I, Asim Ahmed khan S/o Sartaj Ahmed Khan, Age 37 yrs, Occ: IT
Engineer, R/o H. No: 20-3-914/1 Shah Gunj, Charminar, Hyderabad, T.S do
hereby solemnly affirm and state on oath as follows:
1. That, I am the deponent herein and the Petitioner in the above
G.W.OP. and as such I am well acquainted with the facts of the case.
2. I submit that, I have filed the above GW.OP. for seeking Custody of
my minor daughter by name Fatimah Zohra against my
wife/Respondent herein.
3. I submit that, I have filed an I.A Vide No. 496 of 2024 U/s.12 of
guardian and wards act, R/w sec.151 of CPC for visitation rights of
my daughter namely Fatimah Zahra for every week from Saturday
till Sunday and this Hon’ble court have passed the orders by
granting the said visitation rights to the me every Saturday and
Sunday from 11:00 am 5:00 pm requiring me to pick up and drop off
the child from the respondent's house, pending the disposal of the
O.P
4. I submit that my daughter got the attachment to me and she is
being mentally disturbed due to short visits to me and she is crying
a lot and she is not ready to go back to her mother, with great
difficulty I am convincing her to go back to her mother.
5. I further submit that, due to paucity of time I could not even spend
quality time with my daughter and could even take her to any
parks/places where she usually enjoys due to the limited visitation
hours. The ideal timing for such outings is from 4:00 p.m. to 8:00
p.m., which does not fit within the current schedule.
6. I submit that, the heavy traffic on weekends results in spending two
hours of the granted visitation time in transit, causing stress and
reducing the quality of our time together.
7. I submit that, my daughter suffers from gut issues and needs
regular consultations with her doctor, who is only available on
weekdays. The current schedule does not allow me to take her to
these important appointments.
8. I submit further that, most of the family gatherings, functions,
events and get togethers takes place on weekends from 7:00 p.m.
to 11:00 p.m., and I am unable to include my daughter in these
important social events due to the restricted visitation hours. So, it
is just and necessary to protect my and my daughter’s right
and for the reasons mentioned above herein and to modify
the orders passed by this Hon’ble Court in the interest of
justice.
It is therefore prayed that this Hon’ble Court may be pleased to
modify the order passed in I.A 496 of 2024 dated 01.07.2024 and
allow me to keep my daughters f r o m S a t u r d a y m o r n i n g t i l l
Sunday evening and on long weekends or holidays of
m o r e t h a n 2 d a y s , in the interest of justice, equity and fair
play, else I along with my daughter will be put to irreparable loss
and hardships.

pleased to modify the order passed in I.A 496 of 2024
dated 01.07.2024 and allow me to keep my daughters
from Saturday morning till Sunday evening and
on long weekends or holidays of more than 2
d a y s in the interest of justice for the purpose of urgent
hearing, in the interest of justice, else petitioners will be put to
irreparable loss and hardship, and pass such other order or orders
as this Hon’ble Court deems fit and proper in the circumstances of
the case.
