused has been prompt to contact the office of the

counsel for the dates of the case.

That the accused/applicant undertakes to appear on each and every hearing of

thisHon* ble Court.

That the applicant is ready to give undertaking to appear regularly before

thisHonble Court on each and every date of hearing.

Prayer:

It is therefore, most respectfully prayed that this Hon'ble Court may kindly be

pleased to passed an order(s) for recalling/cancelling the NBW issued against the

applicant vide order dated 03.08.2023, in the interest of justice.
